BE IT RESOLVED that the City of Lakeville enter into an
agreement with the State of Minnesota, Department of Transportation
for the following purposes, to-wits
To provide maintenance and electric energy
for 2 each 200 watt high pressure sodium
lighting units on Trunk Highway No. Sfl
and C.S.A.H. 9 (Dodd Road) in accordance
with the terms and conditions set forth
and contained in. this Agreement, a copy of
which was before the Council.
BE Ifi FURTHER RESOLVED that the proper City officers be .and
hereby are authorized to execute such agreement, and thereby assume
for and on behalf of the City all of the contractual obligations
contained therein.

BETWEEN
THE STATE OF MINNESOTA, DEPARTMENT OF TRANSPORTATION
AND
THE CITY OF LAKEVILLE, MINNESOTA
FOR
Maintenance and electric energy far highway lighting systems on
Trunk Highway No. 50 and C.S.A.H. 9 (Dodd Road) in Lakeville.

THIS AGREEbIENT made and entered into by and between .the
State of Minnesota, Department of Transportation, hereinafter
referred to as the "State", and the City of Lakeville, hereinafter
referred to as the "City", WiTNESSETH:
4vHEREAS, the State intends to award a contract to provide
highway lighting systems on Trunk Highway No. 50 and C.S.A.H. 9
(Dodd .Road) in the City,
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:-
1. The State shall install or cause to be installed said
highway lighting systems at its own cost and expense in accordance
with the plan and specifications for State Project No. 1914-20 and
as shown in Exhibit A attached hereto and made a part hereof.
2. Upon completion of the installation. of the lighting
units the City. shall maintain and keep in repair the complete
lighting system, and provide the necessary electrical energy for
their operation including any extension of power lines at the cost
and expense of the City.
3. Any and all persons engaged in the aforesaid
maintenance work to be performed by the City shall not be
considered employees of the State and all claims that may ar might
arise under the T~orker's Compensation Act of this State on behalf
of said employees while so engaged, and any and all. claims made by
any third party as a consequence of any act or omission on the part
of said City employees while so engaged on any of the maintenance
work contemplated herein shall not be the obligation and

responsibility of~the State. The City shall not be responsible
under the Worker's. Compensation Act for any employees of the State.
4. This Agreement shall continue in force for a term of
one year, commencing on the date of approval by the Commissioner of
Transportation, and shall continue in force from year to year
thereafter; provided, however,- that this Agreement may be
terminated by mutual consent of both parties for reasonable cause
during any term hereof and shall be considered terminated upon
written notice thereof from the State to the City and that in no
event shall this agreercent be extended beyond the period. for. which
either party may legally bind itself.
