HomeMy WebLinkAbout82-061 CITY OF LAKEVILLE RESOLUTION Date September 7, 1982 Resolution No. 82-6~1 Plotion by zaun Seconded By Nelson RESOLUTION WAIVING SUBDIVISION REGULATIONS ON PORTION OF FORMER RAILROAD RIGHT-OF-WAY IN EXCHANGE FOR DEDICATION OF ANOTHER PORTION OF RIGHT-OF-WAY (WITHIN JACQUARD AVENUE) TO THE CITY OF LAKEVILLE WHEREAS, the Farmington-Shakopee Association, Inc., is the fee owner of that portion of the vacated former Chicago, Milwaukee, St. Paul and Pacific Railroad legally described as follows: The East 30.00 feet of the abandoned Chicago, Milwaukee, St. Paul and Pacific Railroad in Government Lot 3, in Section 30, Township 114, Range 24, Dakota County, Minnesota. and WHEREAS, the Farmington-Shakopee Association, Inc., is also the fee owner of that portion of the vacated former Chicago, Milwau- kee, St. Paul and Pacific Railroad property which abuts the property now owned by one Otis Bell and legally described as follows: All that part of the abandoned right-of-way of the Chicago, Milwaukee, St. Paul and Pacific Railroad as shown in Dakota County Recorder's Document No. 570089 lying in the West Half of the Southwest Quarter (W2 of SW 4) of Section Twenty-Six (26), Township One Hundred Fourteen (114), Range Twenty-One (21), described as follows: Beginning at the northwest corner of said SW 4; thence south 139.81 feet to the northerly right-of-way of said railroad, being the actual point of beginning of the land to be described; thence south 89 08'42" east alon~, said northerly right-of-way line to the east line of said W2 of SW4; thence south 100 feet along said east line to the southerly right-of-way line; thence west along said southerly right-of-way line to the west line of said SW~; thence north to the point of beginning and there terminating. and WHEREAS, the Gity of Lakeville would like to acquire the first above described. property from said Farmington-Shakopee Association, Inc.; and WHEREAS, the Farmington-Shakopee Association, Inc., is willing to donate. the first above described property to the City of Lakeville in return for a waiver of any subdivision regulations as to the second above described property. n l • NOW, THEREFORE, BE IT RESOLVED, by the Lakeville City Council: 1. That the City of Lakeville hereby waives all of its subdi- vision regulations as to the second above described property, provided that the Farmington-Shakopee Association, Inc., delivers its Quit Claim Deed to the City of Lakeville to the first above described property in recordable form.
