RESOLUTION REGARDING THE MINNESOTA RENAISSANCE , FESTIVAL PLANNED UNIT DEVELOPMENT APPLICATION WHEREAS, the Minnesota Renaissance Festival has filed an application. for planned. unit development (P.U.D.) zoning; and WHEREAS, the City Planning Commission has conducted a public hearing on the proposed rezoning; and WHEREAS, the City Council:. has carefully reviewed the appli- cation. NOW, THEREE`ORE, BE IT~RESOLVED by the Lakeville City Council as follows: 1. Subject to the conditions set forth herein and such other .conditions as may be determined'-appropriate by the City Council, concept' approval of phase ane , two and three off. -the P . U. D . is hereby- granted,: 2. Approval by 'the City Council of the development stage,: final plans and rezoning shall be subject tothe following conditions: A. Compliance with 'the terms of the. P.U.D. provisions of .the City°s Zoning Ordinance. B. Satisfactory resolution of potentialtrafficproblems at the. applicant's sole expense, including the preparation of an engineering feasibility. report on a full diamond interchange on I-35. C. To the extent that they have jurisdiction, approval of the. County, the Metropolitan Council and its .agencies, the State of Minnesota and its agencies, the Federal Government and. its agencies and full compliance with 'their recommendations. D. Satisfactory environmental safeguards;.. including if deemed appropriate, preparation of an environmental impact statement.. E. Acceptance of precise operation standards and requirements as set forth. no more thane l3 days per year in the months of August and September on Saturday and Sundays plus the Monday .Labor Day; hours of operation limited to 9::30 A.M. to 7:00 P.M. on those. days: -1_ F. Acceptance in the P.U.D. agreement of provisions for an annual review by the City Council fore compliance with the terms of .the agreement and Gity ordinances: governing the operation of the festival, with the review and decisions of the Lakeville City Council to be completed by December 31 of each year; and with the provision that the Lakeville City Council has the sole right to approve or deny the future operation of the festival based.:upon the results of the City's. review of the past years''operation and compliance with the terms of .the P.U.D. agreements. and requirements of appropriate City ordinances or'state laws: The festival owner shall have .the right to propose solutions o problems identified by ;the City Council,• but the City Council shall have the r„ right to reject the:.proposed solutions and deny the. future .operation of the ..festival: G. Acceptance of a provision whereby the'Lakeville City .Council shall have the right after 10 years of festival operation to require the festival owner-to re-apply fora continuance of its license to :operate the festival, based on the`City.Council's determination as to the implementation of phase three. of the P,U.D. plan. A. .The City Council. shall dAt~rmine, if and when the extension of sanitary sewer and water to the festival property must occur to , serve-:the property or any ad1acent or nearby property. I. Acceptance of provisions in the P.U.D. agreement that as a part of the 1986 annual. review by the City..Council that the City Council shall include a study of the feasibility of implementing ..phase-two of the P.U.D. plan, (office/commercial) development of that. part of the. .property, from he standpoint of the. market and need for that type of.development in.Lakeville based upon criteria to be included: in the F. U. D., agreement; and with the acceptance by the festival owner that: the `City Council 'shall have..the sole right to prohibit the exclusive. use by the festival of the approximately 50 acres of land designated. in the P. U D. .concept plan, for phase two office/commercial use thereafter. J._ The acceptance by the festival .owner of provisions in the P.U.D. agreement that require that no less than five (5) non-profit .civic groups. from .the City of Lakeville be involved in the festival commercial activities, and that: all Lakeville.: non-_profit civic groups shall be given priority over any other group from another community. _2- a .t a` ~ ;rte . ~ .l'a The City Council .shall have the sole .right to approve what. group`~on- stitutes a civic group from Lakeville, with criteria to be included in the P.U.D. agreement as to what constitutes an acceptable .group. K: Acceptance of criteria in the P.U.D. agreement provisions as to,what will constitute an unaccept~.ble traffic condition,. such as congestion at I-35 and T.H. 50; I-35 and. Dakota. County Road 70; 188th .and/or 185th Street and T.H. 50; and at the intersection of Minnreg-Road and the west frontage road:. L. Acceptance'of provisions of the P.U.D. agreement that require the festival owner to correct any ..problems or inconveniences to adjacent and nearby property owners as`drected by the City`of Lakeville.. M. Acceptance of pravis~.ans in 'the P.U.D. agreement for.: the City'Councl to have the right to determine what measures must be taken- in insure the public health, s~.fety and welfare of the public during the period of time the festival begins preparation for the annual .operation, k. thru and after.itsoperaton, with all costs to the City of Lakeville to be paid for by the festival owner. N. Acceptance of the provision that the Lakeville City Council shall have the right to approve or deny the P.U.D. development agreement -after all other appropriate governmental jurisdictions have acted upon this application, regardless of their approval, and the applicant agrees :concept. approval shall have no binding. effect on the final determination of the application and waives its right, if any, to bring suit if final approval is denied. O. .Approval and adoption by the City Council-by a 4/5 majority vote of an ordinance to rezone the property to Planned Unit Development, P. Such .other and additional conditions as may,. be deemed- appropriate by'the City Council. 3. The.City attorney. and. City. staff are directed to prepare a draft of a Planned Unit Development Agreement, including but not limited to, conditions set forth above. ADOPTED-this 1st day of June , 1981.
