HomeMy WebLinkAbout80-135 r Councilmember zaun then introduced the .following resolution and called for its adoption: Resolution No. 80-135 RESOLUTION APPROVING REDEVELOPMENT PLAP3 FOR REDEVELOPMENT PROJECT N0. 1 AND TAX INCREMENT FINANCING PLAN FOR TAX INCREMENT FINANCING DISTRICT NU. 1, MAKING NO ELECTION PURSUANT TO SECTION 273.76 SUBDIVISION 3(b`} OF THE TAX INCREMENT FINANCING ACT AND AUTHORIZING EXECUTION OF COOPERATION AGREEMENT BE IT RESOLVED by the City Council of the City of Lakeville, Minnesota, as follows: Section 1. Recitals. 1.01. Proposed Redevelopment Plan and Financing Plan. The Housing. and Redevelopment Authority in and for the City of Lakeville (the Authority) has determined to undertake a redevelopme.rit project in the City, designated "Redevelapment Project No. 1".(the Project} and has proposed a tax increment financing district designated "Tax Increment Financing District No. 1" (the District). The Authority has submitted to this Council for its approval a Redevelopment Plan for the Project (the Redevelopment Plan) and a Tax Increment Financing Plan for the District (the Financing Plan). The Redevelopment Plan and the financing Plan are hereinafter sor,~etimes referred to as the "Plans." 1.02. Public Hearings _on the Plans. This Council, by resolution adopted November 3, 1980 called pub.lie hearings on the proposed plans for Monday, November _17, 1980. Notice of the hearings was published in a newspaper of_ gener~~l. circulation in ttie City as required by law and said hearings w~_re he1.d on November 17, 1980, and all persons appearing thereat were pe.rmi.tted to present their views on the Plans. 1.03. Written Opinion of_ Planning Commission. Prior to the commencement of the hearings this Council received the written opinion of the Planning Commission of ttie City stating that the Plans are consistent with the City's comprehensive plans for development as a whole and its zoning ordinance. Section 2. Approval and Implementation of Plans. 2.01. This Council has reviewed and considered the proposed Plans, the written opinion of the Planning Commission, the facts and views presented at the public hearings and .other Council meetings concerning the Plans and the facts and circum- stances concerning the City, the Redevelopment Project and the District and their redevelopment. 2.02. On the basis of such review and consideration, this Council hereby determines that (a) ttie proposed redevelopment of the Project area, which includes the District) as specified in the Plans, would not occur solely through private investment within the reasonably foreseeable future. The use of tax increment financing for phase ono o.E the Project, as described in the Redevelopment Plan, is deemed necessary to achieve the redevelop- ment of the District; (b) the Plans conform to the comprehensive plan for the development of the City ~ a whole; (c) the Plans will afford maximum opportunity, consistent with the sound needs of the City as a whole, for the redevG~lopment of the District. by private enterprise; (d) the District is a "redevelopment district" under Minnesota Statutes, Section 273.73 Subdivision 10(a)(1) in that the land comprising the District is predominantly occupied by the buildings, exclusive of any outbuildings, are structurally .substandard to a degree requiring substantial renovation or clearance; and (e) the Project and the proposed redevelopment described in the Plans are necessary and will result in the accomplishment of public purposes specified in Minnesota Statutes, Section 462.415, as are more particularly described in the Plans. 2.03. The proposed Plans are hereby approved. The. .City Clerk-Administrator is .authorized and directed to take all actions on behalf of the City, if required and subject to the approval of this Council as may be required by law, to implement the Plans. 2.04. The City Engineer and the Public Utilities Commission are authorized to p.repar.e feasibility studies relative to the construction of the public utilities and othe:r public improvements to be pr<~vided by the City in accordance with the Plans and the Cooperation Ayr.eement described in Section 4. 2.05. The Authority i_s authorized and directed to take all actions necessary to implE~m~r,t ~anc1 c~_~rry outs the Project and Plan, subject only to such appi~ov l <.~f this Council. as may be required by law. Section 3. No Election. This Council does not make the election provided for in Minnesota Statutes, Section 273.76 Subdivision 3(b). Section 4. Authorization_to _Execute Cooperation Agreement. In order to implement the Plans it is necessa.r_y that the City and Authority enter into a Cooperation Agreement, a proposed form of which has been presented to this Council. The form of Cooperation Agreement, with such variations, insertions and additions as the City Attorney may hereafter deem appropriate, is directed to be executE:d by the Mayor and City Clerk-Administrator, and filed with the Dakota County Auditor.
