The following is the Director's Report for July of 2004.
Spotlight on Business
EDC Member Todd Bornhauser introduced Mark Hebert, business partner in Hebert &
Associates, Inc. and SPOWD Developments, which own the Lakeville Business and
Industrial Center, as the spotlighted business at the July 19"' City Council meeting. A copy
of the information that will be provided to the City Council is attached.
Strategic Plan for Economic Development
The August 24th regularly scheduled EDC meeting has been selected as the date for a
work session on the 2005-2007 Strategic Plan for Economic Development. Todd Rapp,
Senior Director of Himle Horner, Inc., has submitted a proposal to serve as the facilitator for
the meeting which I am currently reviewing with City Administrator. This work session will
be between 4:00 p.m. - 8:00 p.m. on August 24th in the Marion Conference Room and
there will be a break for dinner which will be provided. This work session will involve
discussion and prioritization of the significant issues identified in the questionnaire sent to
City Council and EDC members earlier this month. Additional information will be sent out
to EDC members the week prior to the work session. Please mark your calendars for
August 24`h and the earlier start time of 4:00 p.m. for this important first meeting on
the 2005-2007 Strategic Plan for Economic Development.
Building Permit Update
Through the end of June, the City has issued building permits with a total valuation of
$108,859,166. This compares to a valuation of $86,610,847 during the first six months of
2003. Included in this valuation are permits for 211 new single-family dwellings and 258
townhouse units. Attached is a copy of the full building permit report through June 30,
2004.

The purpose of the Spotlight on Business program is `Yc inform and educate residents on benefits of C/I
base to gain community support and appreciation for business growth" (Goal #1 of the Economic
Development 2004 Strategic Work Plan.) Lakeville Business and Industrial Center Phase I & II has been
selected as the next participant in the Spotlight on Business program. Economic Development
Commission Ex-officio member Todd Bornhauser will be in attendance at the Council meeting to present
information on Lakeville Business and Industrial Center. Business Partner Mark Hebert (pronounced
"He-Bert") will be present to accept the award.
Phase I of the Lakeville Business and Industrial Center was constructed in 2003 at 21021 Heron Way in
the Airlake Industrial Park. The 27,000-square-foot multi-tenant office warehouse building was designed
to have features that would appeal to businesses that have small space needs or those that need space
to accommodate expansion or downsizing. Phase II, a second office warehouse building approximately
36,000 square feet in size, is currently being constructed at 21017 Heron Way. Phase III, a third building
comprising of 27,000 square feet, is in the planning process.
Lakeville Business and Industrial Center Phase I and II offer twenty-one, 3,000-square-foot suites with
approximately 25% office and 75% warehouse/assembly space. The suites were designed to
compliment small businesses with each tenant having a front office entrance and rear elevation having
garage doors with either drive-in or dock capabilities. Separate metered utilities, high ceilings and wet
fire suppression systems are features that will accommodate a wide range of office warehouse tenants.
Tenants in Phase I and II include: Frontier Communications, Braun Intertec, S.G.O. Roofing and
Construction, American Remodelers, C.M.I. Mailing and Marketing, Pinnacle Flooring, Cabinets Plus,
Champion Coatings, Threads, Inc., and Campbell Contracting.
Tenants of Lakeville Business and Industrial Center Phase I and II employ over 130 full-time and part-
time workers. Several tenants employ staff in professional and technical positions with high wage levels.
In addition to employment, Lakeville Business and Industrial Center provides a substantial tax benefit to
the community. The Dakota County Assessor has assigned an estimated market value of nearly $1
million to the Lakeville Business and Industrial Center Phase I building and property. The value has not
yet been assigned to the Phase II building, which is still under construction. Based on current tax
capacity rates, this market value will result in an estimated contribution of $30,171 in local property taxes
going to support the City, Dakota County, and Independent School District 194 in 2005.

Lakeville seeks right balance on athletic center

Lakeville leaders, in pursuing athree-way public-private-school district partnership to construct a community athletic
center, have several questions to consider, among them:
• What is the appropriate level of resident access, and at what cost?
• What rules can the private developer, KPAC LLC, impose, and what should remain under city control?
• How will the school district, with its limited funding and a need for athletic facilities, fit into the deal?

Laurie King, 44, a 23-year Lakeville resident and mother of two children, said she thinks the city should insist upon
securing better access for residents. Under the preliminary agreement, residents who don't join the club as members
would have access to six daily passes a year at $6 to $10 apiece, and the passes would have to be used at least 30 days
apart.
"It'll stop a lot of people from going," King said. "It'll stop the average person from going."
King, who is not related to the King family that owned the 66-acre parcel, said she is perhaps irked most by the fact
that the center will be built on community-owned land.
Lakeville Parks and Recreation Director Steve Michaud has said the center is meant to be a private club. The club will
benefit the school, which will gain use of a pool and an ice azena, and the city, which will get an athletic facility at a
substantially lower cost than what it would take to build a public community center, Lakeville officials have said.
Several of Lakeville's neighbors have had varying levels of success in similar public-private ventures. In some cases,
those suburbs found a good match for their community. In others, residents were surprised and even angered by what
turned out to be more of a private club rather than the public community center many had expected.
Savage, for example, renegotiated the cost of resident pool passes for the second time last week with its partner, Life
Time Fitness. Resident season pool passes have fluctuated in cost since the club's opening in 2002_ They have been as
high as $450 for a family and $250 for an individual season pass. Last week, Savage negotiated the costs to $250 for a
family, down from $400 at the start of the season, and $150 for an individual pass, down from $200.
While Savage City Administrator Barry Stock said he thinks the agreement has worked out well, "some people will
say, 'Well, we didn't get an aquatic center, we got a private club.' Which I think in some respects is legitimate."
The city entered into an agreement with Life Time Fitness in 2000, spending $4.4 million of voter-approved $5 million
on land and the complex's outdoor pool.
Life Time Fitness, Stock said, built the rest a fully loaded, 24-hour fitness center, with all the expected exercise
equipment such as free weights, gymnasiums, a basketball court and an indoor pool; plus such amenities as tanning, a
salon and a bistro.

Savage is leasing the 14-acre club lot to Life Time Fitness for $1 a year for 40 yeazs. After that, the club can purchase
the land for $1 million.
Stock said the center generates between $70,000 and $80,000 a year in property taxes for the city. And, he said, the city
takes on no liability, nor does it have to pay a staff. And the city ended up with a much better facility than the approved
$5 million would have paid for on its own.
"The key thing is to try to negotiate cleazly some of the policy issues related to residents," Stock said.
Family access, for example, has proved a sticky concept. "Let's say Grandma and Grandpa come to town and want to
take [he kids to the pool," Stock said. "Technically, they ie not residents. So what do they pay?"
For families whose property tax dollars helped build the pool, Grandma and Grandpa having to pay the higher, non-
resident rate is frustrating, Stock said.
Lakeville has been mulling several of the same questions. The city, which is donating only land to the deal, approved a
preliminary ground lease agreement with KPAC LLC, which spelled out specific land use terms and policies. The
Lakeville deal has the added complexity of a third partner, Independent School District 194, which will have use of the
center's pools and ice arena based on a pending agreement.
The Lakeville City Council created an ad-hoc advisory committee to help guide the athletic club's development in
7anuary. It met for the first time on July 12 when it toured the Rochester Athletic Club, built by the same developers
that are to build Lakeville's.
The cities of Maple Grove, Champlin and Plymouth have all worked out deals with private clubs and could also serve
as models for Lakeville and other cities. Plymouth, which entered into an agreement with Life Time Fitness and the
Wayzata School District to build a fitness center, might be the city with the deal that most closely mirrors Lakeville's,
given the school component.
Plymouth's recreation superintendent, Diane Evans, said the partnership iscost-effective and a boon to the city and
school district.
"It's a terrific service for the community, and on the same token, it's not a tax burden on the community;' Evans said.
Other south-of-the-river cities are exploring community center options that could include private partnerships.
Shakopee is exploring expansion options for its community center, including a possible agreement with a private entity.
It had considered apublic-private club agreement in the mid '90s, but that failed when the private company pulled out.
In Farmington, city officials are on the verge of approving a community center feasibility study that would consider
several options, among them a possible deal with a private company.
