HomeMy WebLinkAbout04-12-94 CITY OF LAKEVILLE SPECIAL COUNCIL MEETING BOARD OF REVIEW APRIL 12, 1994 The meeting was called to order by Mayor Zaun at 7:00 p.m. Roll call was taken. Present: Councilmembers Johnson, Sindt, Mulvihill, Harvey and Mayor Zaun. Also .present: R. Erickson, City Administrator; J. Walston, Assistant City Attorney; D. Feller, Finance Director; C. Friedges, City Clerk. Mr. Feller provided an overview of the property tax structure and process far those present. He explained that the major factors that determine property taxes are: 1. Market value 2. Tax capacity class rate and resulting tax capacity value 3. Tax capacity rate and resulting property taxes He went on to explain that the entities involved in determining the City of Lakeville's tax capacity rate are: 1. Schools 60.7%) 2. Dakota ounty {21.9%) 3. City of Lakeville (16.0%) . Other regional jurisdictions such as the .Mosquito Control Commission, Metropolitan Council and the Metropolitan Transit Commission levy a total of less than 2%. Mr. Feller explained that the State of Minnesota offers a property tax refund to renters who have household incomes of less than $35,000 and homeowners who have household incomes of less than $60,000. Property owners are also entitled to a property tax refund if their taxes have increased by more than 12%. Mr. Feller introduced Mr. Marvin Pulju, Dakota County Assessor, who explained that the assessor's office is responsible for determining 1994 property valuations, based on current market conditions, for taxes .payable in 1995. Property sales from the period of October 1, 1992, to September. 30, 1993, were analyzed and considered in making the 1994 assessment. He outlined the assessment process, stating 147 residents from Lakeville attended the County's open book meetings held in March. Mr. Pulju explained the new homestead law, stating property owners will only have to re-apply for homestead status once every four years unless the property has been sold. Mr. Bill Peterson, Assessing Services Manager, explained that the County uses a Computer Aided Mass Appraisal (CAMA) system. The CAMA system contains the land and building characteristics of all parcels within the County. The system assigns values to each of those characteristics which. results in total value of the property. If residents have questions about their valuations, they are invited to meet individually with the assessor's staff this evening. The assessor will, often times, schedule a physical inspection of the property upon the owner's request. Mr. Peterson opened the meeting to general questions and comments from the audience. Mr. Ken Wandel asked if property taxes .could, some day, be frozen for retired persons. Mr. Erickson explained that the State Legislature is currently considering, as part of the omnibus tax bill, a provision that would allow property taxes for senior citizens to be frozen (deferred) until such time as the property is sold, so that senior citizens can remain in their homestead. Councilmember Sindt asked .staff to explain the appeal process that a property owner would follow if they are not satisfied with the decision of the Board of Review. Mr. Walston stated the property owner would need to file a written appeal to the County Board of Equalization and/or appear in person at the County's meeting. It was explained that the next step, if still not satisfied, would be to file an appeal to the Minnesota Tax Court. • The City Council and County Assessor concurred that the Board of Review would reconvene on May 2,1994, prior to the regular Council meeting. 94.69 Motion was made by Sindt, seconded by Harvey to receive letters of appeal from the following property owners and refer them. to the- County Assessor's office: James D. Green, 17060 Judicial Road; T.M. Jaeke, PID #22-21173-090-01, #22-21172-080-06, #22-21172-040-03, #22-21170-020-03, #22-21101-410-04; Thomas D. Leuma, 8155-174th Court; Craig S. Wolfson, 17811 Lake Cove Circle. Roll call was taken on the motion. Ayes, Johnson, Zaun, Sindt, Mulvihill, Harvey. Mayor. Zaun recessed the meeting at 7:35 p.m. to allow the property owners present an opportunity to meet individually with the assessor's staff. Mayor Zaun reconvened the meeting at 8:35 p.m. Mr. Pulju stated there were 37 residents in attendance who individually met with the appraisers.
