HomeMy WebLinkAbout0338 ORDINANCE N0. 338 CITY OF LAKEVILLE COUNTY OF DAKOTA, MINNESOTA AN ORDINANCE AMENDING ORDINANCE N0. 167, THE ZONING ORDINANCE, BY ADDING SECTION 44 CONCEPNING THE CREATION OF THE BUSINESS CAMPUS D STRICT, BY AMENDING SECTION 11 CONCERNING BUILDING REGULATIONS AND B AMENDING SECTION 23 CONCERNING GENERAL DISTRICT PROVISIONS. Section 1. Ordinance No. 167 is amended by adding Section 44 to r ad as follows: S CTION 44. "BC" BUSINESS CAMPUS DISTRICT 4 .1 Purpose. The purpose of the Business Campus District is to provide for the e tablishment of business offices, wholesale showrooms, and related uses in an e vironment which provides a high level of amenities, including landscaping, preservation of natural features, architectural controls, pedestrian trails, and other features. 44.2 The following uses are permitted uses in a "BC" District: 1) Commercial/professional offices 2) Wholesale showrooms 3) Conference centers 4) Radio and television stations 5) Governmental and public utility buildings and structures 6) Indoor commercial recreation and outdoor civic events 7) Laboratories 8) Commercial printing establishments 44.3 The following are permitted accessory uses in the "BC" District: 1) Commercial or business building and structures for a use accessory to the principal use but such use shall not exceed thirty C30) percent of the gross floor space of the principal use. 2) Off-street parking as reguiated by Section 12 and Section 44 of this Ordinance. 3) Off-street loading as regulated by Section 13 and Section 44 of this Drdinance. 44.9 The following are conditional uses in a "BC" District. (Requires a conditional use permit based upon procedures set forth and regulated by Section 4 of this Ordinance.) i) Manufacturing, compounding, assembly, packaging, treatment or storage of products and materials provided that: a) The proposed use complies with the performance standards outlined In Section 44.5 of this Ordinance. b> The provisions of Section 4.1.5) of this Ordinance are considered and satisfactorily met. 2) Warehousing/Storage, provided that: a) The proposed use complies with the performance standards outlined in Section 44.5 of this Ordinance. b) The provisions of Section 4.1.5) of this Ordinance are considered and satisfactorily met. 3) Commercial/Industrial Planned Unlt Development as regulated by Section 6 of this Ordinance. 4) Indoor limited retail sales accessory to office/manufacturing uses provided that: ' a) Location. 1. All sales are conducted in a clearly defined area of the principal building reserved exclusively for retail sales. Said sales area must be physically segregated from other principal activities in the building. 2. The retail sales area must be iocated or. the ground floor of the principal building. b) Sales Area. The retail sales activity shall not occupy more than fifteen C15) Percent of the gross floor area of the building. c) Access. The building where such use is located is one having direct access to a collector or arterial level street without the necessity of using residential streets. d> Hours. Hours of operation are iimited to 6:00 am to 10:00 pm. The provisions of Section 4.1.5) of this Ordinance are considered and satisfactorily met. 44.5 BC Design and Performance Standards. The foilowIng minimum requirements shall be observed in the "BC" district subJect to additidnai requirements, exception and modifications set forth in this Ordinance. 1) Site Plan Requirements. a) Legal description and site in acres of the development site. b) Location and size of all buildings, storage, parking, loading, roadways, and all setback dimensions. c) Detailed landscaping plans and specifications. d) Location and width of sidewalks and trails. e) Detailed utility plan, including plans for sanitary sewage disposal, water systems, electrical service, and gas service. f) Detailed grading and drainage plans. g) Detailed building plans for all structures including floor and building elevations and exterior building treatment. h) Detailed description of maintenance procedures and grounds supervision. i) Details as to whether all cf the area will be developed a-portion at a time. J) Detailed phasing plan showing future additions. k) tdame, address and phone number(s) of developer or developers. 2) Lot Requirements and Setbacks. a) Lot Area: 30,000 square feet. b> Lot Width: 100 feet c) Lot setback requirements: 1. Front Yards: Not less than fifty CSO) feet. 2. Side Yards: a. Not less than ten (10) feet on any one side, nor less than thirty (30) feet on the side yard abutting a street. b. Not less than forty (90) feet on the side yard abutting a residential zoning district. 3. Rear Yards: Not Less than thirty (30> feet, nor less than forty (40) feet abutting a residential zoning district. d) Lot coverage. Not less than thirty <30) percent of the lot, parcel or tract of land shall remain as a grass plot including shrubbery, plantings, or fencing and shall be landscaped. 3) Duildina Height All buildings must be in conformance with Section 11.3-2 of this Ordinance. 4) >~uildina tvpe and construction All building materials and construction must be in conformance with Section 11.4 of this Ordinance. 5) rkin . a> Detailed parking plans in accordance with Section 12 of the Zoning Ordinance and the additional requirements of the section listed below, shall be submitted for City review ar,d approved before a building permit may be obtained. 1. The parking area shall be setback a minimum of ten (10) feet from any property line. 2. The parking lot in front of the building shat be screeneC from the street and from adjoining property in conformance withthe Provisions of Section 9.7 ar,d Section 9.8 of the Zoning Ordinance. 6) Loadino. Any structure erected or altered for a use which requires the receipt or distribution of materials or merchandise by trucks or similar vehicles, shall provide off-street loading space in conformance with the' provisions of Section 13 of the Zoning Ordinance and .the following additional requirements: a) A detailed off-street loading plan including berths, area, and 'access shall be submitted to the City for review and approval prior to issuance of a building permit. b) The location of the loading area shall not be in the front of the building. c) All areas intended to be used for loading including access shall be surfaced with bituminous or concrete. 7) Trash Receptacles. All buildings shall provide an enclosed trash receptacle area in conformance with the following: a) Exterior wall treatment shall be similar and/or complement the principal building. b) The enclosed trash receptacle area shall be located In the rear or side yard. c) The trash enclosure must be in an accessible location for pick-up hauling vehicles. d) The trash enclosure must be fully screened from view of adjacent properties. 8) Landscaping. A detailed landscaping plan in conformance with Section 9.7 of the Zoning Ordinance shall be submitted to the City Council and approved before a building permit may be obtained. 9) useable Open Space. Every effort shall be made to preserve natural ponding areas and features of the land to create passive open spaces. 10) Outdoor Storage. Open and outdoor storage is a permitted accessory use under the following conditions. x a) The storage area is in compliance with Section 9.15.6 of this Ordinance. b) The area is fully fenced, screened and landscaped from adjacent properties according to a plan approved by the Zoning Administrator and a landscape security as determined by the Zoning Administrator is provided. c) Storage area shall be limited to a maximum of twenty (20) percent of the gross ]ot area. d) Storage area shall be setback thirty C30) feet from all property lines. e) The storage area is surfaced with bituminous to control dust. 11) Sicanage. A comprehensive sign plan must be submitted in conformance with Section 7.6 of the Sign Ordinance. Section 2. Ordinance No. 167 is amended by amending Section 11.3, Subsection 2 to read: 2) No structure shall exceed three (3) stories or thirty-five (35) feet, whichever is least, in the "R-6" "R-'r", "F.-B", "B-3", "B-4", "CBD-C", "B-W", "BC", or "I-1" Districts. Section 3. Ordinance No. 167 is amended by adding Section 23.1, Subsection 2.g. to read as follows: g) "BC", Business Campus District Section This Ordinance shall become effective immediately upon its passage and publication.
