HomeMy WebLinkAbout0320 f r. • • ORDINANCE N0. 320 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDIPANCE AMENDING ORDINANCE N0. 167, BEING THE ZONING ORDINANCE OF THE -CITY OF LAKEVILLE. THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS AS FOLLOWS: Section 1. That Ordinance No. 167, Section 47.5 is hereby amended to read as follows: 47.5 Minimum Lot and Setback Requirements. 1) The following chart sets forth the minimum area setbacks and other requirements of each respective classification: Natural Recreational General Environment Development Development a) Minimum lot size above normal high water mark Non-sewered* Sewered, abutting lake 40,000 sq.ft. 20,000 sq.ft. 15,000 sq.ft. Boathouses may be permitted to be located up to the ordinary .high water mark provided they shall not be used for habitation and they shall. not contain sanitary facilities. Natural vegetation or other natural materials shall be required in order to screen parking areas when viewed from the water. Parking areas of more than four (4) spaces shall be screened in accordance with a landscaping plan submitted and approved by the City Council. Section 2. That Ordinance No. 167, Section 47.6 3) is hereby amended to read as follows: 47.6 3) Wa~ter~SuPP1 Any private supply of water for domestic purposes shall conform to Minnesota Department of Health Standards for water quality. Private wells shall be placed in areas not subject to flooding and up slope from any source of contamination. Wells already existing in areas subject to flooding shall be flood-proofed in accordance with City Standards. No private wells shall be located closer than three (3) feet to the outside basement wall of a dwelling. The outside basement footing shall be continuous across the opening of the well alcove. No well shall be located closer than fifteen 15 feet to a ro erty line. Section 3. That Ordinance No. 167, Section 47.7 is hereby amended to read as follows: 47.7 Shoreland Alterations. 1) The removal of natural vegetation shall be restricted to prevent erosion into public waters, to consume nutrients in the soil, and to preserve shoreland aesthetics. a) Cleareutting is prohibited, except as necessary for placing public roads, utilities, structures and parking areas . b) Natural vegetation shall be restored insofar as feasible after any construction project. c) Selective cutting of trees and underbrush is allowed as long as sufficient oover is left to make cars and structures inconspicuous when viewed from the water. d) The provisions of-this section shall not apply to permitted uses which normally require the removal of natural vegetation. Section 4. This Ordinance shall be effective immediately upon its passing and publication. Adopted by the Lakeville City Council this 15th day of June, 1987.
