HomeMy WebLinkAbout0299 ORDINANCE NO. 299 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 3 OF THE LAKEVILLE CITY CODE BY ADDING A CHAPTER 4 REGULATING GAMBLING The City Council of the City of Lakeville ordains as follows: Section 1. Title 3, Chapter 4 of the Lakeville City Code is hereby amended to read as follows: SECTION: 3-4-1 Purpose 3-4-2 Definitions 3-4-3 Lawful Gambling 3-4-4 Additional Regulations 3-4-5 City Approval Required 3-4-6 Investigation Fee 3-4-7 City Permit 3-4-8 Penalty 3-4-1 Purpose. The purpose of this Chapter is to closely regulate and control gambling activities and to prohibit the commercial- ization of these activities. 3-4-2 Definitions. The terms used herein have the meanings set forth in Minnesota Statutes Section 349.11 through 349.22, and in the rules adopted pursuant to the authority contained in the Statutes. 3-4-3 Lawful Gambling. There shall be no gambling in the City of Lakeville except as authorized pursuant to the provisions of Minnesota Statutes Section 349.11 through 349.22, inclusive, and rules adopted pursuant to the authority contained in the Statutes. 3-4-G Pdditional Regulations. In addition to the requirements of Minnesota Statutes Section 349.11 through 349.22, inclusive, and rules adopted pursuant to the authority contained in the Statutes, the City will not approve a license unless the following regulations are complied with: A. Except as provided in § 3-4-4(B) of the City Cade, gambling occasions may be conducted only by a "qualified organization" which is defined to mean: 1) a fraternal, religious or veterans affiliate of a national organization with a Lakeville Chapter that has operated in the City for the most recent three (3) years and which conducts regular meetings or activities in the City at least six (6) times a year; or r08/06/86 L. J 2) a fraternal, religious or veterans organization at least 40% of whose active members are residents of Lakeville, that has operated in the City for the most recent three (3) years, and which conducts regular meetings or activities in the City at least six (6) times a year; or 3) an organization that for the most recent three (3) years has had a bona fide office open in the City at least ten (10) hours a week; or 4) a parent or student organization affiliated with a school that regularly enrolls Lakeville residents. B. An organization which is not a qualified organization may conduct up to two raffles each calendar year. C. At least 85% of the gross receipts from lawful gambling must be returned to the gambler or used for a lawful purpose. At least 20% of the gross receipts collected from lawful gambling must be used for a lawful purpose. 3-4-6 Investigation Fee. Upon being notified by the Board that an organization has applied for issuance or renewal of a license, the organization shall pay to the City an investigation fee in an amount established from time to time by resolution of the City Council. Failure to promptly pay the required investigation fee shall be grounds for disapproval of a license. 3-4-7 City Permit. No organization may conduct a gambling event which would otherwise be allowed pursuant to the exemptions set forth in Minnesota Statutes Section 349.214, without first securing a permit from the City and paying the permit fee as may be established from time to time by City Council resolution. 3-4-8 Penalty. Any person violating any provision of this Ordinance is guilty of a misdemeanor and upon conviction thereof shall be subject to a fine of not more than $700.00 or imprisonment not to exceed ninety (90) days or both, plus in either case the cost of prosecution. Additionally, violation of this Ordinance shall be reported to the Minnesota Charitable Gambling Board and a recommendation shall be made for suspension, revocation or cancellation of an organization's license, Section 2. Effective Date.
