AN ORDINANCE AMENDING ORDINANCE N0. 167, BEING THE LAKEVILLE ZONING ORDINANCE AS IT
PERTAINS TO ANTENNAS AND SATELLITE DISH COMMUNICATION RECEIVERS.
THE CITY COUNCIL OF THE CITY OF LAKEVILLE DOES ORDAIN:
Section 1. Section 11.3. 5) of the Lakeville Zoning Ordinance addressing build-
ing height limit is hereby amended by deleting the following:
m) Television and radio antennas not exceeding twenty (20) feet above the
roof.
Section 2. Section 22.6. of the Lakeville Zoning Ordinance addressing satellite
dishes is hereby amended by deleting in its entirety.
Section 3. Section 11.3. 5) of the Lakeville Zoning Ordinance is hereby amended
by adding the following:
m) Satellite dishes, television receiving antennas, and radio receiving antennas
shall be a permitted accessory use within all zoning districts provided that
they meet the following conditions:
(1) The dish or antenna shall not exceed fifteen (15) feet in height.
(2) -The dish or antenna shall not exceed twenty (20) feet above the roof
line.
(3) No dish or antenna shall be located within the required front yard
setback or required side yard setback abutting a street.
(4) For ground mounted satellite dishes, television antennas or radio
antennas in A-P, R-A and R-1 districts shall be setback from all
adjoining lots a distance equivalent to one-half (2) the height of
the structure; shall be located at least ten (10) feet away from any
other building or structure and shall not be located within a utility
easement.
(5) In all districts other than A-P, R-A and R-1, ground mounted satellite
dishes, television antennas, or radio antennas shall be setback from
all adjoining lots a distance equivalent to the height of the structure.
Such structures shall be located ten (10) feet or more from any other
building or structure and shall not be located within a utility easement.
(6) .When a satellite dish, television antenna, or radio antenna
is located on the roof of a building, the applicant shall furnish
the City Building Official with building plans and structural
components of the satellite dish, television antenna or radio
antenna displaying the means of securing the structure to the roof
of a building, The Building Official must approve the building
plans.
(7) Lightning Protection. Each satellite dish, television antenna or
radio antenna shall be grounded to protect against natural
lightning strikes in conformance with the National Electrical
Cade as adopted by the City of Lakeville.
(8) Satellite dishes, television antennas or radio antennas which
exceed height limitations specified herein may be allowed by
conditional use permit as provided in Section 11.3.4. of this
Ordinance.
Section 4. This Ordinance shall be in full force and effect upon its passage
and publication.

ORDINANCE AS IT PERTAINS TO
ANTENNAS AND SATELLITE DISH
COMMUNICATION DEVICES.
THE CITY COUNCIL OF THE CITY OF
LAKEVILLE DOES ORDAIN:
Section 1. Section 11.3. 5) of the Lakeville
Zoning Ordinance addressing building
height limit is hereby amended by deleting
the following:
m) Television and radio antennas not ex-
ceeding twenty (20) feet above the roof.
Section 2. Section 22.B. of the Lakeville Zon-
ing Ordinance addressing satellite dishes is
hereby amended by deletirig in its entirety.
Section 3. Section 11.3. 5) of the Lakeville
Zoning Ordinance is hereby amended by ad-
ding the following:
p) Satellite dishes, television antennas,
and radio antennas for either transmission
or reception shall be a permitted ac-
cessory use within all zoning districts, pro-
vided that they meet the following con-
ditions:
(1) A ground mounted dish or antenna
shall not exceed fifteen (15) feet in
height above ground level.
(21A roof mounted dish or antenna shall
not exceed five ( 5) feet above the roof
peak.
(3) No dish or antenna shall be located
within the required front yard setback or
required side yard setback abutting a
street.
4) For ground mounted satellite dishes,
television antennas or radio antennas in
A -P, R -A and R-1 districts shall be set-
back from all adjoining lots a distance
equivalent to one-half (,2) the height of
the structure; shall be located at least
ten (10) feet away from any other
building or structure and shall not be
located within a utility easement.
(5) In all districts other than A -P, R -A
and R-1, ground mounted satellite
dishes, television antennas, or radio
antennas shall be setback from all ad-
joining lots a distance equivalent to the
height of the structure. Such structures
shall be located ten (10) feet or more
from any other building or structure and
shall not be located within a utility ease-
ment.
(6) Building Permits. A building permit
shall be required for the installation of
any communication reception device
which requires a conditional use permit.
Building permit applications shall be ac-
companied by a site plan and structural
components data for the communication
reception device, including details of an-
choring. The Building Official must ap-
prove the plans before installation.
(7) Color/Content. Communication
reception devices shall be of a neutral
color and shall not be painted with
scenes or contain letters or messages
which qualify as a sign.
8( Lightning Protection. Each com-
munication reception device shall be
grounded to protect against natural
lightning strikes in conformance with
the National Electrical Code as adopted
by the City of Lakeville.
(9) Electrical Code. Communication
reception device electrical equipment
and connections shall be designed .and
installed in conformance with the Na-
tional Electrical Code as adopted by the
City of Lakeville.
(10) Satellite dishes, television antennas
or radio antennas which exceed height
limitations specified herein may be
allowed by conditional use permit as
provided in Section 11.3.4 of this Or-
dinance.
Section 4. This Ordinance shall be in full
force and effect upon its passage and
publication.
