HomeMy WebLinkAbout0290 ORDINANCE N0. 290 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE PROVIDING FOR THE CONTINUATION OF A VOLUNTEER FIRE DEPARTMENT FOR THE CITY OF LAKEVILLE AND PROVIDING FOR THE RULES AND REGULATIONS AND FOR THE GOVERNMENT OF THE DEPARTMENT The City Council of the City of Lakeville ordains as follows: SECTION 1. Fire Department Continued. There is hereby continued in the City a Volunteer Fire Department consisting of a Chief, an Assistant Chief, a District Chief for each Fire Station, a Training Officer, a Captain from each Fire Station, a Board of Directors and not less than 40 nor more than 70 firefighters including the above positions. The exact number of firefighters shall be determined by resolution of the City Council. SECTION 2. Election of Officers. The members of the Fire Department shall elect the Fire Chief, Assistant Chief, District Chiefs, Board of Directors, Secretary of the Department and a Treasurer of the Department, as prescribed in the Constitution and By-Laws of the Department. The annual election shall be on the last Monday in January at a time and place set by the Board of Directors. The election of the Fire Chief, Assistant Chief and District Chiefs are subject to confirmation by the City Council. SECTION 3. Duties of the Department Officers. The duties of the Fire chief, Assistant Chief, District Chiefs and all other elected or appointed officers of the Department shall be set forth in the Constitution and By-Laws of the Department. SECTION 4. Board of Directors. The Board of Directors of the Depart- went shall consist of the Fire Chief, Assistant Chief, District Chiefs and Eight (8) Directors elected in accordance with the Constitution and By-laws of the Department. The duties of the Board of Directors shall be as set forth in the Department's Constitution and By-Laws. SECTION 5. Records. The Chief shall keep in convenient form a complete record of all fires. Such record shall include the time of the alarm, location of fire, cause of fire (if known), type of building, name of owner and tenant, purpose for which occupied, value of building and contents, members of the Department responding to the alarm, and such other information as he may deem advisable or as may be required from time to time by the City Council or state insurance department. SECTION 6. Qualifications for Membership. Membership in the Depart- went, including officers, shall be restricted to individuals between the ages of 19 and 65. Members shall retire no later than the first day of the month following their 65th birthday. New members shall be at least 19 years of age at the time of application. Each applicant accepted by the Department shall serve a 24 month probationary period during which he may be dismissed with or without cause. Probationary firefighters shall meet such additional qualifi- cations as set forth in the Department's Constitution and By-Laws. SECTION 7. Constitution and By-Laws. The Department shall adopt a Constitution and By-Laws by a two-thirds (2/3) vote of the total membership of regular firefighters, subject to the confirmation of the City Council. The Constitution and By-Laws shall be consistent with this ordinance and all other present or subsequent City ordinances. If the Department's Constitu- tion or By-Laws conflicts with a City ordinance, the City ordinance shall prevail. 2 SECTION 8. Present Members. Firefighters who are Probationary Fire- fighters of the Fire Department at the time of the adoption of this ordinance shall be required to serve a two year probationary period before becoming a Regular Firefighter. SECTION 9. Relief Association. The members and officers of the Fire Department may organize themselves into a Fire Department Relief Association. The Association shall adopt By-Laws, subject to confirmation by the City Council. SECTION 10. Interference with Department. It shall be unlawful for any person to give or make, or cause to be given or made, an alarm of fire without probable cause, or to neglect or refuse to obey any reasonable order of the Chief at afire, to drive over afire hose, or to interfere with the Fire Department in the discharge of its duties; and any person convicted of violating this section shall be punished by a fine not exceeding $500 or by imprisonment for a period not exceeding 90 days. SECTION 11. Fire Marshal Appointment. The Fire Chief shall appoint a qualified person, with city council approval, to exercise the powers and perform the duties of the Fire Marshal as set forth in the adopted uniform fire code. The Fire Marshal may or may not be a member of the Lakeville Volunteer Fire Department. SECTION 12. Effective Date. This ordinance shall take effect upon its passage and publication.
