HomeMy WebLinkAbout0257 ORDINANCE N0. 257 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 10, CHAPTER 5 OF THE LAKEVILLE CITY CODE CONCERNING SUBDIVISION The City Council of Lakeville ordains as follows: Section 1. Title 10, Chapter 5, Subdivision 1 is amended by adding Subparagraph G to read as follows: g. In lieu of the City approving a plat conditioned upon the developer furnishing the City a letter of credit or performance bond for 100% of the city engineer's estimated costs of the required improvements, the City may condition the plat approval on actual completion of the improvements. If the City Council authorizes this option, the terms of the authorization shall be set forth in a development agreement signed by the City and developer before the developer proceeds with any construction activity. The development contract shall require the developer to furnish the City a cash escrow or letter of credit to cover all inspection, planning, engineering, and legal expenses incurred by the City in monitoring the construction of the improvements and the cost as estimated by the City Engineer for erosion control, street signs, street lights and landscaping. If the developer satisfactorily completes installation of the improvements and they are recommended for acceptance by the City Engineer, then the city Council shall pass a resolution giving final approval to the plat. Section 2. This Ordinance shall be effective immediately upon its passage and publication. Adopted this 29th day of October 1984.
