HomeMy WebLinkAbout0243 ORDINANCE N0. 243 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENBING THE LAKEVILLE ZONING ORDINANCE The Lakeville City Council hereby ordains: Section 1. Section 2.2(7) of the Lakeville Zoning Ordinance is amended to read as follows: 7) Animals a) Domestic Animals. For purposes of this Ordinance, a domestic animal shall be defined as house pets such as dogs, cats, and birds which can be contained within a principal structure throughout the entire year, provided that containment can be accomplished without special modification to the structure requiring a building permit from the City. In addition, it includes birds and rabbits normally sheltered outside the home. b) Farm Animals. Cattle, hogs, bees, sheep, goats, chickens, turkeys, horses and other animals commonly accepted as farm animals in the State of Minnesota. Section 2. Section 20.I of the Lakeville Zoning Ordinance is amended to read as follows: 20.1 Keeping Animals. The following animals may be kept in the city: 1) Domestic animals are an allowed use in all zoning districts. 2) Horses are an allowed use in all zoning districts provided: a. The minimum lot size is 2-1/2 acres. b. The number of horses does not exceed one per acre unless a higher number is granted by the issuance of a conditional use permit. 3) Farm animals are a~n allowed use on all farm property. Farm animals may not be confined in a pen, feed lot or building within 100 feet of any residential dwelling not owned or leased by the farmer. 4) Animals being kept as part of the Minnesota Zoological Garden's or St. Paul Como Zoo's docent programs are an allowed use in all zoning districts. Before such animals are allowed, however, the participant in the program must notify the City Clerk in writing of their participation in the program and identify the animal being kept. 5) With the exception of animals allowed by 20.1 (1), (2), (3) and (4), no other animals are allowed except by conditional use permit. 6) Animals may only be kept for commercial purposes if authorized in the zoning district where the animals are located. 7) Animals may not be kept if they cause a nuisance or endanger the health or safety of the community. Section 3. This ordinance shall be effective upon its passage and publication. Adopted this 16th day of April 1984.
