HomeMy WebLinkAbout0224 << ORDINANCE N0. 224 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 10 OF THE LAKEVILLE CITY CODE PERTAINING TO SUBDIVISIONS It is hereby ordained by the Lakeville City Council: Section 1. Title 10, Chapter 4, Section 8 of the Lakeville City Code is amended by adding Section R to read as follows: Property being replatted with the same number of lots shall be exempt from all park land dedi- cation requirements. If the number of lots is increased or if land outside the previously recorded plat is added, then the park land dedi- cation shall be based on the additional lots and on the additional land being added to the plat. If the additional land does not create additional lots, then each 1/3 acre added shall be considered a new lot for purposes of calculating the dedication requirements. Section 2. Title 10, Chapter 5, Section 5 of the Lakeville Code is amended by adding Section 10-5-5-1 to read as follows: Property being replatted shall be exempt from the storm sewer charge requirements of Section 10-5-5. If land outside the previously recorded plat is added, then the charge shall be calculated based on the land being added to the plat. Section 3. Title 10, Chapter 1, Section 7 is amended by adding the following definitions of "replat". Replat: The subdivision of land in accordance with this title which has previously been platted and which is on file of record with the county pursuant to Minn. Stat. Chapter 505. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the communi- ty which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, and has entry as controlled circulation matter in its local post office. (5) Said newspaper purports to serve the Cities of Apple Valley and Lakeville in the County of Dakota and it has its known office of issue in Burnsville, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the publisher or persons in her employ and subject to her direction and control during all such regular business hours and devoted exclusively dur- ing such hours to the business of the newspaper and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to any person, corporation, part- nership or other unincorporated association requesting the newspaper and making the ap- plicable payment. (8) Said newspaper has complied with all foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (9) Said newspaper has f11 - ed with the Secretary of State of Minnesota an affidavit in the form prescribed by the Secretary of State and signed by Mary Ziegenhagen and sworn to before a notary public stating that the newspaper is a legal newspaper.
