HomeMy WebLinkAbout0109 ORDINANCE NO. 109 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING ORDINANCE NO. 42 BEING THE ZONING ORDINANCE OF THE CITY OF LAKEVILLE The City Council of Lakeville ordains as follows: Section 1. That Ordinance No. 42 is hereby amended by adding to Section 6.1 the following district: Planned Unit Development District. Section 2. That Ordinance No. 42 is hereby amended by adding the following Section 4.18a to read as follows: Planned unit developments may only be created by establishing a planned unit development district if the proposed mix of uses cannot be accommodated in a conventional zoning district. If the proposed uses can be accommodated in a conventional zoning district the planned unit development may only be created by special use permit. Section 3. That Ordinance No. 42 is hereby amended by adding the following provisions: Section 24 A. PUD Planned Unit Development District 24A.1. Purpose. The intent of this section of the ordinance is to establish special requirements for the granting of a zoning district amendment (rezoning) to allow mixed use or special/unique purpose PUD projects which are in compliance with the permitted and conditional uses allowed within the PUD District and in accordance with the provisions and procedures as prescribed in Ordinance No. 84. 1 t • • 24A.2. Permitted Uses. All permitted uses allowed in Section 7-23 inclusive of this ordinance. 24 A.3. Permitted Accessory Uses. All permitted accessory uses allowed in Sections 7-23 inclusive of this ordinance. 24 A.4. Conditional Uses. All conditional uses allowed in Sections 7-23 inclusive of this ordinance. 24 A.S. Special Procedures. The establishment of a PUD, Planned Unit Development District shall be subject to the amendment requirement as outlined in Section 5 of this ordinance plus the procedures and conditions imposed by ordinance no. 84. Section 4. This Ordinance shall be effective upon its passage, approval, and publication. Adopted this Sth day of July , 1977. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news column devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and adver- tisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 240 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second class -matter in its local post - office. (5) Said newspaper purports to serve the Village of Lakeville in the County of Dakota and it has its known office of issue in the City of Lakeville in said county, established and open during its regular business hours for the gather- ing of news, sale of advertisements and sale of subscriptions and maintained by the publisher or persons in his employ and subject to hs direction and control dur- ing all such regular business hours and at which said newspaper is printed. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper has complied with all the foregoing conditions for at (east two years preceding the day or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by publisher of said news- paper and sworn to before a notary public stating that the news- paper is a legal newspaper. (9) Said newspaper was on May 20, 1965 qualified as a medium of official and legal publication and has continually thereafter met the foregoing conditions.
