HomeMy WebLinkAbout0116 1 ~ l ORDINANCE NO. 116 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE PROVIDING FOR THE OPERATION OF A STREET LIGHTING SYSTEM AND THE COLLECTION OF THE COSTS OF SUCH SERVICE The City Council of Lakeville ordains as follows: Section 1. Installation of Street Lighting The Council shall determine by resolution from time to time, the streets, alleys or other public or private areas on which the City shall install and operate street lighting systems. Before any such service is furnished pursuant to such resolutions, the Clerk shall, under the Council's direction, publish notice that the Council will meet to consider such projects. Such notice shall be published in the official newspaper at least once no less than ten (10) days prior to such meeting of the council and shall state the date, time and place of such meeting, the streets, alleys or other public and private areas affected and the particular projects proposed, and the estimated cost of each project. At such 'hearing or at any adjournment thereof, the Council shall hear property owners with reference to the scope and desirability of the proposed projects. The Council shall thereupon adopt a resolution rejecting or confirming the original projects with such modifications as it considers desirable. Section 2. Charges Subdivision (1) Charges for street lighting shall be made against all property benefited by the street lights. Rates shall be established on area basis, in accordance with charges to the City. Such rates shall be established by resolution for each such area or district by resolution from time to time and may be amended from time to time by resolution of the Council. . r M. Subdivision (2) The street lighting charge shall be made quarterly, with the water and sewer bill. Subdivision (3) On or before September first of each year the Clerk shall list the total unpaid charges for the service against each separate lot or parcel to which they are attributable under this Ordinance. The Council may then spread the charges against property benefited as a special assessment under Minnesota Statutes §429.101 and other pertinent statutes for certification to the County Auditor for collection the following year with current taxes. Subdivision (4) Citizens who are receiving social security retirement benefits or disability benefits shall be exempt from energy and maintenance charges provided they sign an affidavit swearing to the receipt of said benefits with the City Clerk. Section 3. Separability If any section, subdivision, clause or phrase of this Ordinance is for any reason found to be invalid, such decision shall not affect the validity of the rest of the ordinance. Section 4. Effective Date This Ordinance shall be effective upon its passage and publication. Adopted this 6th day of March , 1978. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news column devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and adver- tisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 240 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second class -matter in its local post - office. (5) Said newspaper purports to serve the Village of Lakeville in the County of Dakota and it has its known office of issue in the City of Lakeville in said county, established and open during its regular business hours for the gather- ing of news, sale of advertisements and sale of subscriptions and maintained by the publisher or persons in his employ and subject to hs direction and control dur- ing all such regular business hours and at which said newspaper is printed. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit ,in the form prescribed by the Secretary of State and signed by publisher of said news- paper and sworn to before a notary public stating that the news- paper is a legal newspaper. (9) Said newspaper was on May 20, 1965 qualified as a medium of official and legal publication and has continually thereafter met the foregoing conditions.
