CITY OF LAKEVILLE
DAKOTA COUNTY, MINNESOTA
AN ORDINANCE ADOPTING THE MINNESOTA BUILDING CODEf PROVIDING
I'OR ITS ADMINISTRATION AND ENFORCEMENT; 12EGULATING T1iE ERECTION,
CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL,
DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA
AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY OF
LAKEVILLE; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION
OF FEES THEREFORE; PROVIDING PENALTIES FOR THE VIOLATION THEREOF;
DECLARING AND ESTABLISHING FIRE ZONES; RIiPEAI,ING ORDINANCE NO. 3
OF THE CITY OF LAKEVILLE AND ALL OTIiER ORDINANCES AND PARTS OF TFiE
ORDINANCES IN CONFLICT THEREWITH.
The City of Lakeville does ordain as follows:
Section 1. Building Code. The Minnesota State Buildiny Code,
one copy of which is on file in the office of the City Clerk has
been adopted by Laws 1977, Chapter 381 as a uniform building code
applicable throughout the state. Such code is hereby confirmed as
the building code of the City of Lakeville and incorporated in this
ordinance as completely as if aet out in full.
A. The 1976 Edition of the State Building Code adopts by
reference the following codes:
(1) 1976 Edition of the Uniform Building Code, identified
as "UBC";
(2) 1975 Edition of the National Electric Code, identified
as "NEC";
(3) 1971 American National Standard Safety Code for Ele-
vators, Dumbwaiters, Escalators and Moving Walks,
identified as ANSI A17.1 - 1971 and Supplements,
ANSI A17.1a - 1972, ANSI A17.1b - 1973, ANSI A17.1c
- 1979, ANSI A17.1d - 1975, ANSI A17.1e - 1975, ANSI
A17.1f - 1975 and ANSI A17.1g - 1976.
{9) 1976 Minnesota Plumbing Code, identified as M[ID 120
through MHD 135.
(5) "Flood Proofing Regulations", June 1972, Office of
the Chief Engineers, U.S. Army.
(6) Minnesota Heating, Ventilating, Air Conditioning and
Refrigeration Code, identified as SBC 7101 through
SBC 8505.
(7) "Design and Evaluation Criteria for Energy Conserva-
tion in New Building, Additions and Remodeled Elements
of Buildings and Standards for Certain Existing Public
Buildings", identified as 2MCAR Section 1.16001
through 2MCAR Section 1.16006. (SBC 6001 - 6006).

(8) Standards of Performance for Solar Energy Systems and
Subsystems Applied to Energy Need of Buildings, 1977
Edition, identified as 2MCAR 1.16101 through 2MCAR
1.16107.
B. In addition to those items listed above, certain Appendecie,
Standards and Supplemental Materials referenced in the Code
are hereby adopted by reference as part of the Building Code
of the City of Lakeville and incorporated into this ordinance
as completely as if set out in full, included but are not
limited to the followings
(1) Technical Requirements for Fallout Shelters, iden-
tified as SBC Appendix "A".
(2) Variations in Snow Loads, identified as SBC Appendix
B..
(3) 1976 Uniform Building Code Appendix Chapters 23, 35.
(9) Minnesota Plumbing Code Appendix "B". .
C. The following Appendices, Standards and Supplemental Ma-
terials are adopted by reference for the City of Lakeville
and are incorporated into this ordinance as completely as
if set out in full.
(1) SBC Appendix "C". Abbreviations and addresses of
Technical Organizations.
(2) 1976 UBC Appendix, Chapters 13, 15, 38, 48, 49, 51,
57 and 70.
(3) Minnesota Plumbing Code Appendices A, C, D, E and F.
(4) Flood Proofing Regulations, Sections 201.2 through.
zos.2.
(5) SBC Appendix "D" Building Security SBC 90101 - 4110.
Section 2. Organization and Enforcement. The organization
of the Building Department and enforcement of the Code shall be
conducted within the guidelines established by Chapter 2 of the
Uniform Building Code 1976 Edition.
The City Inspection Department shall be the Building Code De-
partment of the City of Lakeville. The Administrative Authority
shall be a State Certified "Building Official" so designated by'
the Appointing Authority.
The Appointing Authority shall be the council of the City of
Lakeville.
Section 3. Permits, Inspections and Fees.
A. The issuance of permits, conduction of inspections and
collection of fees shall be as provided for in Chapter 3
of the Uniform Building Code.

B. Surcharge. In addition to the permit fees required by
Subdivision A in Section 3 above, the applicant shall pay
a surcharge in the amount fixed by law. The amount required
by law shall be remitted to the Minnesota Department of
Administration.
Section 4. Fire Zone Districts. The entire area of the City
of Lakeville is hereby declared to be and is hereby established as
a Fire District known as Fire Zone No. 3, and such zone shall in-
clude such territory or portions of zone as illustrated, outlined
and designated on a certain map on file in the office of the City
Clerk of the City of Lakeville being marked and designated as "Fire
Zones of the City of Lakevillle".
Section 5. Violations and Penalties. The penalty described
in the Uniform Building Code, 1976 Edition, Chapter Two, Section
205 shall be in keeping with Minnesota Statutes 609.031 which pro-
vides for a maximum fine of $500.00 or imprisonment for 90 days,.
or both.
Section 6. Effective Date of Ordinance. This ordinance shall
be effective December 1$a 1978.

JOSEPH R. CLAY and DANIEL H. CLAY, being duly sworn, on oath say they are and
during all the times herein stated have been the publishers and printers of the news-
paper known as Dakota County Tribune and have full knowledge of the facts herein
stated as follows: Said newspaper is printed in the English language in newspaper
format and in column and sheet form equivalent in printed space to at least 900 square
inches. Said newspaper is a weekly and is distributed at least once each week. Said
newspaper has 50 per cent of its news columns devoted to news of local interest to the
community which it purports to serve and does not wholly duplicate any other publica-
tion and is not made up entirely of patents, plate matter and advertisements. Said
newspaper is circulated in and near the municipality which it purports to serve, has at
least 500 copies regularly delivered to paying subscribers, has an average of at least
75 per cent of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post -office. Said newspaper purports
to serve the Cities in the County of Dakota and it has its known offices of issue in the
Cities of Farmington, Rosemount, Burnsville, Apple Valley, and Lakeville established
and open during its regular business hours for the gathering of news, sale of advertise-
ments and sale of subscriptions and maintained by the managing officer of said news-
paper or persons in it's employ and subject to their direction and control during all such
regular business hours and at which said newspaper is printed. Said newspaper files
a copy of each issue immediately with the State Historical Society. Said newspaper
has complied with all the foregoing conditions for at least two years preceding the day
or dates of publication mentioned below. Said newspaper has filed with the Secretary
of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affi-
davit in the form prescribed by the Secretary of State and signed by the managing
officer of said newspaper and sworn to before a notary public stating that the news-
paper is a legal newspaper.
