ORDINANCE N0. 134
CITY OF LAKEVILLE
DAKOTA COUNTY, MINNESOTA
AN ORDINANCE PROVIDING FOR THE CONTINUATION OF A VOLUNTEER
FIRE DEPARTMENT FOR THE CITY OF LAKEVILLE AND PROVIDING FOR
THE RULES AND REGULATIONS AND FOR THE GOVERNMENT OF THE
DEPARTMENT
The City Council of the City of Lakeville ordains as follows:
SECTION 1. Fire Department Continued. There is hereby conti-
nued in this City a Volunteer Fire Department consisting of a Chief,
a First and Second Assistant Chief, a Training Officer, a Captain
of each Fire Station, a Board of Directors, and not less than 40
nor more than 70 firemen including the above positions. The exact
number of firemen shall be determined by resolution of the City
Council.
SECTION 2. Election of Officers. The members of the Fire
Department shall elect the Fire Chief, First and Second Assistant
Chiefs, Board of Directors, Secretary of the Department and a
Treasurer of the Department, as prescribed in the Constitution and
By-Laws of the Department. The annual election shall be on the last
Monday in January at a time and place set by the Board of Directors.
The election of the Fire Chief, and First and Second Assistant
Chiefs, are subject to confirmation by the City Council.
SECTION 3. Duties of Department Officers. The duties of the
Fire Chief, First and Second Assistant Chiefs, and all other elected
or appointed officers of the Department shall be set forth in the
Constitution and By-Laws of the Department.
SECTION 4. Board of Directors. The Board of Directors of
the Department shall consist of the Fire Chief, First and Second
Assistant Chiefs and six fire fighters elected in accordance with
the Constitution and By-Lacas of the Department. The duties of
the Board of Directors shall be as set forth in the Department's
Constitution and By-Laws.

SECTION 5. Records. .The Chief shall keep in convenient form a complete
record of all fires. Such record shall include the time of the alarm, location-
of fire, cause of fire (if known), type of building, name of owner and tenant,
purpose for which occupied, value of building and contents, members of the De- '
partment responding to the alarm, and such other information as he may deem
advisable or as may be required from time to time by the City Council or state
insurance department.
SECTION 6. Qualifications for Membership.: Membership in the Department,'
including officers, ahalT be restricted .to individuals between the ages of 18
and 65. Members shall retire no later than the first day of the month follow-
. ing their 65th birthday.. New members shall .be between the ages of I8 and'35.
Each applicant accepted 'by the Department shall serve a 24 month probationary
period during which he may .be dismissed'with ox"without cause. Probationary
firemen shall meet such additional qualifications as set forth in the Depart-
ment's Consti~ti~tion and BY-Laws.•
SECTION 7. The Department shall adopt a Constitution and By-Laws by a
two-thirds (2/3) vote of its membership, subject to the confirmation of the.
City Council. The. Constitution and By-Laws. shall be consistent with this Or-
dinance and all other present or subsequent City Ordinances. If the Depart-
ment's Constitution or By-Laws conflicts with a City Ordinance, the City Or-
dinance shall prevail.
SECTION 8. Present members. Persons who are probationary members of
the Fire Department at the time of the adoption of this Ordinance shall be
required to serve a two year probationary period before receiving firemen's
rating.
SECTION 9. Relief Association. The. members and officers of the Fire
Department may organize themselves into a Firemen's Relief Association. The
Association shall adopt By-Laws, subject to confirmation by the City Council
SECTION 10. Interference with Department. It shall be unlawful for
any person to .give or make, or cause to be given or made, an alarm of fire
without probable eause, or to neglect or refuse to obey any reasonable order
of She. Chief at a fire, to drive over afire hose, or to interfere with the
Fire Department in the discharge of Sts duties; and any .person convicted of
violating this Section shall be punished by a fine not exceeding $500 or by
imprisonment for a period not exceeding 90 days.

SECTION 11: Repeal: Lakeville Ordinance Nos. 33 and 76 are hereby re-
pealed.
SECTION 12. Effective bate. T~iis Ordinance shail-take effect upoa its
passage and publication.

JOSEPH R. CLAY and DANIEL H. CLAY, being duly sworn, on oath say they are and
during all the times herein stated have been the publishers and printers of the news-
paper known as Dakota County Tribune and have full knowledge of the facts herein
stated as follows: Said newspaper is printed in the English language in newspaper
format and in column and sheet form equivalent in printed space to at least 900 square
inches. Said newspaper is a weekly and is distributed at least once each week. Said
newspaper has 50 per cent of its news columns devoted to news of local interest to the
community which it purports to serve and does not wholly duplicate any other publica-
tion and is not made up entirely of patents, plate matter and advertisements. Said
newspaper is circulated in and near the municipality which it purports to serve, has at
least 500 copies regularly delivered to paying subscribers, has an average of at least
75 per cent of its total circulation currently paid or no more than three months in 'arrears
and has entry as second-class matter in its local post -office. Said newspaper purports
to serve the Cities in the County of Dakota and it has its known offices of issue in the
Cities of Farmington, Rosemount, Burnsville, Apple Valley, and Lakeville established
and open during its regular business hours for the gathering of news, sale of advertise-
ments and sale of subscriptions and maintained by the managing officer of said news-
paper or persons in it's employ and subject to their direction and control during all such
regular business hours and at which said newspaper is printed. Said newspaper files
a copy of each issue immediately with the State Historical Society. Said newspaper
has complied with all the foregoing conditions for at least two years preceding the day
or dates of publication mentioned below. Said newspaper has filed with the Secretary
of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affi-
davit in the form prescribed by the Secretary of State and signed by the managing
officer of said newspaper and sworn to before a notary public stating that the news-
paper is a legal newspaper.
