HomeMy WebLinkAbout0140 I ` ORDINANCE NO. 140 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE APQENDING ORDINANCE N0. 42, BEING THE ZONING ORDINANCE OF THE CITY OF LAKEVILLE The City Council of Lakeville ordains as follows: Section 1. That Ordinance No. 42 is hereby amended to rezone from B-4 and R-1C to R-2 the following described property located within the City of Lakeville, Minnesota, to-wit: That part of the East Half of Northeast Quarter of Northeast Quarter; Except the South 500 feet of the West 208.71 feet; and also except the South 330 feet of the East 384 feet, all in Section 1, Township 114, Range 21, Dakota County, Minnesota, lying easterly of the following described line: Commencing at the northwest corner of said East Half of Northeast Quarter of Northeast Quarter of Section 1; thence on an assumed bearing of EAST a distance of 137.81 feet to the actual point of .beginning of the line to be described; thence southerly a distance of 5,03 feet along a curve not tangential with the last described line, said curve is concave to the east, has a radius of 568.46 feet, a central angle of 0 degrees 30 minutes 25 seconds,-and the chord of said curve bears South 9 degrees 16 minutes 18 seconds East; thence southerly a distance of 72.65 feet along a reverse curve concave to the west having a radius of 416.26 feet and a central angle of 10 degrees 00 minutes 00 seconds; thence South 0 degrees 28 minutes 30 seconds West, tangent to said curve, a distance of 130.00 feet; thence southerly a distance of 67.07 feet along a tangential curve concave to the west having a radius of 698.67 feet and a central angle of 5 degrees 30 minutes 00 seconds; thence southerly a distance of 354.87 feet along a reverse curve concave to the east having a radius of 968.63 feet and a central angle of 20 degrees 59 minutes 28 seconds; thence South 15 degrees 00 minutes 58 seconds East, tangent to said curve, a distance of 52.28 feet; thence southerly a distance of 138.88 feet along a tangential curve concave to the west having a radius of 636.56 feet and a central angle of 12 degrees 30 minutes 00 seconds to a point on the north line of the South 500 feet of the East Half of Northeast Quarter of Northeast Quarter of Section 1, said point being 208.71 feet West of the west line of the East Half of Northeast Quarter of Northeast Quarter, and said line there terminating. Section 2. The Zoning Map of the City of Lakeville referred to and described in said Ordinance No. 42 as that certain map entitled "Zoning District of Lakeville, Minnesota, April 20, 1970" shall not be republished to show the aforesaid rezoning, but the Clerk shall 4., . appropriately mark the zoning map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove provided for in this Ordinance and all of the notations, references and other infor- mation shown thereon are hereby incorporated by reference and made a part of this Ordinance. Section 3. This Ordinance shall be in full force and effect from and after its publication according to law. Enacted and ordained into an Ordinance this 19th day of March 1979. CLAY, being duly sworn, on oath say they are and during all the times herein stated have been the publishers and printers of the news- paper known as Dakota County Tribune and have full knowledge of the facts herein stated as follows: Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches. Said newspaper is a weekly and is distributed at least once each week. Said newspaper has 50 per cent of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publica- tion and is not made up entirely of patents, plate matter and advertisements. Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75 per cent of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office. Said newspaper purports to serve the Cities in the County of Dakota and it has its known offices of issue in the Cities of Farmington, Rosemount, Burnsville, Apple Valley, and Lakeville established and open during its regular business hours for the gathering of news, sale of advertise- ments and sale of subscriptions and maintained by the managing officer of said news- paper or persons in it's employ and subject to their direction and control during all such regular business hours and at which said newspaper is printed. Said newspaper files a copy of each issue immediately with the State Historical Society. Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below. Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affi- davit in the form prescribed by the Secretary of State and signed by the managing officer of said newspaper and sworn to before a notary public stating that the news- paper is a legal newspaper.
