HomeMy WebLinkAbout06-29-92 f s CITY OF LAKEVILLE SPECIAL COUNCIL MEETING JUNE.29,1992 The meeting was called to order at 8:00 p.m. by Mayor Zaun. Roll call was taken. Present: Councilmembers Sindt, Mulvihill, Harvey and Mayor Zaun.. Absent: Councilmember Ruhmann. Also present: R. Erickson, City Administrator; J. Walston, Assistant City Attorney; S. Michaud, Parks & Recreation Director; C. Friedges, City Clerk. Mr. Erickson explained that this special Council meeting was called for the expressed purpose of transferring property from Quigley-Sime Associates to the City of Lakeville. He explained. that City staff met with the attorney for the Quigley-Sime property in April of this year, at which time the owners of approximately 27 acres of property located south and west of Aronson Park expressed a desire to donate the land to the City of Lakeville for park purposes. Mr. Erickson went on to explain -that approximately five acres of the site had been used many years ago as a City dump. Staff questioned whether ground water contamination was evident in that area and retained the firm of Barr Engineering to perform an environmental analysis. Test. results indicated that no ground water contamination was found, based upon tests for .several common volatile organic compounds (VOCs) and toxic metals. Some high nitrate levels were found, however, it was determined that the waste deposited at the • site was not the source. Mr. Erickson stated the cost to the City for this. property would be approximately $800.00 per acre, based on payment of .the second half 1992 taxes and unpaid special assessments. Mr. Walston stated the purpose of the proposed Transfer Agreement is to memorialize the conditions of the property transfer, which are summarized as follows: 1. Quigley-Sime Associates will warrant title to the property; 2. Quigley-Sime Associates will warrant that there are no leases or occupancies affecting the property; 3. The. City is to pay one-half of the general real estate taxes due in 1992; 4. Quigley-Sime Associates will pay all delinquent property taxes; 5. City will assume unpaid balance of special assessments (approximately $20,000); and 6. Quigley-Sime Associates will provide the City with an updated Abstract of Title to the property. Mr. Walston explained that the special Council meeting is being held so that the transfer can be consummated before July 1, 1992, so that the subject property will be exempt from the taxes which would otherwise be payable m 1993. A closing is scheduled for 9:00 a.m. on June 30th. Mr. Michaud showed an aerial photograph of the property and described possible future uses of the property for an athletic facility and/or neighborhood park. Councilmembers raised concerns regarding the impact of a park to the surrounding residents. The Council directed staff to hold neighborhood meetings to receive input .from the residents prior to .preparation of a park plan. 92.148 Motion was made by Mulvihill, seconded by Harvey to acknowledge receipt of the Quigley-Sime Property Environmental Review prepared b~ Barr Engineering Company dated June 19,1992 (report on file in the tarty Clerk s office). Ayes, Zaun, Sindt, Mulvihill, Harvey. 92.149 Motion was made by Sindt, seconded by Mulvihill to approve a Transfer Agreement between Quigley-Sime Associates and the City of Lakeville. Roll call was taken on the motion. Ayes, Sindt, Mulvihill, Harvey, Zaun.
