CITY OF LAKEVILLE
DAKOTA COUNTY, MINNESOTA
AN ORDINANCE AMENDING ORDINANCE N0. 113 BEING THE SUBDIVISION
ORDINANCE OF THE CITY OF LAKEVILLE
The City Council of Lakeville ordains as follows`.
Section 1. Ordinance No. 113 is hereby amended by amending
Section 8, Subdivision I, J, K, L and N to read as follows:
Subdivision I. In residential plats one acre of land shall
be conveyed to the City as an outlot by warranty deed for every 75
people the platted land could house based upon the following population.
calculations:
Single family detached dwelling lots 3.5 persons
Two family dwelling lots 6.O persons
Apartment, Townhouses, Condominiums
and other dwelling units 1 person per
bedroom
J. In lieu of a park land donation the City may require
the following cash donations:
Single family dwelling lots $300.00
Two family dwelling lots $600.00
.Apartments, Townhouses, Condominiums
and other dwelling units $150.00- per
unit plus $75.00
per bedroom
above the first
bedroom on each
unit
Commercial and Industrial $600.00 per
acre
K. The-.City may elect to receive a combination of cash,
land and development of the land for park .use. The fair market value
of the land the City wants and the value of the development of .the
land shall be calculated. That amount shall be substracted from the
cash contribution required by Section 8, Subdivision J. The remainder
shall be the cash contribution requirement.

L. "Fair Market Value" shall be determined as of the time
of filing the final plat in accordance with the following:
1. The City and the developer may agree as to the fair
market value, or
2. The fair market value may be based upon a current
appraisal submitted to the City by the subdivider at the subdivider's
expense. The appraisal shall be made by appraisers who are approved
members of the SREA or MAI, or equivalent real estate appraisal
societies.
3. If the City disputes such appraisal the City may, at
the subdivider's expense, obtain an appraisal of the property by a
qualified real estate appraiser, which appraisal shall be conclusive
evidence of the fair market value of the land.
N. Park cash contributions are to be calculated at the time
of final plat approval. The Council may approve a delay in the payment
of cash requirements provided that an agreement is executed guarantee-
ing such payment at the time of the final plat or development plan
approval. Delayed payment shall include interest at the highest rate
permitted by law.
Section 2. This ordinance shall become effective from and
after the date of its publication.

ORDINANCE OF THE CITY OF LAKEVILLE
The City Council of Lakeville ordains as
follows:
Section 1. Ordinance No. 113 is hereby
amended by amending Section 8, Subdivision
I, J, K, L and N to read as follows:

JOSEPH R. CLAY and DANIEL H. CLAY, being duly sworn, on oath say they are and
during all the times herein stated have been the publishers and printers of the news-
paper known as Dakota County Tribune and have full knowledge of the facts herein
stated as follows: Said newspaper is printed in the English language in newspaper
format and in column and sheet form equivalent in printed space to at least 900 square
inches. Said newspaper is a weekly and is distributed at least once each week. Said
newspaper has 50 per cent of its news columns devoted to news of local interest to the
community which it purports to serve and does not wholly duplicate any other publica-
tion and is not made up entirely of patents, plate matter and advertisements. Said
newspaper is circulated in and near the municipality which it purports to serve, has at
least 500 copies regularly delivered to paying subscribers, has an average of at least
75 per cent of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post -office. Said newspaper purports
to serve the Cities in the County of Dakota and it has its known offices of issue in the
Cities of Farmington, Rosemount, Burnsville, Apple Valley, and Lakeville established
and open during its regular business hours for the gathering of news, sale of advertise-
ments and sale of subscriptions and maintained by the managing officer of said news-
paper or persons in it's employ and subject to their direction and control during all such
regular basiness hours and at which said newspaper is printed. Said newspaper files
a copy of each issue immediately with the State Historical Society. Said newspaper
has complied with all the foregoing conditions for at least two years preceding the day
or dates of publication mentioned below. Said newspaper has filed with the Secretary
of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affi-
davit in the form prescribed by the Secretary of State and signed by the managing
officer of said newspaper and sworn to before a notary public stating that the news-
paper is a legal newspaper.
