HomeMy WebLinkAbout0162 k t ORDINANCE NO. ].G2 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING THE ZONING ORDINANCE N0. 42 BEING THE ZONING ORDINANCE OF THE CITY OF LAKEVILLE THE CITY COUNCIL OF LAKEVILLE ORDAINS AS FOLLOWS: SECTION I. Ordinance No. 42 is hereby amended to rezone from B-4 to R-1C, the following described property located within the City of Lakeville, Minnesota: That part of the SE4 of the SW4 of Section 1, Township 114, Range 21, Dakota County, Minnesota, described as follows: Beginning at the southwest corner of Jackson Heights Second Addition, according to the plat thereof on file and of record, said point being on the south line of the SW4 of said Section 1 and distant 233 feet west of the southeast corner of the said SW4; thence west along the said south line of the SW4 a distance of 81.58 feet, more or less, to a point which is 220 feet east of the intersection of the south line of the said SW4 with the center of old Lyndale Road, now County Highway No. 5; thence north, parallel with the east line of the said SW4' a distance of 76.24 feet to the southerly right of way line of 170th Street as constructed and formerly called Orchard Lake. Road; thence southeasterly along the said southerly right of way line of said street a distance of 81.66 feet, more or less, to the west line of said Jackson Heights Second Addition; thence south 72.56 feet, more or less, to the place of be- ginning. Also: That part of the NE4 of the NW4 of Section 12, Township 114, Range 21, Dakota County, Minnesota, described as fol- . lows: Beginning at the northeast corner of the NW4 of said Section 12; thence North 89 degrees 09 minutes 12 seconds West, assumed bearing, on the north line of the said NW4 a distance of 346.81 feet; thence South 18 degrees 39 min- utes 15 seconds East a distance of 100.00 feet; thence South 89 degrees 09 minutes 12 seconds East a distance of 314.66 feet to the east line of the said NW4; thence northerly on the said east line 94.27 feet to the point of beginning. SECTION II. The Zoning Map of the City. of Lakeville referred to and described in said Ordinance No. 42 as that certain map entitled "Zon- ing Map, Village of Lakeville, Minnesota" shall not be republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the zoning map for the purpose of indicating the rezoning herein- above provided for in this Ordinance and all of the notations, refer- ences and other information shown thereon are hereby incorporated by reference and made a part of this Ordinance. SECTION III. This Ordinance shall be in full force and effect from and after its publication according to law. Enacted and ordained into an Ordinance this 19th day of May , 1980. ALSO: That part of the NEra of the NW1/4 of Sec- tion 12, Township 114, Range 21, Dakota County, Minnesota, described as follows: Beginning at the northeast corner of the NW.4 of said Section 12; thence North 89 degrees 09 minutes 12 seconds West, assumed bearing, on the north line of the said NW1/4 a distance of 346.81 feet; thence South 18 degrees 39 minutes 15 seconds East a distance of 100.00 feet; thence South 89 degrees 09 minutes 12 seconds East a distance of 314.66 feet to the east line of the said NW1/4; thence northerly on the said east line 94.27 feet to the point of beginn- ing. SECTION 11. The Zoning Map of the City of Lakeville referred to and described in said Ordinance No. 42 as that certain map entitl- ed "Zoning Map, Village of Lakeville, Min- nesota" shall not be republished to show the aforesaid rezoning, but the Clerk shall ap- propriately mark the zoning map for the pur- pose of indicating the rezoning hereinabove provided for in this Ordinance and all of the notations, references and other information shown thereon are hereby incorporated by reference and made a part of this Ordinance. SECTION III. This Ordinance shall be in full force and effect from and after its publication according to law. Enacted and ordained into an Ordinance this 19th day of May, 1980. CLAY, being duly sworn, on oath say they are and during all the times herein stated have been the publishers and printers of the news- paper known as Dakota County Tribune and have full knowledge of the facts herein stated as follows: Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches. Said newspaper is a weekly and is distributed at least once each week. Said newspaper has 50 per cent of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publica- tion and is not made up entirely of patents, plate matter and advertisements. Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75 per cent of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office. Said newspaper purports to serve the Cities in the County of Dakota and it has its known offices of issue in the Cities of Farmington, Rosemount, Burnsville, Apple Valley, and Lakeville established and open during its regular business hours for the gathering of news, sale of advertise- ments and sole of subscriptions and maintained by the managing officer of said news- paper or persons in it's employ and subject to their direction and control during all such regular bt,siness hours and at which said newspaper is printed. Said newspaper files a copy of each issue immediately with the State Historical Society. Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below. Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affi- davit in the form prescribed by the Secretary of State and signed by the managing officer of said newspaper and sworn to before a notary public stating that the news- paper is a legal newspaper.
