HomeMy WebLinkAbout0193 ORDINANCE NO. 193 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING ORDINANCE N0. 167, BEING THE ZONING ORDINANCE OF THE CITY OF LAKEVILLE The City Council of Lakeville ordains as follows: Section 1. That Ordinance No. 167 is hereby amended to rezone to A-P, Agricultural Preserve District, the following described land located within the City of Lakeville, Minnesota: (Parcel A - 6.90 acres) North 780 feet of the West 385.08 feet of the SW4 of Section 22, Township. 114, Range 20, Dakota County, Minnesota. (Parcel B - 3,20 acres) South 533 feet of the East 261.37 feet of the SW4 of Section 22, Township 114, Range 20, Dakota County, Minnesota. (Parcel C - 40.0 acres) East 1320.0 feet of the South 1551.0 feet of the SW4 of Section 22, Township 114, Range 20, Dakota County, Minnesota, except the following: the East 522.74 feet of the South 533.0 feet. (Parcel ll - 33.3 acres) The East 1320 feet of the SW4 of Section 22, Township 114, Range 20, Dakota County, Minnesota, except the South 1551.0 feet thereof. (Parcel E - 61.2 acres) The SW4 of Section 22, Township 114, Range 20, Dakota County, Minnesota, except the following: East 1320 feet thereof; South 225 feet thereof lying west of said East 1320 feet; North 780.0 feet of the West 385.08 feet; South 950 feet of the North 1730.0 feet of the West 210.48 feet. (Parcel F - 3g,7g9 acres) South i of South 's of the NW4 of Section 22, Township 114, Range 20, Dakota County, Minnesota. The above parcels subject to Cedar Avenue and 200th Street W. (County Road 64). AND Parcel #20212-A, which is the North one-half (NZ) of the Northwest Quarter (NW4) of Section Twenty-two (22), Township One Hundred Fourteen (114), Range Twenty (20), except coming from the northeast corner 970 feet to begin corner, then 208 feet west in lot, then 90° 216' , then left 90° .208' , then left 90° 218' to beginning (Kelly residence), and except coming from the SW corner of an assumed bearing of north on the westerly line of said Section 22 . r for a distance of 240' , then right 90° 205' , then right 90° 240', then right 90° 205' to beginning (77.85 acres). AND N'-z of NE4 of Section 21 and E 20 acres of NE4 of NW4 of Section 21, Range 20, Township 114. AND SZ of NE4 and SE 40 acres of NW4 of Section 21, Township 114, Range 20. Section 2. The zoning map of the City of Lakeville shall not be republished to show the af°resaid rezoning, but the Clerk shall appropriately mark the zoning map on file in the Clerk's office for the purpose of indi- cating the rezoning hereinabove provided for in this Ordinance and all of the notations, references and other information shown thereon are hereby incorporated by reference and made a part of this Ordinance. Section 3. This Ordinance shall be in full force and effect from and after its publication according to law. Enacted and ordained into an Ordinance this 21st day of September 1981. CLAY, being duly sworn, on oath say they are and during all the times herein stated have been the publishers and printers of the news- paper known as Dakota County Tribune and have full knowledge of the facts herein stated as follows: Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches. Said newspaper is a weekly and is distributed at least once each week. Said newspaper has 50 per cent of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publica- tion and is not made vp entirely of patents, plate matter and advertisements. Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75 per cent of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office. Said newspaper purports to serve the Cities in the County of Dakota and it has its known offices of issue in the Cities of Farmington, Rosemount, Burnsville, Apple Valley, and Lakeville established and open during its regular business hours for the gathering of news, sale of advertise- ments and sale of subscriptions and maintained by the managing officer of said news- paper or persons in it's employ and subject to their direction and control during all such regular biisiness hours and at which said newspaper is printed. Said newspaper files a copy of each issue immediately with the State Historical Society. Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below. Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affi- davit in the form prescribed by the Secretary of State and signed by the managing officer of said newspaper and sworn to before a notary public stating that the news- paper is a legal newspaper.
