CITY OF LAKEVILLE SPECIAL COUNCIL MEETING

The meeting was called to order by Mayor Zaun at 7:00 p.m. Roll call was
taken. Present: Councilmembers Ruhmann, Sindt, Mulvihill, Harvey and Mayor
Zaun
Also present: Robert Erickson, City Administrator and Charlene Friedges,
City Clerk.
Dakota County Assessor, Marvin Pulju, presented a report on the 1992 Board of
Review activities for the City. The report, (on file in the City Clerk's
office) shows Board of Review meeting attendees, value changes as recommended
by the Assessor's Office on certain parcels, the status of 11 residential
reviews, Argonne Farms parcel reviews and 21 commercial reviews.
Mr. Richard Sexton stated he did not accept the Assessor's recommended market
value adjustment on his 2-acre parcel, which reduced. the value from $21,000
to $10,500. He also felt a reduction should be made on the market value of
his. 11.6-acre parcel. He felt the value should be reduced .because of the
future extension of 175th Street past his property. He stated he felt .his
property was being appraised as though the street were already extended. He
also .felt .that right-of--way acquisition for 175th Street would reduce the
size of his 2-acre parcel, making it unbuildable and impossible to sell.
. Mr. Erickson agreed that the future extension of 175th Street could cause a
hardship on the 2-acre parcel containing Mr. Sexton's homestead, but did not
feel the value of the 11-acre parcel would be affected when that property is
developed.. He stated 175th Street would not be extended to Highview Avenue
until a developer purchases Mr. Sexton's property. The developers who own
property east of Mr. Sexton's property to Dodd Blvd..are anxious to plat
their property, which would include their paying 100% of the costs (one sided
benefit) for extending 175th .Street. He also pointed out that the City
Council reduced Mr. Sexton's assessment on the Highview Avenue improvement
project and did not pursue an active assessment for the urbanizing of
Highview Avenue, from which Mr. Sexton's property is benefitted.
Councihnember Harvey stated based on other sales in the area at $6,750 to
$7,900 per acre (before the new school was built), the $6,300 per acre
valuation that has been placed on Mr. Sexton's .property is well within the
90-100% range of the estimated market value.
Mr. Sexton stated he would prefer a value that more accurately reflects a
time line for future development as opposed to the actual market, given the
fact. that his property is located outside the Metropolitan Urban Service Area
(MUSA).
Mr. Pulju asked Mr. Sexton to state the asking price for his property. He
stated the property is listed with a Realtor, and he received no offers. He
stated he couldn't remember what the Realtor is asking for the property.

92.97 Motion was made by Harvey, seconded by Mulvihill to accept the Assessor's
recommended adjustment on Parcel #22-00900-010-28 from $21,000 to $10,500,
with no adjustment to Parcel #22-00900-010-29, given the fact that the
approved value is within the normal range of sales within the area.
Roll call was. taken on the motion. Ayes, Ruhmann, Zaun, Sindt, Mulvihill,
Harvey.
Mr. Mark Zweber and Mr. Richard Sullivan addressed the Council regarding the
value .placed on their 37-acre farm property near Holyoke Avenue and 192nd
Street. _Mr. Zweber stated the land is currently being used for agricultural
purposes, although the property is zoned R-2. Given the lack of sewer and
.water in that area and the in-place moratorium on new development, they have
no immediate plans for development of that property..
Mr. Erickson stated the land in question is outside the MUSA, and it could be
1999 before sanitary sewer and water is available to that area. He felt the
value should be modified to reflect the current use of the property. He
stated while the assessors office accurately determined the value of the
property as a residential use, it should be rezoned to reflect its active use
now and in .the next five to ten years.
• Mr. Pulju stated the property owners are currently applying for green acres
status; and if they qualify, the property would be assessed using an
agricultural. schedule. He explained that the high value is for market value
purposes, and .green acres property is automatically assessed at an
agricultural/green acres value, which is less.
Councilmember Mulvihill was concerned about what would happen to the value if
the property owners do not qualify for green acres status. It was
recommended that the property be valued at $2,700/acre, which is consistent
with other R-A zoned property in the area. This would be the market value on
the property before the green acres deferment.
Mr. Zweber stated he felt the $2,700 figure was high based on recent sales of
agricultural property in the area. Councilmember Sindt agreed that the value
should be consistent with current data from agricultural property sales.
92.98 Motion was made by Mulvihill, seconded by Ruhmann to direct the Dakota County
Assessor's Office to place a market value of $2,700 per acre on Parcel
#22-02000-011-79, which is consistent with other R-A zoned property,
recognizing that if the property owners qualify for green acres status, the
appropriate adjustment would be made.

Roll call was taken on the motion. Ayes, Zaun, Mulvihill, Harvey, Ruhmann.
Nay, Sindt. Councilmember Sndt stated she felt the value should be lower,
based on .current sales data from agricultural properties.
The remaining nine residential reviews were not individually discussed, since
the property owners were not present. Mr. Pulju explained that some property
owners have accepted their recommendations, while others who were asked to
provide. supporting data have not responded. It was explained that the next
step in the appeal process is at the County Board of Equalization in June.
92.99 Motion as made by Mulvihill, seconded by Sindt to receive a letter from
Federal Deposit Insurance Corporation, Rosemount, Illinois, regarding Drovers
National Bank, Tremonts Orchard Lake Views (9 parcels).
Roll call was taken on the motion. Ayes, Sindt, Mulvihill,. Harvey, Ruhmann,
Zaun.
92.100 Motion was made by Harvey, seconded by Ruhmann to receive and accept the
recommendations of the Dakota County Assessor's .Office on the remaining
parcel reviews, (report on file in the City Clerk's office).
• Roll call was taken on the motion. Ayes, Mulvihill, Harvey, Ruhmann, Zaun,
Sindt.
There being no unfinished or new business, Mayor Zaun adjourned the meeting
at 8:15 p.m.
