HomeMy WebLinkAbout0200 ORDINANCE NO. 200 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING ORDINANCE N0. 167, BEING THE ZONING ORDINANCE OF THE CITY OF LAKEVILLE The City Council of the City of Lakeville ordains as follows: Section 1. That Ordinance No. 167 is hereby amended to rezone to R-6, Medium Density Residential, the following described land located within the City of Lakeville, Minnesota: All that part of the SE4 of the SE4 of Section 29> Township 114, Range 20, Dakota County, Minnesota, described as follows: Commencing at the southeast corner of said Section 29; thence North 0 degrees 04 minutes 17 seconds East, assumed bearing, on the east line of the SE4 of said section a distance of 547.62 feet to the former southerly right of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence North 73 degrees 52 minutes 24 seconds West on the said former southerly right of way line of said railroad a distance of 700.66 feet to the intersection with the easterly extension of the north line of Elm Street (now called 209th St. West) as platted in Fairfield, according to the plat thereof on file and of record in the County Recorder's Office in and for Dakota County, Minnesota, which is the point of beginning; thence South $9 degrees 19 minutes 17 seconds West on the easterly extension of the said north line of Elm Street and on the said north line of Elm Street as platted in said Fairfield a distance of 257.74 feet to the east line of W alnut Street (now called Holt Avenue) as platted in said plat of Fairfield; thence North 0 degrees 00 minutes 43 seconds West on the east line of said Walnut Street to the former southerly right of way line of said railroad; thence South 73 degrees 52 minutes 24 seconds East on said former southerly right of way line of said railroad to the point of beginning. Section 2. The zoning map of the City of Lakeville shall not be republished to show the aforesaid zoning, but the Clerk shall appropriately mark the zoning map on file in the Clerk's office for the purpose of indi- cating the rezoning hereinabove provided for in this Ordinance and all of the notations, references and other information shown thereon are hereby incorporated by reference and made a part of this Ordinance. Section 3. CLAY, being duly sworn, on oath say they are and during all the times herein stated have been the publishers and printers of the newspaper known as Dakota County Tribune and have full knowledge of the facts herein stated as follows: Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at (east 900 square inches. Said newspaper is a weekly and is distributed at least once each week. Said newspaper has 50 per cent of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up en- tirely of patents, plate matter and advertisements. Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75 per cent of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office. Said newspaper purports to serve the Cities in the County of Dakota and it has its known offices of issue in the Cities of Farmington, Rosemount, Burnsville, Apple Valley, and Lakeville established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer of said newspaper or persons in it's employ and subject to their direction and control during all such regular business hours and at which said newspaper is printed. Said newspaper files a copy of each issue immediately with the State Historical Society. Said newspaper has complied with all the foregoing conditions for at (east two years preceding the day or dates of publication mentioned below. Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the managing officer of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
