ORDINANCE NO. 207
CITY OF LAKEVILLE
DAKOTA COUNTY, MINNESOTA
AN ORDINANCE AMENDING ORDINANCE NO. 167,
BEING THE ZONING ORDINANCE OF THE CITY OF LAKEVILLE
The City Council of the City of Lakeville ordains as
follows:
Section 1. That Ordinance No. 167 is hereby amended
to rezone the following described land located within the City
of Lakeville, Minnesota:
Parcel No. 1. From CBD-I, Industrial, and CBD-C, Commercial,
entirely to CBD-C, Commercial.
All that part of the SE4 of the SE4 of Section 29, Township 114,
Range 20, Dakota County, Minnesota, described as follows:
Commencing at the southwest corner of the SE4 of the SE4 of said
Section 29; thence North, assumed bearing, on the west line of
the said SE4 of the SE4 a distance of 945.52 feet to the intersec-
tion with the westerly extension of the former southerly right
of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad;
thence South 73 degrees 52 minutes 24 seconds East on the said
westerly extension of the former southerly right of way line 41.64
feet to the former west right of way line of said railroad; thence
North on the said former west right of way line 41.64 feet to the
point of beginning; thence South 73 degrees 52 minutes 24 seconds
East on a line parallel with the former southerly right of way
line of said railroad 281.06 feet to the former east right of way
line of said railroad; thence North on the said former east right
of way line 114.51 feet to the former northerly right of way line
of said railroad; thence North 73 degrees 52 minutes 24 seconds
West on the said former northerly right of way line 281.06 feet
to the former west right of way line of said railroad; thence South
on the said former west right of way line 114.41 feet to the point
of beginning.
Parcel No. 2. From B-4, General Business, and R-2, Single Family
Residential, to R-6, Medium Density Residential:.
Outlot A, Yung Addition, Dakota County, Minnesota, except the east
237.25 feet thereof and except beginning at the southwesterly corner
of said Outlot A; thence easterly along the southerly line of said
Outlot A, 33.40 feet; thence northerly perpendicular to the said
southerly line of Outlot A, 48.32 feet to the northerly line: of
said Outlot A; thence westerly on the northerly line of said Outlot
A, 47.60 feet to the northwest corner of said Outlot A; thence
southerly on the west line of said Outlot A, 50.45 feet to the
point of beginning.
Also all that part of the former right of way of the Chicago,
Milwaukee, St. Paul and Pacific Railroad in the SE4 of the SE4
of Section 29, Township 114, Range 20, Dakota County, Minnesota,
bounded on the west by the east line of Central Square and its
northerly extension and bounded on the east by the southerly exten-
sion of the west line of the east 237.25 feet of Outlot A, Yung
Addition.
Parcel No. 3. From B-4, General Business, and R-2, Single Family
Residential, to R-5, Single Family, Two Family and Medium Density
Residential:

The east 122.27 feet of Outlot A, Yung Addition, Dakota County,
Minnesota, according to the plat thereof on file and of record.
Subject to an easement for drainage and utility purposes over,
under and across the west five feet thereof and over, under and
across the northerly 10 feet thereof.
ALSO:
That part of the SEA of the SE'-4 of Section 29, Township 114, Range
20, Dakota County, Minnesota, described as follows:
Commencing at the southeast corner of said Section 29; thence North
0 degrees 04 minutes 17 seconds East, assumed bearing, on the east
line of the SE4 of said section 547.62 feet to the former southerly
right of way line of the Chicago, Milwaukee, St. Paul and Pacific
Railroad and the point of beginning; thence North 73 degrees 52
minutes 24 seconds West on the said former southerly right of way
line 156.65 feet to the intersection with the southerly extension
of the west line of the east 122.27 feet of Outlot A of Yung Addi-
tion, according to the plat thereof on file and of record in the
County Recorder's Office in and for Dakota County, Minnesota; thence
North 0 degrees 23 minutes 47 seconds West on the said southerly
extension 104.31 feet to the former northerly right of way line
of said railroad, said point being on the southerly line of said
Outlot A of Yung Addition; thence South 73 degrees 52 minutes 24
seconds East on the said former northerly right of way line and
on the southerly line of said Outlot A of Yung Addition and its
easterly extension 157.54 feet to the east line of the SEA of said
Section 29; thence South 0 degrees 04 minutes 17 seconds West on
the said east line of the SE-4' of said Section 29 a distance of
104.06 feet to the point of beginning. Subject to an easement for
drainage and utility purposes over, under and across the west five
feet thereof; over, under and across the southerly 10 feet thereof
and over, under and across the east 10 feet thereof.
Section 2. The zoning map of the City of Lakeville shall
not be republished to show the aforesaid zoning, but the Clerk
shall appropriately mark the zoning map on file in the Clerk's
office for the purpose of indicating the rezoning hereinabove pro-
vided for in this Ordinance and all of the notations, references
and other information shown thereon are hereby incorporated by
reference and made a part of this Ordinance.
Section 3. This Ordinance shall be in full force and
effect from and after its publication according to law.
Adopted this 2nd day of August 1982.

JOSEPH R. CLAY and DANIEL H. CLAY, being duly sworn, on oath say they are and during all the
times herein stated have been the publishers and printers of the newspaper known as Dakota County
Tribune and have full knowledge of the facts herein stated as follows: Said newspaper is printed in the
English language in newspaper format and in column and sheet form equivalent in printed space to at
least 900 square inches. Said newspaper is a weekly and is distributed at least once each week. Said
newspaper has 50 per cent of its news columns devoted to news of local interest to the community
which it purports to serve and does not wholly duplicate any other publication and is not made up en-
tirely of patents, plate matter and advertisements. Said newspaper is circulated in and near the
municipality which it purports to serve, hos at least 500 copies regularly delivered to paying
subscribers, has an average of at least 75 per cent of its total circulation currently paid or no more than
three months in arrears and has entry as second-class matter in its local post -office. Said newspaper
purports to serve the Cities in the County of Dakota and it has its known offices of issue in the Cities of
Farmington, Rosemount, Burnsville, Apple Valley, and Lakeville established and open during its
regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and
maintained by the managing officer of said newspaper or persons in it's employ and subject to their
direction and control during all such regular business hours and at which said newspaper is printed.
Said newspaper files a copy of each issue immediately with the State Historical Society. Said newspaper
has complied with all the foregoing conditions for at least two years preceding the day or dotes of
publication mentioned below. Said newspaper has filed with the Secretary of State of Minnesota prior to
January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of
State and signed by the managing officer of said newspaper and sworn to before a notary public stating
that the newspaper is a legal newspaper.
They further state on oath that the printed
