ORDINANCE N0. 91
AN ORDINANCE REGULATING THE SURFACE WATER USE OF
LAKE MARION IN THE CITY OF LAKEVILLE.
The City Council of the City of Lakeville does ordain:
Section 1. Definitions. The following words and terms,
whenever they occur in this Ordinance, are defined as follows:
(1) Slow minimum wake speed - Operation of a watercraft
at the slowest speed possible while still maintaining
steerage control.
(2) Lake - Lake Marion.
(3) Council - The Lakeville City Council.
Section 2. Districts and Maps.
2.1. Districts. For the purpose of this Ordinance,
the Lake is hereby divided into the following zones:
(1) Slow minimum wake speed zone.
(2) Speed zone.
2.2 Maps. The boundaries of the above districts
are hereby established as shown on that certain map entitled
"Water Surface Regulations of Lake Marion, Lakeville, Minne-
sota, 3rd day of May , 1976", which map is herein-
after referred to as "surface water map" and is incorporated
herein and made a part hereof.
2.3. Boundaries. Where any uncertainty exists as
to the exact location of a district boundary line, as shown
on said zoning map, the location of such line shall be
determined by the Council.
Section 3. Slow Minimum Wake Speed Zone. It shall be
unlawful for any watercraft to be operated faster than the slow
minimum wake speed in a slow minimum wake speed zone.
Section 4. Speed Zone. The maximum speed limit in a
speed zone shall be 35 m.p.h. except that any power craft within
200 feet of anchored fishermen, trolling fishermen, non-powered
watercraft, buoys, docks or swimmers shall travel at a slow minimum
wake speed.
Section 5. Traffic Patterns. All power boats, whether
or not pulling water skiers, shall travel in a counter-clockwise
direction on the "First Lake" as indicated on the surface map,
except that any watercraft launching or landing a person on skis,
aquaplane, or similar device may do so by the most direct route to
open water.
Section 6. Time Restrictions. From one-half hour after
sunset until 8:00 A.M. watercraft shall not tow a person on water
skis, aquaplane, or similar device.
Section 7. Exemption. Law enforcement officials and
state and local resource management personnel are exempt from the
provisions of this ordinance when acting in the performance of
their official duties.
Section 8. Enforcement. Any person who violates this
Ordinance shall be guilty of a misdemeanor and upon conviction
thereof shall be subject to a fine of not more than $300.00 for any
offense or to imprisonment not to exceed 90 days.
Section 9. Effective Date. This Ordinance shall become
effective upon its adoption and publication according to law.
