HomeMy WebLinkAbout0090 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA ORDINANCE N0. 90 AN ORDINANCE ESTABLISSiNG A COMMISSION TO PLAN FOR TEE PHYSICAL DEVELOPMENT OF THE CITY AND TO MA&E RECOMMENDATIONS TO THE CITY COUNCIL IN REGARD TO LAND USE QUESTIONS AND THE LIRE. The City Council of the City of Lakeville ordains: SECTION 1. ESTABLISHMENT OF A COMMISSION. The Planning Commission of the City of Lakeville is hereby established and shall be titled "The Planning Commission of the City of Lakeville, Dakota County, Minnesota". SECTION 2. COMPOSITION AND TERMS OF OFFICE. 1. The Planning Commission shall consist of seven (7)membera appoint- ed by the City Council.. 2. Terms of .off ice for members shall be for three years, overlapping as presently established. 3. Members shall be appointed from among persona in a position to re- present the general public interest, and no person shall be appointed with pri- vate or personal interests likely to conflict with the general public interest. If any person. appointed shall find that his private or personal interests are involved in any matter coming before the Planning Commission, he shall disqualify himself from taking part is action on the matter, or he or she may be diaquali- fled by the chairperson of the Planning Commission. 4. Every appointed member shall before entering upon the discharge of his duties, take an oath that he or she will faithfully discharge the duties of the office. SECTION 3. REMOVAL FROM OFFICE; VACANCIES. 1. Any member of the Planning Commission may be removed from office by a `fir-fifths vote of the entire City Council. In addition, any member may be removed for non-attendance at three consecutive Planning Commission meetings by the City Council. 2. It shall be the duty of the chairperson of the Planning Commission to notify the City Council promptly of any vacancies occurring in membership, and the City Council shall fill such vacancies within thirty (30) days thereof for the unexpired term of the original appointment. 1 - SECTION 4. STRUCTURES, OFFICERS, PROCEDURES, SALARIES AND EAPENSES. 1. At the first meeting of the year, the Planning Commission shall elect a chairperson whose election must receive the confirmation of the City Council.. No Planning Commission member shall serve more than two consecutive years as chairperson. 2. At the first meeting of the year the Planning Commission shall elect a vice chairperson from those of its members and may create such other offices as it may determine. Terms of all elected offices shall be for one year, with eligibility for reelection. 3. The Planning Commission shall adopt rules for its governance and for the transaction of its business, and shall keep a record of attendance at its meetings and of resolutions, transactions, findings, and determinations showing the vote of each member on each questions requiring a vote, or if ab- sent or abstaining from voting indicating such fact. When the Planning Commis- sion recommends the denial of any matter before it, the reasons for the denial shall be stated in the recommendation to the City Council. The records of the Planning Commission shall be a public record. 4. Sub3ect to prior approval of the City Council and within limits set by appropriations or other funds made available, the Planning Commission may use such City staff, technicians and experts as may be deemed proper, and .may incur such other expenses as may be necessary and proper for the conduct of its affairs. Members of the Planning Commission shall receive no salaries or fees for their services thereon, but may receive necessary travel, per diem and other expenses while on official business for the Planning Commission if funds are available for this purpose. 5. The Planning Commission shall hold at least one meeting each month. 6. A meeting to be official must have a quorum present. Five (5) regular members shall constitute a quorum. 7. All motions and resolutions must have the majority of votes present to be official. 8. The City .Council shall make available to the Planning Commission such appropriations as it may see fit for fees and expenses necessary in the conduct of its work. -y- M~r, SECTION 5. FUNCTIONS, POWERS AND DUTIES. The functions, powers and duties of the Planning Commission shall be, in general: 1. To acquire and maintain in current form such basic information and historical data as is necessary to an understanding of past trends, present economic and social farces at work to cause changes in these conditions. 2. To prepare and keep current a comprehensive general plan for meet- ing present requirements and such future needs as may be foreseen, based on demographic and statistical trends and data available. 3. To establish principles and policies for guiding action affecting development in the city and its environs. 4. To prepare and recommend to the City Council ordinances, regula- tions, and other proposals promoting orderly and economically sound development along lines indicated as desirable by the comprehensive plan. 5. To determine whether specific proposed developments conform to the principles and requirements for the comprehensive plan and the ordinances. 6. To keep the City Council and the general public informed and ad- vised as to all planning and development matters. 7. To conduct such public hearings as may be required to gather in- formation necessary for the drafting, establishment and maintenance of the comprehensive plan and ordinances and regulations related to it. The Commission may establish sub-committees from their membership to study and recommend to the full commission on the comprehensive plan fiscal planning-and ordinances. S. To perform other duties which may be lawfully assigned to it, or which may have bearing on the preparation or accomplishment of the plan. 9. In connection with ite duties, and within the limit of its funds as provided by the City Council upon request, the Planning Commission may make, cause to be made, or obtain maps, aerial photgraphs and surveys, and special studies on the location, condition and adequacy of specific facilities of the City and, as appropriate, its environs, including, but not limited to, studies on housing, commercial and industrial facilties; economic development; parks; plaggrounds attd other recreational facilities; schools; public and pri- vate utilities; and traffic, transportation and parking, and employment. 10. No change shall be made in the zoning plan, future street and public land plan or regulations governing the platting of land, until the proposed change has been referred to the Planning Commission for a report -3- thereon and an attested copy of such report has been filed with the City Council, and no ordinance or resolution establishing anq such plans or speci- fications shall be adopted by the City Council until such ordinance or resolu- tion has been referred to the Planning Commission for a report thereon, and an attested copy of such report has been filed with the City Council. Failure of thesPlanning Commission so to report within sixty (60) days or such longer period as may be designated by the City Council after such reference shall be deemed to be approval of the proposed change. 11. All public hearings required by the City's zoning ordinance shall be conducted by the Planning Commission. 12. All public hearings on the vacation of streets and alleys shall be conducted by the Planning Commission. 13. As part of its duties, the Planning Commission shall prepare a list of public works which it believes are necessary and desirable to be con- structed when specifically requested to do so by the City Council. Such list shall be arranged in order of preference with recommendations as to which pro- jects shall be constructed with the City general funds, and which with road and bridge funds, and such other methods of financing as it deems advisable. 14. It shall be the responsibility of the Planning Commission to pass upon all proposed new or amended plats coming directly or indirectly under the jurisdiction of the City. The Planning Commission shall make a recommendation to the City Council whether or not the proposed new or amended plat should be approved. 15. No building permit for new structures or additions and/or ex- terior remodeling of existing structures to be erected on commercial and/or industrial property shall be issued until the application for the permit has been refereed to the Planning Commission for report thereon, and a copy of such report has been filed with the City Council. Failure of the Planning Commission so to report within sixty (60) days, or such longer period as may be designated by the City Council after such reference, shall be deemed to be approval of the permit by the Planning Commission. SECTION 6. CONFLICTS WITH OTHER ORDINANCES, SEPARABILITY OF PRO- VISIONS. Ordinance No. 15 of the City of Lakeville is hereby repealed. Should any section of this Ordinance he held unconstitutional or void, the remaining provisions shall nevertheless remain in full force and effect. -4- .f . . ' SECTION 7, EFFECTIVE DATE.
