HomeMy WebLinkAbout0077 ORDINANCE NO. Z? AN ORDINANCE PROVIDING FOR NOTICE OF COUNCIL MEETINGS AND MEETINGS OF COMMITTEES, BOARDS AND COMMISSIONS. The City Council of the City of Lakeville does ordain: Section 1. Scope and Responsibility for Notifying Public. It is declared to be the policy of the City Council of the City of Lakeville that all of its meetings shall be open to the public, and the presiding officer of the City Council shall have the responsibility of fulfilling the notice: requirements of .Sections 3 and 4, and supply- ing the necessary information therefor to the-City Clerk. Section 2. Special Meetings of the Council. Special meetings of the City Council may be called by the D4ayor or upon. his refusal by any written request submitted to the City Clerk by any two (2) members of the City Council. At least twenty-four (24) hours before the:.time of the meeting, the City Clerk shall notify each member of the time, place and agenda of the meeting by causing written notice thereof to be delivered to him personally if he can. be found, or i,f he cannot be found,. by leaving a copy of said notice at the home of the member with some person of suitable age and dis- cretion. Such notice may be waived by the unanimous consent or waiver of the. entire City Council, which consent or waiver shall be in writing. No matters other than those listed on the written agenda shall be determined by the Council, unless waived by the unanimous vote of all Council members. It shall be the duty of the presiding officer of the City Council to provide notice to the public pursuant to Sections 3 and 4. Section 3. Notice Requirement. It shall be the duty of the presiding officer of the City Council to notify all of its members in writing of the date, time ..and place of a meeting and the topics to be discussed, at least twenty-four (24) hours before such meeting. The presiding officer of the City Council shall furnish a copy of i• .such notice to the City Clerk, who shall .act in accordance with Section 4. Section 4. Official Bulletin Board. The City Clerk shall cause to be installed and maintained a bulletin board readily accessible to public view at the main entrance to the City Hall, upon which she shall post all notices transmitted to her and as required by this chapter. Section 5. Emergency Meetings. Emergency meetings shall be open to the public, but notice requirements hereunder as to the public .need not be complied with if impractical. Notice requirements for such meetings of the City Council or a commission as to the. members thereof shall conform to the procedures set forth in Section 2. An emergency meeting is one called to institute immediate action involving the protection of the public peace, health or safety. Section 6. Penalty. 'Persons in violation of this ordinance may be penalized only as provided by the .sanctions set forth in statutory enactments concerning open meetings. Section 7. Effective Date.
