LICENSING' OF SCAVENGERS WITHIN THE CITY OF LAKEVILLE`AND IMPOSING A PENALTY FOR VIOLATIONS THEREOF Be it ordained by the City Council of the City of Lakeville: Section 1. LICENSE REQUIRED: No person shall follow or .practice the occupation of scavenger or act as a scavenger within the City without first having obtained a license as provided herein. No person shall empty the contents of any privy, privy box, vault, sink, septic tank or cesspool into any .manhole or other outdoor sewer installation or at any dump or sanitary landfill in the City, excepf at the locations designated by .the City With the approval of the Metropolitan Sewer Commission, Hader the terms and conditions set forth herein. Section 2, TRANSPORTING SEWAGE: No part of the contents of any such sanitary sewage £acility shall be transported into and deposited within the City, nor shall the contents of any such £acility be transported within or through the City unless it is removed and transported by means of an air-tight apparatus, pneumatic or otherwise, so as to prevent the contents from being ag~.tated or exposed to open air in the process of removal of transportation. Section 3. TANKS: Any tank, vehicle or other apparatus .used in transporting the contents from any such facility must be maintained and operated in such a manner as to avoid-the emission of offensive fumes or the.. spilling or loss of any- unsanitary or offensive substance. Section 4. PERMIT TO REMOVE: In the event that ,the contents of a cesspool or septic tank are to be removed therefrom, a permit shall first be secured from the City. A permit f_ee of $ pp shall be paid for each such permit. The obtaining of suc~~ a permit shall entitle the scavenger who removes such contents to deposit the same in the designated locations as provided herein. Section 5. AUTHORITY OF LICENSEE: No person other-than a properly. licensed scavenger shall clean any sanitary or plumbing facilities listed in Section 1 hereof. Section 6. APPLICATION FOR LICENSE: Application. for a scavenger's license shall be made to the Clerk, shall be signed by the applicant and shall contain .the name and address of the proposed license and of the owner and license number of any vehicle to be used. When such application is filed with the Clerk, he shall transmit it to the Plumbing Inspector for .approval and issuance. Section 7. LICENSE FEE: The fee for such license shall be $ ~~11 ) per vehicle per year or fractional. part there- o . L censes s all expire bn December 31 next following the date when they become effective. :f Section 8. VEHICLE REGIFTRATION: Such license shall constitute a registration of the vehicle so licensed and of°-the tanks, containers and equipment to be used therewith and no other vehicle, tank or equipment may be used without first obtaining written approval of the same from the Plumbing Inspector. Section 9. VEHICLE TO DESIGNATE LICENSEE: The name of the licensee or his registered trade name shall be printed in plain letters on each side of. the cab of each vehicle and the City license number shall be displayed in a conspicuous place on or inside of, the cab of such vehicle. Section 10. VEHICLE LEFT STANDING: No person shall cause or permit any vehicle used £or.scavenger hauling to stand or remain at or near any public building or residence or upon any street, highway, or other public place for any longer time than is actually required in the loading, conveying and unloading thereof. Section 11. UNLOADIidG: The unloading of the contents from any such vehicle at the designated locations of;the City shall be between the hours of eight o'clock (8:00) A.M, and four thirty o'clock. (4:30) P.M. Mondav through Friday. The driver of such vehicle must have evidence in his possession, in the form of a permit, indicating that he has paid the necessary permit fee and that the material to be so deposited has been scavenged in the City. Section 12. LIABILITY INSURANCE: No license for any vehicle shall be issued unless and .until the applicant has filed with the Clerk a policy or polzcies of insurance against liability for wrongful death or personal injury in the amounts. of at least one hundred thousand dollars ($100,000.00) per person and three hundred thousand ($300,000.00) per accident and against liability for property damage in the sum of at least twenty five thousand {$25,000.00). Such policy shall provide that it may not be cancelled by the insurer except upon notice to the City. In case of cancellation of such insurance, such license shall be suspended automatically. Section 13. REVOCATION OF LICENSE: Violation of any. of the provisions of this ordinance by any licensed scavenger shall result in automatic revocation of all scavenger licenses issued to such licensee. Section 14. PENALTIES: Any person or firm who shall violate any provisions of this ordinance shall be deemed guilty of a misdemeanor and shall be punished by a fine of not to exceed three hundred dollars {$300.0:0) or: imprisonment in the County Jail for not. more than ninety {90) days, or both, for each offense.."Each day of violation shall be considered a separate offense. Section 15. EFFECTIVE DATE: This ordinance shall become effective from and after the date of publication according to law. Adopted this 15tt? day of April, X974.'
