ORDINANCE NO. 68
AN ORDINANCE AMENDING ORDINANCE N0. 42 OF THE CITY OF
LAKEVILLE BEING THE ZONING ORDINANCE OF THE CITY OF LAKEVILLE,
MINNESOTA.
THE CITY COUNCIL OF THE CITY OF LAKEVILLE DOES ORDAIN:
Section 1.
That Ordinance No. 42 be amended by amending Section
4.32 of said Ordinance to read as follows:
4.32 Areas Without Sanitary Sewer
Tn areas without public sanitary sewer, single and
two family homes shall have a minimum lot area of
3 acres; smaller lots may be permitted by the governing
body only if it can be demonstrated by percolation tests
or other means that said small lots will not result in
ground water, soil, or other contamination which might
endanger the public health; likewise, larger lots may
be required on the basis of percolation or other tests.
Non-residential land uses and apartment buildings may be
permitted in areas without sanitary sewer only if a
special use permit .is issued; said special use permit shall
not be granted if the governing body determines that a
satisfactory waste disposal,method;and system is not
available,
Section 2.
This ordinance shall become effective upon its passage,
approval and publication.
Adopted this 7th day of Sanuary, 1974.
