ORDINANCE NO. 66
AN ORDINANCE REGULATING THE LABELING,
SALE, ADVERTISING AND DISPLAY FOR SALE
OF MILK IN THE VILLAGE OF LAKEVILLE.
The Village Council of the :Village of Lakeville, Dakota
County, Minnesota, does ordain as follows:
Section 1. Definitions.
(a) "Milk" means the fluid, whole, fresh, clean lacteal
secretion containing not less than 8.25 percent milk solids--not
fat--and not less than 3.25 percent of milk fat and practically
free from colostrum, obtained by the complete milking of one or
more healty cows.
(b) "Grade A Milk" means Grade A raw milk for pasteu-
rization which. has been pasteurized, cooled and prepared for dis=
tribution in a dairy plant approved by the Minnesota State Commissioner
of Agriculture, the bacterial count of which at no time after pas-
teurization and until delivery exceeds 30,000 bacteria per milliter,
standard plate count, as determined by averaging the logarithms of
the results of the last four consecutive tests of samples taken on
separate days, except that such average may be over 30,000 bacteria
per milliliter if the last individual result is 30,000 bacteria per
milliliter or lower, and not more than .one of the last four coliform
counts of which shall exceed 10 per milliliter unless the last in-
dividual result is 10 per milliliter or lower.
(c) "Grade A Raw Milk for Pasteurization" means raw milk
which complies with all the requirements for its production, the
bacterial count of which does not exceed 200,000 bacteria per milli-
liter, standard plate count or direct microscopic clump count, as
determined by averaging the logarithms of the results of the last
four consecutive tests of samples taken on separate days, except
that such average may be over 200,000 bacteria per milliliter if
the last individual result is 200,000 bacteria per milliliter or
lower.
(d) "Pasteurization" refers to .the process of heating
fluid milk as required by M.S.A. 32.21 through 32.47.
(e) "Grade B Milk" means Grade B raw milk for pasteuriza-
tion which has been pasteurized,; cooled and prepared for distribution
in a plant approved by the Minnesota State Commissioner of Agriculture,
the bacterial count of which at no time after pasteurization and until
delivery, exceeds 50,000 bacteria per milliliter. or is Zess than
80,000 bacteria per milliliter, standard plate count, as determined
by averaging the logarithms of the results of the last four consecu-
tive tests of samples taken on separate days, except that such average
may be over 50,000 bacteria per milliliter if the Last individual
result is 50;000 bacteria. per milliliter or lower, and not more than
one of the last four coliform counts of which shall exceed 10 per
milliliter unless the last individual result is 10 per milliliter or
lower.
(f) "Grade B Raw Milk for Pasteurization" means raw milk
which complies with all the requirements for its production, the
bacterial count of which does not exceed 500,000 bacteria per milli-
liter, standard plate count br direct microscopic clump count, as
.determined by averaging the logarithms of the results of the last
four consecutive tests of samples-taken on separate days, except
that such average may be over 500,000 bacteria per milliliter if the
last individual result is 500,000 bacteria per milliliter or lower.
Section 2. Labeling.
All containers in which milk is sold shall bear the name
and address of the producer or the distributor. Any container in
which Grade B milk is sold shall be conspicuously imprinted with .the
label "Grade B."

Section 3. Display.
Any retail market or store selling Grade B milk shall
display the Grade B milk on a shelf or area separate from all .other
types of milk, such that the customers of the market or store can
clearly distinguish the Grade B.milk from all other types of milk.
Section 4. Advertisement.
Any advertisement for the sale of milk shall clearly
indicate whether the milk advertised is Grade A or Grade B milk.
Section 5. Effective Date.
This ordinance shall be effective upon its passage,
approval and publication.
