HomeMy WebLinkAbout04-24-91 CITY OF LAKEVILLE SPECIAL COUNCIL MEETING APRIL 24, 1991 The meeting was called to order at 7:00 p.m. by Mayor Zaun. Roll call was taken. Present: Councilmembers Ruhmann, Sindt, Mulvihill, Harvey and Mayor Zaun. Also present: B. Erickson, City Administrator; C. Friedges, City Clerk. MINU'PE S The minutes of the April 8, 1991, Special Council meeting were approved as presented. ITEM 5 Mr. Marvin Pulju, Dakota County Assessor, provided a ]ast of 100 property owners who appeared at the April 8th Board of Review meeting. There were 57 reviews resulting from the Board of Review meeting, 43 .letters received and 12 additional reviews resulting from phone calls. He explained that the assessor's office has completed 163. reviews. Mr. Pulju provided a list of the properties and adjustments that have been made. There are still 32 reviews pending; a list of these properties and the reasons. they are .unresolved were • also provided. Councilmember Harvey questioned the William Dolan property review which is pending. He asked .why Mr. Dolan has bypassed this meeting and plans to appeal to the County Board of Review. Mr. Pulju stated the property owner was advised he could attend the local Board of Review,. but chose to appeal at the County level. Mr. Ernie Darflinger stated he represents the owners of Lot 33, Argonne Farms, who "are appealing the assessed market value of their property.. He stated his clients, Mr. Wayne .Doyle and Mr. Richard Whybrew, were advised by the County Assessor's Office not to attend the local Board of Review meeting this evening. Mr. Darflinger provided a comparison of current and previous values on Lot 33 of Argonne Farms and the parcels surrounding it. He also showed increases in valuation of Parcels 30, 31, 32, 34, 36 and 37. He pointed out that the valuations oxa these parcels have been increased anywhere from 26~ to 43% from last year. Parcel 33, however, has. been increased by the Assessor's Office $153,400, which is 930% over last year. He stated he and his clients. have contacted the Assessor's staff and have received no reasonable explanation for this increase. CITY OF LAKEVILLE SPECIAL COUNCIL MEETING APRIL 24, 1991 PAGE 2 Mr. Steve Nelson, Senior Appraiser, stated the property, which is zoned commercial, has not been previously valued consistent with market conditions in that area. He offered to lower the value to $91,400 for a more even transition with nearby properties. He stated the appraisers would have to go back next year and re-evaluate the other. parcels to bring them all in line with the current market.. Councilmember Harvey was concerned with the differential between this parcel and the surrounding parcels. He suggested the assessor apply a similar increase to Parcel 33 as was applied to the neighboring parcels, assuming they were all properly assessed last year. That increase .would be 40%, which would establish the land value of Parcel 33 at $23,100 for 1991. Mr. Erickson agreed that a more in-depth market analysis is needed in that area of the City, as the land. is probably valued lower than what it should be. However, all parcels should be :evaluated and. adjusted consistently. 91.77 Motion was made by Harvey, seconded by Sindt to acknowledge receipt of the Dakota County Assessor°s Office reports and • information from Mr. Darflinger on Parcel 33 of Argonne Farms. Roll call was taken on the motion. Ayes, Zaun, Sindt, Mulvihill, Harvey, Ruhmann. 91.78 Motion was made by Harvey, seconded by Ruhmann to direct the County Assessor's Office to increase the land value on Parcel 33 of Argonne Farms by 40% of last year's valuation ($16,500)® which brings the 1991 assessed value to $23,100. Roll call was taken on the motion. Ayes, Ruhmann, Zaun, Sindt, Mulvihill, Harvey. 91.79 Motion was made by Harvey, seconded by Sindt to close the Board of Review Meeting and direct the Assessor's Office to continue. follow-up on matters that remain pending. OF LAKEVILLE SPECIAL COUNCIL MEETING APRIL 24, 1991 PAGE 3 ITEM 3 Mr. Erickson asked the Council to consider approval of a .resolution concerning the Environmental Impact Statement (EIS) for I-35W. He explained that I-35 Solutions Alliance has been working toward improvement of traffic flow on I-35W. The EIS for the project has been delayed because of what is known as the NTN .(Neighborhood Transportation Network) Alternative being proposed by a Minneapolis neighborhood group. As stated in the resolution, if the Minnesota Department of Transportation, Metropolitan Council and Federal Highway Administration feel the NTN proposal needs to be reinserted into the EIS process,. the cities (Lakeville, Burnsville, Apple Valley, Prior Lake, Bloomington, Richfield and Savage) want. the EIS split .into two portions, with one being the portion south of the City of Minneapolis which desperately needs a third lane. This would enable construction of the third. lane in the south portion without delay. 91.80 Motion was made by Harvey, seconded by Mulvihill to approve Resolution No. 91-47 regarding the Environmental Impact Statement for I-35W improvements south of I-494. • Roll call was taken on the motion. Ayes, Sindt, Mulvihill, Harvey, Ruhmann, Zaun. ITEM 4 Mr. Erickson explained that School District No. 194 is proposing the installation of a temporary watermain to the new high school site for building construction purposes. This utility extension would not be necessary if the City proceeds this year with the extension of the existing trunk sanitary sewer and watermain along Dodd Boulevard as requested by the school clistrict in their January 15th petition. These utilities would extend along the west side of Dodd Boulevard from the north property Line of the elementary school to the north property line of the high school site. Staff is recommencling the City Council authorize preparation of a feasibility report for this project, as the school district has submitted conditional use permit and preliminary plat applications to the City. Mr. Erickson further explained that to expedite the .project, staff is recommending this work be incorporated with the 175th Street extension, Improvement Project 90-9. .Staff is also recommending the school district request a waiver of the • public hearing requirement; then only the school district's property would be assessed for lateral benefits. No assessments would be proposed east of Dodd Boulevard since aLl parcels are presently under Green Acres. Resolution No. 91-48 authorizing preparation of a .feasibility report for Dodd Boulevard utility construction, Improvement Project 91-6. Roll call was taken on the motion. Ayes, Mulvihill, .Harvey, Ruhmann, Zaun, Sindt. UNFIl~IISHED BUSINESS None. NEW BUSINESS Mr. Erickson provided a brief background on the proposed .redevelopment of the Schmitty .and Sons property on Holyoke Avenue, along with the proposed extension of sewer from McGuire Jr. High School to Holyoke Avenue and water along Holyoke Avenue from McGuire Jr. High School to 210th Street. Staff is asking the Council to consider purchasing. the Radford property,. located immediately north of Schmitty & Sons on Holyoke Avenue, so that the existing house, which has a malfunctioning septic system, can be demolished to accommodate future expansion of the Schmitty & Sons development. The property would also accommodate expansion • of the parking lot for St. John's Lutheran Church, .and would allow the City's acquisition of right-of-way easements for the trunk sewer across the Schmitty and Sons' property on the south at no cost to the City. Mr. Erickson explained that the Radford house is located in the .flood plain and is currently several feet below the .grade of Holyoke Avenue. Under a 100 year storm, the property owners would more than. likely experience water in the basement, as they have previously. The property owners currently have a purchase agreement on the property. Mr. Erickson stated that in the City Attorney's opinion, the buyers are not likely to secure financing for the property without extension of City sewer. City staff, however, questions whether it is cost beneficial to extend sanitary sewer to two non-conforming uses (the Radford house and the house owned by Schmitty & Sons) . Mr. Erickson explained that one conclition of the proposed Planned Unit Development for Schmitty & Sons is to remove their house when they proceed with their business expansion. Mr. Erickson proposed the following,. which is acceptable to Schmitty and Sons: • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING APRIL 24, 1991 PAGE 5 • 1. The Cit would not extend sewer alon Hol oke Avenue as Y g Y originally. planned as a part of Improvement ,Project 90-5, which .will save the City approximately $11,000. 2. Schmitty and Sons would tear down their existing house two years from the date the bus garage. is connected to the sewer system. 3. Reimburse Schmitty & Sons for purchase of the Radford property for $65,000, to be .paid for out of the City's Trunk Storm Sewer Fund. The City would maintain a drainage and utility easement across the entire property to improve existing drainage problems between this property and Brad Johnson's apartments. Schmitty & Sons would make approximately $30,000 of improvements to the property, including excavation, fill, curb and gutter and blacktop. They would also be required to combine all parcels. Mr. Erickson explained that all the necessary legal documents would be approved by the Council at subsequent meetings and must. be filed by Schmitty & Sons. Councilmember Sindt asked if the City should receive authorization from FEMA before proceeding. Mr. Erickson • explained that FEMA has issued the .necessary permit. The DNR has also issued the necessary permit and stated this project opens up opportunities for enhancement of .the Vermillion River trout stream by leaving the tree cover in place. Mayor Zaun asked if this action (not extending sanitary sewer to Holyoke Avenue) jeopardizes the servicing of property west of Holyoke Avenue on 215th Street Mr. Erickson stated the subtrunk extension to Holyoke Avenue would ultimately be extended westerly along the drainage course to serve the existing homes west of Dodd Boulevard along 215th Street. 91.82 Motion was made by Harvey, seconded by Mulvihill to authorize the City Attorney and City Administrator to .send the April 23, 1991, proposal letter to Schmitty and Sons,. with proposal No. 3 to read, "The City would participate in 100% of the purchase price of the Radford property..:'. Roll call was taken on the motion. .Ayes, Harvey, Ruhmann, Zaun, Sindt, Mulvihill. Councilmember Ruhmann asked the Council to consider passing a resolution in opposition to a provision of Senate File 1169 that would require all cities over 20,000. population to establish single-member wards for the election of city • council members. District 36 Representative Bill Macklin was present and stated he didn't feel this. provision is likely to pass the Senate Redistricting Committee this session. CITX OF LAKEVILLE SPECIAL COUNCIL MEETING APRIL 24, 1991 PAGE 6 91.83 Motion was made by Ruhmann,seconded by Harvey to approve Resolution No. 91-58 in opposition ' to a provision in Senate File 1169 that would require all cities over 2.0,000 population to establish single-member wards for the election of city. council members. Roll call was taken on the motion. Ayes, Ruhmann, Zaun, Sindt, Mulvihill, Harvey. ROBERT ERICKSON, CITY ADMINISTRATOR DATE: APRIL 23, 1991 RE: REDEVELOPMENT/IMPROVEMENT PROJECT PROPOSAL We have discussed on numerous occasions a proposed redevelopment project for the Schmitty and Sons property. The intent of the City of Lakeville is to improve drainage and provide utilities to the Schmitty and Sons site as well as clean up the appearance and reduce the conflicting land uses at the site. Our initial proposal is as follows: 1. Limit the assessments for the revised plan to 305 feet of sewer and 305 feet of water main to the Schmitty and Sons property which would be the same as under the original proposal. 2. Schmitty and Sons would tear down the existing house, garage and shed on the north parcel of Schmitty and Sons and cap the well if any. • 3. The City would participate in 100% of the purchase price of the Radford property excluding special assessments and hookup to assist Schmitty and Sons to purchase the Radford property and demolish the house. The City would be responsible for -the cost of sealing the well and demolishing the house. 4. Acquisition of right-of--way easements from Schmitty and Sons for the trunk sewer across Schmitty and Sons' property on the south would be of no cost to the City. 5. Schmitty and Sons would install harking on the site with 51 definedparking spaces now with additional parkmg to be provided at the time of future- expansion. Parking would need to be installed on the Radford property under a site plan approved by the City. 6. A reciprocal aggreement between St. John's Lutheran Church and Schmitty and Sons would be developed by Schrnitty and Sons to allow St. John's Lutheran Church parking on the Schmitty and Sons property and Schmitty and Sons parking on the St. John's Lutheran Church property south of the channel. The church would provide a right of way easement to the City for drainage improvements at no cost to the City in exchange. for the parking on the Schmitty and Sons property. 7. A future condition be placed when expansion or sale of the Schmitty and Sons property takes place that the east house is demolished at the time of expansion or sale. 8. Sidewalks improvements would be made by the City to provide access between • McGuire Jumor High, the Schmitty and Sons site, and St. Johns Lutheran Church.
