HomeMy WebLinkAbout0006 . ~p LAKEVILLE TOWNSHIP ORDINANCE NO. 6 'SAN ORDINANCE FOR THE ESTABLISHMENT OF PROCEDURES, RULES AND REGULATIONS FOR THE MOVING OF STRUCTURES INTO AND/OR WITHIN THE L?MITS OF THE TOWNSHIP OF LAKEVILLE, MINNESOTA". For the purpose of safeguarding the best interest of the Public and the Health, Morals, Convenience, Order and Prosperity of Lakeville Township, and to continue towaxd attractive, orderly, stable and wholesome community environ- ment, adequate municipal services, and safe streets, the Town Board of Lakeville Township, Minnesota, does hereby ordain: - SECTION It No building or structure shall be hereafter moved into and/or within the township limits of Lakeville Township, except under the following conditions: (a) .Any person, firm, corporation, co-partnexship or any other legal entity having a sufficient proprietary interest desiring to move buildings or structures into and/or within the limits of the Township of Lakeville shall first apply for a permit so to do to the Clerk of said Township, and shall at the time of the making of such application pay to the Township of Lakeville a fee of $50, 00. (b) The said building or structure(s) shall not be of over twenty years of age and must be so constructed as to be in compliance with all of the building and. operating codes and ordinances of Lakeville Township in effect at the time of the issuance of the permit, and must be in good repair and condition, (c) At the time of the filing of the application for a permit to move any building and/or structure(s), as herein contemplated, the applicant shall file an affidavit with the Township Clerk, which affidavit, among other things, shall recite the age, type of construction, height, accurate outside measurements, the number of rooms and descriptions thereof (i. e. living room, dining room, kitchen, bedroom, etc. number of baths, etc, of the structure(s) proposed to be moved, and the address or location where the building or structure(s) may be personally inspected by the Township Building Inspector or his designated representative. After such -1- inspection if in the opinion of the Building Inspector the building or structure(s) does not meet the conditions as outlined in paragraph (b) above, he shall so notify the Town Clerk who shall refuse to issue the permit; provided, howevex, that if the building or structure(s) in, the opinion of the Building Inspector can be remodeled, altexed and/or reconditioned so as to comply with all the requirements of the hakeville Township building code, then being so advised by the Building Inspector the Town Clerk may issue a permit conditioned on the requirements as set forth by the Building Inspectors report. When such a conditional permit is issued, it shall be a further requirement that the applicant shall at the time of the issuance of said permit(s) sign a statement acknowledging acceptance of said conditions and, further, shall post a penal bond in the sum of $5, 000. 00 in favor of Lakeville Township, guaranteeing compliance with said conditions. A.11 permits shall be for the duration of one (1) year from date of issuance. Any moving, remodeling, alteration or reconditioning of any building ox structure(s) must be completed within that period; and in the case of a conditional permit, said penal bond shall remain in full force and effect until. all conditions are fully complied with. (d) The applicant shall notify all owners of other property lying within 300 feet of the outside dimensions of the lot or tract on which the building and/or structure(s) axe to be moved, and as a condition to the granting of said permit, written the applicant must secure the/consent of n®t less than ?5 percent of such owners. (e) A building permit or permits, such as is required under the township building code for any other construction in Lakeville Township, and the payment of fees therefor shall be required in addition to the permit to move the building and/or structure(s) into or within the limits of Lakeville Township. SECTION II: Variances. may be granted by the Town Board, Application for variance must follow the procedures as set forth in Lakeville Township Ordinance NO. II, as Amended, Section IV, except subparagraphs 2 and 3 of paragraph A thereof. -2- w ~ SECTION IIIs Any violation or failure to comply with any provision hereof shall be a penal offense upon conviction of which there shall be a fine of not to exceed $100.00, plus costs, or imprisonment in the county jail not to exceed 90 days. Each day that the violation is permitted to exist shall constitute a separate. offense. SECTION IVt If any provision of this Ordinance shall be severable from any other part or provision thereof, and i.f one or more provisions are held invalid by the Court, such invalidity shall not affect any other part or provision thereof. SECTION y: This Ordinance shall take effect and force frpm and after its passage and publication.
