HomeMy WebLinkAbout0009 AN AMENDMENT TO LAKEVILLE VILLAGE ORDINANCE NO. 9 ENTITLED AN ORDINANCE REGULATING THE' P 4RKING OF MOBILE' HOME'S, MOBILE' HOUSES AND MOBILE COACHES' WITHIN LIMITS- OF THE TOWNSHIP OF LAKEVILLE., DAKOTA COUN- TY, MINNESOTA, TO PROTECT THE PUBLIC HEALTH AND SAFETY BY DEFINING LI- CENSING AND REGULATING MOBILE HOMES AND PROVIDING A PENALTY FOR VIOLA- TION THER,E'OF. Be it ordained that the Village Council of Lakeville Village, Dakota County, Minnesota, does hereby amend its Ordinance No. 9 as follows: SECTION II B, BE AMENDED TO READ AS FOLLOWS: B. No Mobile Home shall be parked on any privately owned tract of ground in any resi- dential area, platted area or within 300 feet of platted area except as hereinafter provided. SECTION II D, BE AMENDED TO READ AS FOLLOWS: D. Permits shall be of two classifications: 1. TEMPORARY PARKING. Temporary parking shall be described as a period not ex- ceeding 16 days, as herein contemplated; any parking of a Mobile Home beyond the 16 day period contemplated shall be considered as permanent parking, and be subject to the provisions of this Ordinance regulating such permanent parking. An owner of a Mobile Home may secure a permit for temporary parking which shall be good for one additional period of two weeks from and after the 48 hour period provided hereinbefore. If the Vil- lage Building Inspector finds that such application and from such further investigation as he may make, that such parking will be lawful under the provisions of this Ordinance, he shall grant the permit for a period of not in excess of that hereinbefore~ provided. The fee for the permit for temporary parking shall be $2,00, payable at the time of application. Every temporary permit shall be~ prominently displayed on the outside of the Mobile Home for which it is issued, in such a manner as to be readily noticeable at all times. 2. PERMANENT PARKING. Permanent parking shall be described as a period not ex- ceeding two years. When an application is received by the Village Clerk for a permanent permit for parking a Mobile Home said application is to be referred to the Planning Com- mission of the Village of Lakeville which shall set a date for public hearing and make rec- ommendations to the Village Council as to the granting or denying of such application. Notice of such hearing shall be published ten (10) days prior to the date of hearing and posted in accordance with law; in addition, applicants shall be required to mail a copy of the notice of hearing at least five (5) days in advance of the hearing date. to all property owners and/or occupants within 600 feet of the Mobile Home site, and, proof of such mail- ing shall be made by affidavit. Further, any applicant for a permanent permit must at the time of the filing of the application for such permit, have the written consent of not less than 75% of all owners of real property lying adjacent to and within 600 feet of the land on which said Mobile Home is to be parked. Renewal permits may be granted for a two (2) year period after notice and hearing as hereinabove required for an initial permit. Upon approval by the Village Council a permanent permit shall be issued by the Village Building Inspection. For permanent parking the initial fee shall be $75.00 and. for a renewal permit the fee shall be $35.00 payable at the time of application for either permit. Every permit shall be prominently displayed on the outside of the mobile home for which it is issued in such a manner as to be readily noticeable at all times.
