HomeMy WebLinkAbout0026 , . r ORDINANCE NO. 26 VILLAGE OF LAKEViT.T.F Dakota County, Minnesota AN ORDINANCE LICENSING AND REGULATING PERSONS ALLOWING THE CONSUMP- TION OR DISPLAY OF INTOXICATING LIQUOR OR SERVING ANY LIQUID FOR THE PUR- POSE OF MIXING WITH INTOXICATING LIQUOR; PROVIDING A PENALTY FOR THE VIO- LATION THEREOF. THE VILLAGE COUNCIL OF THE VILLAGE OF LAKEVILLE ORDAINS AS FOLLOWS: SECTION 1. DEFINITION OF TERMS. As used in this ordinance, words shall have the same meaning as the statutory usage un- der Minnesota Statutes, Chapter 340, and where not given statutory construction, they shall have their ordinary usage. SECTION 2. LICENSE- REQUIRED.. It shall be unlawful for any private club or public place, directly or indirectly, or upon any pretense, or by any device to allow the consumption or display of intoxicating liquor ox• the serving of any liquid for the purpose of mixing with intoxicating liquor without first hav- ing obtained a permit therefor from the Liquor Control Commissioner as provided in Minnesota Statutes, Chapter 340, and a license therefor from the Village of Lakeville. SECTION 3. APPLICATION FOR LICENSE. Every application for a license under this ordinance shall be made on a form supplied by the Village and shall state the name of the applicant, his age, representations as to his character, with such reference as may be required, his citizenship, the business in connection with which the proposed license will operate and its location, whether applicant is owner or operator of the business, how long he has been in that business in that place, and such other information that the Council may require from time to time. It shall be unlawful to make any false statement in an application. Applications shall be filed with the Village Clerk. SECTION 4. LICENSE FEES. SUBDIVISION 1. An application for a license shall be accompanied by a receipt from the Village Treasurer for payment in full of the required fee for the license. Upon rejection of any application for license, the Treasurer shall refund the amount paid less $25.00, which shall be retained as a handling charge for such application. SUBDIVISION 2. All licenses shall expire on the last day of June in each year. Each li- cense shall be issued for a period of one year, except if a portion of the license year has elaps- ed when the application is made, a license may be issued for the remainder of they year for a pro rata fee. In computing such fee, any unexpired fraction of a month shall be counted as one month. SUBDIVISION 3. The annual fee for the license shall be $100.00. SECTION 5. APPLICABILITY. This ordinance shall not apply to any persons or premises otherwise licensed by the Vil- lage of Lakeville for the sale of intoxicating liquor. Notwithstanding anything to the contrary contained in Ordinance No. 25 of this Village entitled "An Ordinance Licensing and Regulating the Sale and Consumption of Non-Intoxicat- ing Malt Liquors and Providing a Penalty for The Violation Thereof", a license hereunder may also operate a retail "on sale" or retail "off sale" beer business (as more particularly de- fined in said Ordinance No. 25) upon the same premises covered by the license hereunder provided the necessary license or licenses has or have first been obtained under the provis- ions of said Ordinance No. 25. Any of the provisions of said Ordinance No. 25 in conflict or inconsistent with the provisions of this ordinance are hereby repealed. - 1 - A SECTION 6. PENALTY. Any person violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction. thereof shall be punished by a fine of not more than $100.00 or imprisonment in jail for not more than 90 days. SECTION 7. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and publica- tion according to law. Adopted this 1st day of May, 1967.
