HomeMy WebLinkAbout0029 ORDINANCE. NO. 29 VILLAGE OF LAKEVILLE DAKOTA. COUNTY, MINNESOTA AN ORDINANCE ADOPTING THE MINNESOTA STATE PLUMBERS CODE AND PROVIDING FOR VIOLATIONS THEREOF. THE VILLAGE COUNCIL OF THE' VILLAGE OF LAKEVILLE ORDAINS AS FOLLOWS: SECTION 1. State Plumbing Code Adopted. The Minnesota Plumbing Code of Minimum Standards as adopted by the Minnesota State Board of Health July 20, 1937, as amended May 9, 1939, January 14, 1947, and October 16; 1951, is hereby adopted and shall be in full force and effect in this Village insofar as applica- ble to plumbing and building construction therein. All work done hereafter in the Village of Lakeville shall be done in accordance with the provisions thereof, except as herein otherwise specified. SECTION 2. Copies of Code to be Filed. Three copies of the above code shall be filed. by the Village Clerk in the Village Hall for inspection and use by the public, and shall be marked by the Clerk with the words "Village of Lakeville -Official Copy". This ordinance shall become effective upon. such filing and upon the publication hereof as required by law. SECTION 3. Amendments. The Plumbing Code adopted by reference in Section 1 of this ordinance shall be deemed amended to provide as follows: A. Notwithstanding anything in said Plumbing Code to the contrary, the following modi- fications or exceptions thereto shall be deemed to apply for the purposes of this ordinance and the use of the following plumbing materials shall be permitted: 1. ABS (Acrylonitrile-butadiene-styrene) DWV (Drain, waste and vent) and/or PVC (Poly- vinyl-chloride) DWV (Drain., waste and vent) plastic pipe and fittings conforming to Commer- cial Standards CS 2.70-65 for ABS and CS 272-65 for PVC and bearing the NSF (National San- itation Foundation Testing Laboratory, Inc.) seal of approval. All ABS and/or PVC DWV plastic pipe and fittings shall conform. to Commercial Standards CS 270-65 and CS' 272-65 for ABS and PVC respectively. 2. ABS and/or PVC DWY plastic traps conforming to Commercial Standard. The Use of Acrylonitrile-butadiene-styrene (ABS) and Polyvinyl-chloride (PVC) Drain, waste and vent (DWV) plastic pipe and fittings will be allowed for all main or branch soil, waste, vent pipes and storm water sewers, storm water drains, inside conductors, within the building, includ- ing the building drain, the building sewer and the storm water sewer in conformation with the following requirements: a. Department of Commerce Standard CS 270-65 for ABS' plastic pipe and CS' 272-65 for PVC plastic pipe. b. Federal Housing Administrations Use of Materials Bulletin No. UM-33 December 15, 1961 for plastic pipe and fittings. c. Western Plumbing Officials Associations Materials Standard PS 17-65 for ABS plastic pipe. d. All pipe and fittings shall be marked at a minimum of every 24 inches with the Seal of Approval of the National Sanitation Foundation Testing Laboratory, Inc. (NSF). Installation procedure shall be as prescribed in the Federal Housing Administration Use of Materials Bulletin, UM-33, Section 8, paragraphs 1 through 8, inclusive, except that para- graph 8:7.1 and 8:7.3 shall be amended to specify 32" and 36" for spacing and support respec- tively. All exposed vertical risers 2" and less shall be supported every 48" and all drains from appliances normally utilizing water over 120° F. such as automatic dish washers shall be con- i . f~ ' tinuously supported to the main drain line. Further, the Western Plumbing Officials Associa- tion Installations Standard for plastic drain, water and vent pipe No. IS 5-65 of January 12, 1961 shall also be followed for thermal expansion and handling of antifreeze protection. SECTION 4. Permits Required. Before proceeding with any plumbing construction, enlargement, alteration, or repair (of a cost in excess of $50.00) including but not limited to the installation of water softening de- vices or of gas, oil or coal heating equipment or of gas designed appliances, the owner of the property where such plumbing or installation is proposed or his agent shall first obtain a permit for such purpose from the Village Clerk. The charge for such permits shall be as fol- lows: A. Initial construction of single family dwelling: $15.00. B. Initial construction of buildings other than single family dwelling and all remodel- ing including a single family dwelling: $2.00 per fixture with a minimum of $15.00. C. All other permit fees for work covered under the provisions of this ordinance but for which no fee has been set hereunder shall be set by the Village Council by resolution from time to time. The fee for renotification where work is found defective and requires correction and reinspection shall be $7.50 for each such reinspection. SECTION 5. Definitions. A. "Building drain" as used in this ordinance shall be deemed to mean that part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste, and other drainage pipes inside the walls of a building and conveys it to the building sewer, beginning five feet outside the inner face of the building wall. B. "Building Sewer" as used in this ordinance shall be deemed to mean the extension from the. building drain to the Village sewer system. SECTION 6. Enforcement. It shall be the duty of the plumbing inspector designated by the Village Council to en- force the provisions of this ordinance. At least two inspections shall be required, one when the rough work is completed and one upon completion of the work. SECTION 7. Exceptions. The provisions of this ordinance are in addition to and not in lieu of any provisions of the State Plumbing Code. SECTION 8. Penalty. Any person failing to comply with the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not to exceed $100.00 or by imprisonment for not to exceed ninety (90) days. SECTION 9. Effective Date. This ordinance shall be in force and effect from and after its publication according to law. Enacted and ordained into an ordinance this 11th day of September, 1967.
