AN ORDINANCE REGULATING THE DISPOSAL OF GARBAGE AND RUBBISH, PROVIDING
FOR THE COLLECTION THEREOF AND LICENSING THE BUSINESS OF GARBAGE' AND
RUBBISH, COLLECTION
THE' VILLAGE COUNCIL OF THE VILLAGE OF LAKEVILLE ORDAINS
AS FOLLOWS:
SECTION I. Definitions. For the purposes of this Ordinance the following terms, phrases,
words, and their derivations shall have the meaning given herein.
1. "Garbage" is hereby defined as: "Waste. foodstuffs or table .wastes. of vegetable
or animal origin, together with other incidental admixtures. Dead animals weighing ten
pounds or less shall be classified as garbage."
2. "Rubbish" shall be construed to mean waste materials from normal household or
living conditions and business operations, other than "garbage" or "ashes", but not to in-
clude garden, lawn or tree trimmings, leaves or waste materials from building construe-
tion or repair; it shall not include factory wastes or refuse from industrial plants of any
character. in general, the kinds. of materials classed as "rubbish" are such as paper, rags,
bottles, tin cans, .cardboard, worn-out. clothing, excelsior and the like.
3. "Refuse" shall be construed to mean mixtures, in any proportions, of garbage,
ashes and rubbish.
SECTION 11. Disposal Requirements.. It shall be unlawful for any person, firm or corpora-
tion to fail to dispose of garbage and rubbish which may be, or which may accumulate, upon
property owned or occupied by him or them, in a sanitary manner. Every person firm or
corporation who shall fail or refuse to make provision for and secure such disposal shall be
guilty of a misdemeanor. Persons desiring to make use of the services of licensed garbage and
rubbish collectors may do so by notifying one of said collectors and paying the fee therefor,
and may obtain the names of the licensed collectors from the Village Clerk.
SECTION III. Garbage containers. Every householder or occupant of any dwelling house and
every operator of any boarding house, restaurant or any other .place of business having gar-
bage to dispose of, who does not otherwise provide for the disposal of such garbage in a sani-
tary manner shall provide himself with one or more metal or plastic cans sufficient to receive
all garbage in a sanitary manner and sufficient to receive all garbage which may accumulate
between the times of collection. Each metal can shall have a capacity of not to exceed twenty
gallons and shall be provided with a bail or handles and a tight fitting cover. All garbage
accumulating between the times of collection shall be placed in said cans after having first
been drained of surplus water and wrapped in paper in a manner sufficient to prevent leak-
age before it is placed in said cans.
SECTION IV. Location of containers. Garbage cans shall be kept at or near the back door of
the building using the same or at the rear of tre property if there is an alley, and shall be ac-
cessible to collectors at all reasonable times. such garbage cans shall be used for garbage only
and not for rubbish. Such garbage cans shall not be used for incinerators or burning cans and
no garbage shall be placed in any can or incinerator or container used for burning of paper and
other combustibles. No garbage shall at any time be burned in any bonfire or other fire
whether in a container or in the open.
SECTION V. Rubbish disposal. Every householder, owner, occupant or tenant of any premises
who does not otherwise dispose. of rubbish in a sanitary manner, shall place all rubbish in a
tight receptacle. If rubbish and garbage are placed in the same container, the entire contents
shall be treated as garbage for disposal purposes. It shall be the duty of each licensed garbage
and!or rubbish collector to haul away once each week to such places as designated in his li-
cense application all rubbish from premises located within the area in which he is authorized
to collect garbage and/or rubbish.

SECTION VI. Regular removal. It is the intention of the Village Council by means of this or-
dinance to establish a system of complete, regular garbage and rubbish collection throughout
the Village so that the disposal of such materials shall be accomplished in a sanitary manner
and so that the health and sanitary conditions of the residents of the Village shall be properly
safeguarded. All residents are required by this ordinance to make adequate provisions for san-
itary removal of garbage and rubbish by means of licensed collectors unless such. persons have
provided other adequate means of disposal which meet with the approval of this Village Health
Officer and which comply with all other ordinances and regulations of the Village.
SECTION VII. Unlicensed collections. Any person, firm or corporation who permits garbage or
rubbish to be picked up from his premises by an unauthorized or unlicensed collector shall be
guilty of a violation of this ordinance. The indiscriminate discarding of garbage or rubbish on
any streets, alleys, drives, parks, playgrounds or other public places or on any vacant lots
privately owned shall constitute a violation of this ordinance whether such garbage or rubbish
is discarded by the individual upon whose premises the garbage or rubbish originates or
whether it is discarded by some other person or collector, licensed or unlicensed.
SECTION VIII. Collection license. It shall be unlawful for any person, firm or corporation to
engage in the business of collecting garbage and/or rubbish without having first secured
from the Village Council a license to do so.
SECTION IX. Application and fee. Any person, firm or corporation desiring a license. to collect
garbage shall make application for the same to the Clerk upon a form prescribed by the Vil-
lage Council. The application shall set forth.
1. The name and address of the applicant;
2. A list of the equipment which h~ proposes to use in such collection;
3. The place or places to which the garbage and/or rubbish is to be hauled;
4. The manner in which said garbage and/or rubbish is to be disposed of;
5. The portion of the Village in which collections are to be made;
6. Fee which they require .for collections and conditions attached to such collection.
Said application shall be submitted to the Health Committee of the Village Council for
its investigation and report. If the Health Committee finds that the applicant is respon-
sible and has proper equipment for such collection and that no nuisance is liable to be
created by the granting of said license, it shall endorse its approval upon the applicat
tion. Before any license may be issued, the applicant shall pay to the Clerk a license fee
of $35.00 which fee shall accompany the application. No license issued hereunder shall
be for a longer period than one year, and all licenses shall expire on December 31st of each
year.
SECTION X. Before any license may be issued, the applicant shall, if his application is approv-
ed by the Council, deposit with the Village Clerk, Proof of the Public Liability Insurance here-
inafter required and a bond or cash in the sum of $100.00 conditioned that he will faithfully
and continuously provide the refuse collection service specified in his application as modified
by the Council, and under the conditions imposed by the ordinances of the Village.
Before any person is granted a license hereunder he shall file with the Village Clerk policies
of public liability and property damage which shall remain and be in force and effect during
the entire term of said license and which shall contain a provision that they shall not be can-
celled without 10 days written notice to the Village. Public .liability insurance shall not be
less than $100,000.00 for injuries, including accidental death to any one person, and, sub-
ject to the same limit for each person, in an amount of not less than $200,000.00 on account of
any one accident and property damage insurance in the amount of not less than $25,000.00
for each accident or mishap. Said policies of insurance shall further provide for indemnity
and security to the Village of Lakeville against any liability and!or responsibility for the acts,
actions, or omissions of the licensee, or of any of the agents or servants of such licensee sub-
ject, however, to the limitations as to amount herein stated. No work shall be done under
any license hereunder until said insurance policies shall have been filed and approved by the
Village Clerk.

SECTION XI. Collection truck. Each licensed garbage and/or rubbish collector shall provide
a covered tank or wagon, so constructed that the contents will not leak or spill therefrom, in
which all garbage and/or rubbish collected by him shall be conveyed to the place designated
in his application. The wagon or conveyance used shall be kept clean and as free from offen-
sive odors as possible, and shall not be allowed to stand in any street, alley, or public place
longer than is reasonably necessary to collect garbage and/or rubbish.
SECTION Xlf. Collection hours and discontinuance of service. No collections of garbage or
rubbish shall be made except between the hours of 7:00 A.M. and 6:00 P.M. The expense of
garbage and rubbish collection shall be paid to the collector by the owner, agent, occupant
or tenant of the premises from which such garbage and/or rubbish is collected, and such
fee shall be full compensation for his services of such collection. The collector may refuse to.
make collections from any premises when the fees are not paid within one month from the
date such garbage and/or rubbish is collected. The collector shall notify the Health Commit-
tee of the Village Council and the Clerk of the. discontinuance of service to any premises with-
in two days after service is discontinued.
SECTION XIII. Any persons violating any section of this Ordinance shall, upon conviction,
be fined not more than one hundred ($100.00 Dollars and in default of payment thereof, be
confined in the County Jail not more than thirty (30)' days.
SECTION XIV. All the ordinances and parts of ordinances in conflict herewith are hereby re-
pealed and revoked.
