HomeMy WebLinkAbout0031 J ORDINANCE NO. 31 VILLAGE OF LAKEVILLE Dakota County, Minnesota AN ORDINANCE REGULATING AND RESTRICTING THE PARKING OF VEHICLES ON THE STREETS OR IN PiJBLIG PLACES IN THE VILLAGE OF LAKEVILLE AND FROVIDE'S PEN- ALTIES FOR. VIOLATIONS THEREOF BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF LAKEVILLE, SECTION 1. DEFINITION For the purpose of this chapter, certain words and phrases are defined as follows: a. Vehicle Any device in, or upon, or by which any person or property is or may be transport- ed upon a public highway. b. Street Any public street, avenue, road, alley or highway located in the Village and estab- lished for the use of vehicles. c. Operator Includes every individual who shall operate a vehicle as the owner thereof, or as the agent, employee, or permittee of the owner or any individual who is in actual phy- sical control of a vehicle. d. Park or Parking The standing of a vehicle, whether occupied or not, upon a street, otherwise than temporarily for they purpose of, and. while actually engaged in, receiving or discharg- ing passengers. or loading or unloading merchandise, or in obedience to traffic reg- ulations, signs or signals or an involuntary stopping of the vehicle. by reason of causes beyond the control of the operator of the vehicle. SECTION 2. POWERS OF VILLAGE: COiJNCIL AND CHIEF OF POLICE The Village. Council is authorized to designate parking zones and restrict the length of time parking shall be permitted at any place within the Village, In establishing or changing park- ing zones or parking restrictions, the Council shall pass a resolution at a meeting adequately describing and defining said parking zones or parking restrictions. The Chief of Police is hereby authorized to forbid parking of all vehicles for temporary periods in case of emergency at any place within the Village. SECTION 3. DESIGNATION OF PARKING SPACES The Chief of Police is hereby authorized to mark off individual parking spaces. Parking spaces are to be designated by lines painted or durably marked on the curbing or surface of the street. At each space so marked off it shall be unlawful to park any vehicle in such a way that said vehicle shall not be entirely within the limits of the space so designated. SECTION 4. BACKING INTO CURB PROHIBITED In areas where angle. parking is permitted, no person shall park any vehicle in any man- ner other than so that the front of the vehicle faces the adjacent curb. SECTION 5. WINTER PARKING No owner of a motor vehicle shall leave, park or permit they same to stand on any Village street or alley for more than 48 hours during the period from November 1st through April 1st of each year. SECTION 6. PARKING AFTER SNOWFALL No owner of a motor vehicle shall leave, park or permit the same to stand on any street or alley for any period longer than 8 hours after a snowfall of such amount which necessi- tates the plowing and clearing of Village streets and alleys of snow by the Village.. SECTION 7. DRIVING NEAR FIRE VEHICLES AND FIRES No person shall come within 300 feet of fire apparatus going to a fire; immediately upon the approach of any fire apparatus or fire officers' cars sounding proper signals. and respond- ~1~, ing to an alarm all other vehicles shall draw as near as possible to the curb and remain stand- ing until such apparatus or vehicle shall have passed. No person shall drive a vehicle of any kind over fire hoses lying on a street whether same is in service at the time or not. No person except fire department members shall park a car within 300 feet. of a fire. SECTION 8. KEYS IN IGNITION No person shall leave a motor vehicle parked on the public streets in the Village of Lakeville with the key in the ignition.. No owner or operator of a used. car lot shall leave the key in the ignition of any automobile on said used car lot when attendant is not on duty. SECTION 9. TOWING AND STORAGE The Chief of Police is hereby authorized and empowered to have removed any vehicle on any street or alley in violation of Sections 5, 6, 7, and 8 or stalled thereon and to have such vehicle placed in a garage or outdoor area by any person engaged in the general garage or filling station business. Such.. vehicle shall not be removed therefrom until reasonable costs of storing and towing the same have been. fully paid. The Chief of Police shall have the further authority to direct employees of the Village to remove any such vehicle and to that event the Chief of Police may impose a charge to be paid to the Village Clerk before the said vehicle may be taken or recov- ered by the owner thereof. In the event that any vehicle held or stored by the direction of the Chief of Police upon which there are charges for storage or towing or both, shall not be reclaimed, recovered or taken by the owner thereof, there shall be deemed to be imposed upon such vehicle a pos- sessory lien in the amount so charged and. unpaid and should the owner thereof fail to pay the same then the possessory lien may be foreclosed in the manner provided. for by law. SECTION 10. PENALTY Any person violating any of the provisions of this ordinance shall, upon conviction, be puni~sOheaabs a fine not exceeding $100.00 or by imprisonment for a period not exceeding nine- Y ( ) Y SECTION 11. SEPARABILITY AND EFFECTIVE DATE It is the intention of the Village that +each separate provision of this ordinance shall be deemed independent of all other provisions herein, and it is further the intention of the Village Council that if any provision of this ordinance be declared invalid, all other provisions thereof shall remain in force and valid.
