HomeMy WebLinkAbout0033 tee' ORDINANCE N0.33 VILLAGE OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF A VOLUNTEER FIRE DE- PARTMENT FOR THE VILLAGE OF LAKEVILLE AND PROVIDING FOR RULES AND REGU- LATIONS FOR, THE GOVERNMENT OF THE SAME. THE VILLAGE COUNCIL OF THE VILLAGE OF LAKEVILLE ORDAINS AS FOLLOWS: SECTION I. Fire Department Established. There is hereby established in this village a volun- teer fire department consisting of a Chief, two Assistant Chiefs, a Fire Marshal, a Board of Di- rectors, and not less than 30 nor more than 35 firemen. SECTION II. Election of Chief, Board of Directors, and Assistant Chiefs and Appointment of Fire Marshal and Firemen. The Chief of the Fire Department shall be elected every three (3) years and two Assistant Chiefs and two Directors annually by the members of the department subject to confirmation by the Village Council. The annual election shall be on the last Mon- day of January at a time and place to be set by the Board of Directors. The Village Council shall appoint a Fire Marshall each year. The Chief of the Fire Department and Directors shall hold office for three (3)' years and Assistant Chiefs for one (1) year and until their successors have been duly elected or appointed; except that any of them may be removed by the fire depart- ment and the Village Council for cause after a public hearing. If a vacancy occurs in any of the above offices, an election shall be held at next regular meeting to fill vacancy. Firemen and probationary firemen shall be elected by the members of the Fire Department. Firemen shall continue as members of the department during good behavior, and may be removed for cause by the department subject to review by the Village Council. SECTION III. Duties of Fire Marshal. The office of Fire Marshal may be held by the Chief or by one of the Assistant Chiefs, if the Village Council by resolution approves. The Fire Marshal shall be charged with the enforcement of ordinances aimed at fire prevention.. He shall have full authority to inspect all premises and to cause the removal or abatement of all fire hazards. SECTION IV. Duties of Chief. The Chief shall have control and responsibility of all Fire Depart- ment functions and all fire fighting apparatus, and shall be solely responsible for its care and condition. He shall be responsible for the proper training and discipline of the members of the Fire Department, and may suspend any member far refusal or neglect to obey orders, pending final action by the department and the Village Council on his discharge or retention. He shall be a member of the Board of Directors of the Fire Department. He shall report each sus- pension by him of a member of the Fire Department as soon as possible to the Board of Direc- tors and to the Fire Department and Village Council at the first regular meeting occurring after such suspension. SECTION V. Duties of Board of Directors. The Board of Directors shall make recommenda- tions to the Village Council on such matters as it deems necessary relating to the operation and administration of the Fire Department, including but not limited to: a. Recommendations concerning members who have been suspended by the Chief. Such rec- . ommendations shall be made after the member has an opportunity to be heard, and shall be given to the Village Council at the next regular meeting after such suspension is consid- ered. b. Recommendations to the Village Council at its regular meeting the second Monday in August as to the condition of the equipment, future needs of the department, and an- nual budget of the department. SECTION VI. Records. The Chief shall keep in convenient form a complete record of all fires. Such record shall include the. time of the alarm, location of fire, cause of fire (if known), type of building, name of owner and tenant, purpose for which occupied, value of building and contents, members of the department responding to the alarm, and such other information as he may deem advisable or as may be required from time to time by the Village Council or state insurance department. SECTION VII. Practice Drills. It shall be the duty of the Chief, when the weather permits, to hold monthly practice drills of at least one hour's duration for the Fire Department and to give the firemen instruction in approved. methods of fire fighting and fire prevention. SECTION VIII. Assistant Chiefs. In the absence or disability of the Chief, the day or night As- sistant Chief, as the case may be, shall perform all the functions and exercise all of the au- thority of the Chief. SECTION IX. Firemen. The Assistant Chiefs and firemen shall be able bodied and not less than nineteen (19) nor more than sixty-five (65) years of age. They shall become members of the Fire Department only after a 12 month probationary period. The Village Council and Fire Depart- ment may require that each candidate, before he may become a probationary fireman, must satisfy certain minimum requirements of height, weight, education and any other qualifications which may be specified by the Village Council and Fire Department; and that must pass a satis- factory mental and physical examination. SECTION X. Benefits for Firemen. The Village Council shall provide for all firemen: a. Workmen's Compensation Insurance. b. Membership in the Voluntary Firemen's Benefit Association of Minnesota for each mem- ber of the department. Plus additional insurance benefits. c. Such additional insurance benefits as the Village Council shall deem proper. SECTION XL Rules and Regulations for the Administration of Fire Department. The Village Council shall from time to time by resolution prescribe rules and regulations for the adminis- tration of the Fire Department. The members of the department may, by a majority vote, add to or amend such rules and regulations subject to confucmation of the same by the Village Council. In the absence of a specific rule or regulation governing a situation, the Chief shall have authority to proceed as he deems best. SECTION XII. Present Members. Persons who are members of the Fire Department at the time of the adoption of this ordinance shall not be required to serve a probationary period before receiving firemen's rating. SECTION XIII. Relief Association. The members and officers of the Fire Department may or- ganize themselves into a Firemen's Relief Association. SECTION XIV. Interference with Department. It shall be unlawful for any ,person to give or make, or cause to be given or made, an alarm of fire without probable cause, or to neglect or refuse to obey any reasonable order of the Chief at a fire, or to interfere with the Fire. Depart- ment in the discharge of its. duties; and any person convicted of violating, this section shall be punished by a fine not exceeding $100.00 or by imprisonment for a period not exceeding 90 days. SECTION XV. Effective Date. This ordinance shall take effect upon its passage and publca- tion. Adopted this 28th day of May, 1968.
