AND REGULATING THE SALE OF INTOXICATING LIQUOR BY°CERTAIN CLUBS WITHLN THE VILLAGE OF LAKEVILLE AND ,PROVIDING FOR THE LICENSING OF SUNDAX LIQUOR SALES BY CLUBS. The Village Council of the 'Village of Lakeville, .Dakota County, Minnesotadoes ordain; SECTION I - All applicable .provisions of Minnesota Statutes 340.47. et secluentia relating to the issuance of club licenses, together with all regulations issued by the State Liquor Control. Commissioner,,. except as may bemodified by this Ordinance, including the con- struction of`.terrns and definitions are hereby approved and .adopted for the control and issuance of club licenses in the Village ©f Lakeville, SECTION II For the purpose ofthis Ordinance., a bona fide club shall d7 be defined as set forth in Minnesota Statutes Annotated 340.x., 15' Subdiv: ~',~`is hereby incorporated by reference. as if set forth herein, On-Sale defined.. The term °'on-sale°` means.: the sale` of liquor. by the glass for consumption on the premises only. SECTION III - The club license .granted pursuant to this Ordinance shall be for a periodnot to exceed on,e (1) year, and the fee therefor shall be $10D, In addition, a special license for the sale of liquor on Sunday as provided herein may_.be granted .`.for a period .not to .exceed one (Z) .year and the fee therefor shall be $200. All .licenses. granted hereunder.. hall expire on he iast:da~r of December in the .year of their issuance. • • SECTION IV Every club,_as herein defined, desiring a license from the. Vi lage Council shall, through their proper officers, file with the Village Clerk, a verified application setting forth all information necessary to show whether or not the said club qualified for such a license within the. meaning of this Ordinance, together with. all such .additional information as may be required by the. Village. Council. The .application shall be accompanied by the. annual..~cense fee.. , of $100. Also accompanying .the.. application shall be ~ ~ ~t e air e-, o fulfill the-requirements of Section°340.12, Minnesota Statutes Annotated, as amended, pertaining to w'S u t. "on-sale." dealers, which -boxrc~ shall be in such form as to be approved by the: Village Council. .SECTION V The Village Council shall cause an inves igation to be made of all .the representations set ...forth in the_applicaton, and an opportunity sha11 be given at a regular or special. meeting of the Council to any person desiring to be heard, for or against the granting of any licenses. After such. `investigation, the payment of thy: license fee and the filing ` =2'- • 1 ~ of the liability insurance policy as herein provided, the Village Council may grant or refuse such license within its' discretion. SECTION VI The terms and conditions of club licenses issued under this Ordinance shall be as follows: (a) The license shall be posted at all times in-a conspicuous place on the licensed premises. (b) The license shall nat be transferable- as to the premises without the approval of the Villaae Council. (c) The sale of`intoxcatng liquor under such license., is restricted to members. of the club Licensed. (d) The licensed premises shall be open to inspection by any police officer, health officer, or other properly designated officer or employee ofthe city at any time during which the club shall be open to its members for business. (e) The licensee shall strictly observe all of the :laws relative to "on-sale" of intoxicating liquor as set forth in ~~innesota Statutes 1945, as amended, together with all of the rules and regulations of the State Liquor Control.Gommissioner insofar as .they are applicable. - (f) The club licensee shall abide lav the general closing hours of the Village ?~unicpal Liquor Store except as gravided herein. (g) The liability insurance policy as required by this Ordinance shall be in fullforce and effect during the torm of any license granted hereunder; 3 • • - ~ SECTION VII Special 9unda~ License Special on-sale licenses far the-sale of intoxicating (rte- S u -~G~~4.J~ liquors may be issued to clubs as defined herein. All sales of liquors by such establishments sha11 be in accordance with M'.S.A, 340.14,'_ Subd. 5. Clubs having a special Sunday license may .serve ntoxi-` eating lquorbet~~een the hours of 12 o'clcack noon and 12 o'clock midnight on .Sunday. SECTION VIII Any license. granted hereunder-may be revoked by the Village Council for cause. Causes for revocaton'shall be viola tion bythe licensee, or its employees, or any provision or condition of this Ordinance. A license shall be deemed revoked upon the passage by the City Council of a'resolution to that effect and no portion. of the license fee paid shall be returned upon revocation. SECTION. IX All Ordinances or parts of Ordinances of this Village inconsistent herewith, are hereby repealed. No_provsion hereof shall effect the municipal liquor store or dispensary. SECTION X Any person violating any of the provisions of this Ordinance shall be guilty of a misdemeanor and upon. conviction thereof, be punished by a-fine of not more than Three. Hundred dollars ($300), or imprisonment in the County Jail for not more than ninety (90)_days, or both.
