RESOLUTION NO. 07-198
` RESOLUTION APPROVING CONVEYANCE OF
CITY-OWNED LAND FOR INCLUSION LN THE
FINAL PLAT OF KENT 46
WHEREAS, EFH Co., a Minnesota corporation, is proposing to final plat certain
land within the City of Lakeville to be known as KENT 46. Southcross Commerce Center I1,
L.L.P, a Minnesota limited liability partnership, and John E. Kozulla, as Trustee for the
John E. Kozulla Trusf Agreement dated January 8, 2003, are collectively the fee owners of
the land that is proposed to be final platted as KENT 46; and
WHEREAS, the proposed KENT 46 final plat includes a small portion of land owned
by the City, which land is legally described on the attached Exhibit "A'; and
WHEREAS, the City desires that the land described on the attached Exhibit "A" be
conveyed to Southcross Commerce Center II, L.L.P, a Minnesota limited liability
partnership, and John E. Kozulla, as Trustee for the John E. Kozulla Trust. Agreement
i dated January 8, 2003, for inclusion in the final plat. of KENT 46.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lakeville, Minnesota:
1. The City Council hereby approves the conveyance of the City-owned land
described on the attached Exhibit "A" to Southcross Commerce Center II,
L.L.P, a Minnesota limited liability partnership, and John E. Kozulla, as
Trustee for the John E. Kozulla Trust Agreement dated January 8, 2003, for
inclusion in the final plat of KENT 46.
2. The requirements of Minn. Stat. § 462.356, Subd. 2 are dispensed with the
Council finding that the .proposed disposal of .real property has no
relationship to the comprehensive municipal plan.
3. The Mayor and City Clerk- are authorized to execute the necessary
documentation to convey and transfer title to the City-owned land to
Southcross Commerce Center II, L.L.P, a Minnesota limited liability
partnership, and John E. Kozulla, as Trustee for the John E. Kozulla Trusfi
Agreement dated January 8, 2003, contingent upon the filing of the final plat.
