HomeMy WebLinkAbout02-27-89 . 6 { ~ ~ CITY OF LAKEVILLE .SPECIAL COUNCIL MEETING FEBRUARY 27, 1989 The meeting was called to order at 7:00 p.m. by Mayor Zaun. Roll call was taken. Present: Councilmembers Nelson, Enright, Sindt, Harvey, and Mayor Zaun. Also present: Keith Nelson, City Engineer; Patrick Farrell, .City Attorney; Patrick McGarvey, City Administrator/Clerk; Dave Everds, Dakota County Engineer; Dave Zech and Pete Sorenson, Engineers with Dakota County. The Mayor opened the public hearing on the proposed improvement of Cedar Avenue, Project 89-1, at 7:00 p.m. The City Clerk attested to the proper legal notices. Keith Nelson showed colored slides and presented the proposed design and location of the improvements to Cedar Avenue and the Dodd Road intersection in Lakeville. He also showed the proposed new design for the intersection of County Road 46 and Cedar Avenue. The Dakota County Engineer indicated that the right of way possession necessary to construct this project within should be accomplished by May 25, 1989. The County expects to begin in phases on the project during May 15th. and June 1, 1989. The City Engineer stated that the estimated City share of the. project cost is $1,087,850.00. The City proposes to assess $759,916.00 and pay the remaining $327,933.00 from funds on hand . The City proposes to assess the residential urban area at $49.46 per front foot and the commercial urban at $74.19 per front foot. Portions of the project where there is a rural design cross section of highway, the residential front foot rate would be $33.46. The engineers also presented the phasing and schedule of the project and detour routes proposed to be used during the project. At this time, Mayor Zaun opened the hearing for questions and comments. t ~ ~ t CITY OF LAKEVILLE SPECIAL COUNCIL MEETING FEBRUARY 27, 1989 Mr. Al Herrmann, representing the Shady Oak Shores subdivision which is being developed on the west side of Cedar Avenue,. addressed the Council and made a presentation on changes he felt should be made in the proposed scheduling of the improvements and the detour routes and he also presented to the Council a written analysis done on how he felt the project should be scheduled and the detour handled in 1989 and 1990. 89.90. Motion was made by Harvey, seconded by Sindt to receive the written comments and report from Mr. Herrmann. Roll call was taken on the motion. Ayes, Nelson, Zaun, Enright,. Sindt, Harvey. Diana Culhand asked if there would be more than one .intersection in Lakeville with traffic signals when the project is completed. The County Engineer indicated that at the present time, only the intersection at 160th Street would be signalized. Plans include three more signalized intersections further south as the traffic warrants it in the future. Mr. James Bombardo raised concerns about the lack of left turn lane movements onto Cedar Avenue at 161st Street and eventually onto 160th Street and Glenwood Avenue when that is ultimately improved in the future. He indicated that the commercial center at the southeast corner of Cedar and 160th Street, would then be .limited to right in and right out access only once l$Oth Street is fully improved. He argued that the intersection at Cedar and 161st Street should be allowed to have left. turn movements. Pete Sorenson indicated, on behalf of the County, that the design of the intersection at-160th Street and Cedar is critical and that in order to accommodate the traffic volumes and movements there it would be very difficult to accommodate left turn traffic movement on Cedar into 161st Street due to its .closeness to 160th Street Mr. Mike Hienzerling asked about the potential conditions on the north end of Highview Avenue for dust control due to the increased traffic the detour would cause. The City .Engineer, Keith Nelson, indicated that the staff felt most of the people .would prefer to travel south on Highview Avenue where the road is improved with asphalt and make their temporary travel plans to the north using Dodd Road and 185th Street to I35W for commuting. Mr. Del Carter asked how much traffic there is expected to be on the 172nd Street detour to Highview Avenue and then to 160th Street or Dodd Road. 2 t CITY OF LAKEVILLE SPECIAL COUNCIL MEETING FEBRUARY 27, 1989 The Council members then suggested that there needs to be ample time taken to analyze the proposed schedule and detour before the County staff responds the concerns raised by Mr. Herrmann .and others in attendance at the public hearing.. Mr. Everds indicated that the County would need to receive City Council approval of the project plans by March 6th if the` project is to proceed ahead on the schedule that is being proposed and that the County will also need the City to approve two cooperative agreements for the project. 88.91 Motion was made Sindt, seconded by Harvey to continue the public hearing to the March 6, 1989, regular Council meeting and table approval of the project plans and cooperative agreements until that time. Roll call was taken on the motion. Ayes, Zaun, Enright, Sindt, Harvey, Nelson. At this time, Mayor Zaun opened the public hearing on the proposed improvement of Flagstaff Avenue, Project 88-19, at 8:40 p.m. The .City Clerk attested to the legal notice. The City Engineer presented slides showing the road cross sections considered for making of .the improvement. He indicated that it was the Engineering Department's recommendation that the Council approve an urban section with concrete curb and gutter and a 38 foot wide road. The total estimated project cost for -these two segments of the road for an urban section is estimated to be $579,800.00. Mr. Nelson then presented a slide showing the participation in the project with funds coming from Dakota County, Minnesota State Aid Gas Tax monies, escrow by developers who owned and developed. property along Flagstaff in the past, property assessments, the City's Multi-Purpose Pedestrian Trail Fund, and trunk water and storm sewer funds of the City. The estimated urban assessment rate for the residential property is $38.00 per front foot plus an additional $3.71 for a portion of the multi-purpose trailway for a total assessment of $41.71 per foot. At this time, Councilmember Enright had to leave the meeting. Time: 9:00 p.m. Mr. Nelson indicated that the project could be substantially constructed in 1989 and would be completed in 1990 with the assessment hearing scheduled for the Fall of 1990. 3 i CITY OF LAKEVILLE SPECIAL COUNCIL MEETING FEBRUARY 27, 1989 The City Administrator indicated that the Council"usually assessed these type of improvements for a period of up to 20 years and the estimated rate of interest at this time would be 9.5 percent on the unpaid principle. At this time, Mayor Zaun opened the public hearing for questions and comments. A person asked which parcels of property have prepaid their assessments on Flagstaff Avenue. The City Engineer indicated that the developer of the Dodd Park and Dodd Ridge .subdivisions had each paid the estimated cost of the road improvement and the money had been invested by the City until the time it is needed for making payments for the construction of the road. Another resident asked if there was no concrete curb and gutter put in now, where the costs would come to pay for it in the '.future. The Engineer indicated that that cost would then be assessed in the future if it was not constructed in 1989. Dale Harris questioned the $38.00 per front foot rate and how it was arrived at. The Engineer explained that $38.00 is the typical rate in the City of Lakeville for a 32 foot wide, 7 ton concrete .curb .and gutter style. street being constructed in a residential area in 1989. Since this street is a 9 ton design with extra thickness in the asphalt and gravel base and in the width, the additional cost is picked up through State, County and City funds. Discussion occurred on the need to possibly extend the trail on the west side of Flagstaff Avenue .further south to connect the Dodd Ridge and Dodd Park areas. Councilman Nelson indicated that the staff and Park and Recreation Committee should look into the possibility of extending that .trail further south, determine the cost and how it .should be paid for. The Attorney indicated that there may be a need to call an additional hearing if the trail is extended further south and the Council wishes to .assess any of the costs. 88.92 Motion was made by Harvey, seconded by .Nelson to close the public hearing. Roll call was taken on the motion. Ayes, Sindt, Harvey, Nelson,. Zaun. Time: 9:16 p.m. 88.93 Motion was made by Harvey, seconded by Sindt to adopt Resolution 89-29 ordering the Flagstaff Avenue Improvement Project 88-19, and authorizing Donohue and Associates to prepare plans and specifications for the project using Alternate A for Segment 4 + • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING FEBRUARY 27, 1989. No. 2, and to direct the Park and Recreation Committee to review and make a recommendation on extending the trail further south on the west side of Flagstaff Avenue, and to include into the project the proposed water trunk main extension, which was recommended by the City Engineer. Roll call was taken on the .motion. Ayes, Harvey, Nelson, Zaun, Sindt. At this time, Mayor Zaun opened the public hearing on the proposed extension and improvement of Howland Avenue, north of .208th Street to Upper 208th Street, Project 89-3. The City Clerk attested to the legal notice. Mr. Keith Nelson presented project slides showing the interim and future storm sewer system construction that needs to be made in this part of the downtown area of Lakeville to accommodate this project now and the future demands on the storm sewer system in this area of the City. Mr. Nelson also presented a drawing showing where the proposed improvements are to be made for Project 89-3. The total estimated project cost is $229,715.00. Mr. Nelson indicated that the Tonsager property is proposed to be assessed for the concrete :sidewalk and the concrete curb and gutter at an estimated cost of $2,372.00. Mr. Tonsager was present and questioned who is to pay for the relocation of 208th Street west of Howland Avenue. .The City Administrator indicated that the Dakota County HRA would be assessed the cost for the relocate of 208th Street. A representative from the Dakota County HRA office was present and indicated that. they understood all of the. costs associated with this improvement project for the property owned by the Dakota County HRA and they were in complete support for the project. 88.94 Motion was made by Harvey, seconded by Nelson to close the public hearing. Roll call was taken on the motion.
