HomeMy WebLinkAbout07-11-88 ~ • • • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING JULY 11, 1988 The meeting was called to order at 7:00 p.m. by Mayor Zaun at the City Hall. Roll call was taken. Present: Councilmembers Harvey, Nelson, Sindt and Mayor Zaun. Absent: Councilmember Enright. Also present: Dennis Feller, Finance Director; Bruce Robertson, Administrative Assistant; Patrick McGarvey, City Administrator/Clerk; and Darrell Schneider, Consulting City Engineer. The City Administrator advised the council that bids had been received on July 7th for the downtown park plaza and parking lot project and the replacement of two blocks of concrete curb and gutter and sidewalk along Holyoke Avenue between Upper 206th Street and 205th Street. Due to a problem in acquiring a clear title to the Winsor Grain property, the closing on the purchase of Winsor Grain property by the Dakota County H.R.A. has been delayed, and the seller has been claiming that the closing of 208th Street between Holyoke Avenue and Howland Avenue would also be delayed until after the County closes on the purchase of the Winsor Grain property, The administrator recommended that the Council award only a part of the contract to Rocon Construction for the work on the curb and gutter and sidewalk replacement on Holyoke Avenue at this time pending the outcome of the possible purchase of the Winsor Grain property by the Dakota County H.R.A. It was pointed out that the contractor was the low bidder on the curb and gutter/sidewalk part of the contract, and with the addition of $3,500 for the mobilization which was included as a part of the costs for the park plaza, Rocon would still be the low bidder in the amount of $48,103.05. The administrator suggested that if the County cannot resolve the purchase settlement with Mr. Cook so that the City can close 208th Street soon and construct the Park-Plaza and parking lot, considera- tion be given to not closing 208th Street between Holyoke and Howland Avenue and not purchasing the Winsor Grain property. He also suggested that redevelopment of the area east of Holyoke between Enggren's and 209th Street be considered. 88.295 Motion was made by Harvey, seconded by Sindt to receive the bids and award the contract to the low bidder, Rocon Construction, in the amount of $48,103.05 for the Holyoke Avenue part of the work, and table award of the rest of the contract pending the outcome of the possible purchase of the Winsor Grain property by the Dakota County H.R.A. Roll call was taken on the motion. Ayes, Harvey, Nelson, Zaun, Sindt. i • • The City Administrator advised the Council that another written offer had been received from John B. Enggren for the purchase of the on-sale liquor store building and property. The offer is for $500,000, with $100,000 to be paid down at the closing. The offer also included a condition that the City pay the remaining $22,165 in special assessments on the property and pay any property taxes that may be due in 1989. The Council discussed the offer, and the consensus was that a larger down payment would be necessary from the City's viewpoint. Council- man Nelson also indicated that $150,000 down payment should be the minimum down payment the City would accept if the City is to assume the pay off of the $22,165 special assessments. The City Adminis- trator pointed out that by waiting to close on the sale until after October 1, 1988, there would be no property taxes due in 1989 to either party. 88.296 Motion was made by Sindt, seconded by Harvey to authorize a counter offer at a $500,000 sale price with $150,000 down payment and then the City would pay the $22,165 in special assessments, with the closing to be after October 1, 1988. The Council discussed the motion and decided that the appropriate motion would be to direct the staff to continue negotiations. 88.297 Motion was made by Sindt, seconded by Harvey to withdraw the above motion. Roll call was taken on the motion, Ayes, Zaun, Sindt, Harvey, Nelson. 88.298 Motion was made by Sindt, seconded by Harvey to authorize the city staff to continue negotiations with Mr. Enggren and to reach a mutually satisfactory purchase agreement along the terms as discussed by the Council, to be given further consideration for approval by the Council at the July 18, 1988, Council meeting. Roll call was taken on the motion. Ayes, Sindt, Harvey, Nelson, Zaun. The City Administrator presented an agreement from the City Attor- ney's office and recommended approval of it between the City and Minnegasco for the relocation of a high pressure gas line, which is necessary due to the 185th Street extension and improvement project. 88.299 Motion was made by Harvey, seconded by Nelson to approve the agree- ment with Minnegasco for the relocation of a gas line on 185th Street extension project, and authorize the mayor and clerk to execute it. Roll call was taken on the motion. Ayes, Harvey, Nelson, Zaun, Sindt. 2 i . , . . At this time, Councilmember Sindt asked about the status of the disciplinary action being taken against Greg Grose. The City Administrator advised the Council that the examiner was set to begin the hearing on July 22nd, and that the report would probably not be before the City Council until the month of September. 88.300 Motion was made by Sindt, seconded by Harvey to suspend Officer Greg Grose with pay. The Council discussed the motion, and Councilman Nelson indicated he did not believe it was reasonable for the City to pay someone to stay home under these circumstances. Councilmembers Sindt and Harvey then withdrew the motion and asked that he matter be placed on the July 18th agenda for further consid- eration. $8.301 Motion was made by Harvey, seconded by Nelson to receive the bids on the tennis courts and reject them and authorize the readvertisement of bids as recommended by the Park & Rec. Director. Roll call was taken on the motion. Ayes, Harvey, Nelson, Zaun, Sindt. 88.302 Motion was made by Nelson, seconded by Harvey to adjourn the special council meeting.
