Present: Covncii Members Bellows, Swecker, Wulff and Mayor Dahl, Absent: Council Member Rieb. Also present: R. Knutson, City Attorney; B. Anderson, Assistant to City Administrator; T. Vonhof, Police Chief; K. Nelson, City Engineer; D. Olson, Community & Economic Development Director; D. Feller, Finance Director; S. Michaud, Parks & Recreation Director; D. Morey, Planning Director; C. Friedges, City Clerk. Additional agenda information -Council Members moved Item 7 to the consent agenda. Presentations/Introductions Steve Michaud presented the April monthly report of the Parks 8~ Recreation Department. Chief Vonhof presented the March/April Police Department monthly report. Citizens' Comments -None Consent Agenda - Mr. Anderson .highlighted items k, I and m. 08.53 Motion was made and seconded to approve the consent agenda items as follows: a. Claims for payment. b. Minutes of the May 5, 2008 City Council meeting. c. Receive minutes of the May 1, 2008 Planning Commission meeting. d. Agreement with. Agreement with Champion Coatings, Inc. for the reconditioning of fire hydrants. f. Resolution No. 08-75 receiving bids and awarding contract for the reroofing of Fire Station # 1 and the Public Works storage facility. g. Receive application of Blazin Wings, Inc. for anon-sale and Sunday liquor license at Buffalo Wild Wings Grill & Bar, and call a public hearing to be held on June 16, 2008. h. Summary of Ordinance No. 838, an ordinance concerning best practices and the revocation or suspension of licenses for the sale of intoxicating liquor or 3.2 percent malt liquor. i. Renewal of tree service operator license for Tree Masters. j. Ordinance No. 839 amending Title 10 of the Lakeville City Code related to park dedication requirements for senior housing developments.. k. Grant and Development Agreement with the Dakota County Community Development Agency for Market Park Plaza project. Receive final draft of the 2008 City of Lakeville Transit Plan m. Joint Powers Agreement with Dakota County for construction of a trail crossing on CSAH 9 (Dodd Boulevard) south of 207th Street, Improvement Project 07-07. 7. Receive the Planning Commission's Findings of Fact and Recommendation and approve a conditional use permit amendment to allow the construction of an additional softball field at Lakeville North High. School, 19600 Ipava Avenue. Roll call was taken on the motion. Ayes, unanimous. Item 8 -Primrose of Lakeville Steve Schwartz, representing Primrose School of Lakeville, requested Council approval of the preliminary and final plat of one commercial lot to be known as Primrose of Lakeville, a conditional use permit fora CITY OF LAKEVILLE COUNCIL MEETING MAY 19, 2008 Page 3 daycare facility and the vacation of a public drainage and utility easement. Planning Director Daryl Morey presented the planning report for Primrose of Lakeville, which is proposed to be located- south of 162nd Street and west of Ipava Avenue. The development includes the construction of an 1 1,000 square foot day care facility with an outdoor play area. It is the last lot to develop in the Ipava Maretplace and Lakeview Bank. commercial area. The Planning Commission held a public hearing and unanimously recommended approval subject to 15 stipulations as listed in the April 11, 2008 planning report. Staff recommendsapproval 08.54 Motion was made and seconded to receive the Planning Commission's Findings of Fact and Recommendation and approve the following: - Resolution No. 08-76 approving the preliminary and final plat of Primrose of Lakeville; - Conditional use permit for a daycare facility on Lot 1, Block 1, Primrose of Lakeville; - Resolution No. 08-77 vacating a public drainage and utility easement. Roll call was taken on the motion. Ayes, unanimous.
