MARCH 2, 2009
Mayor Dahl called the meeting to order at 7:00 p.m. The pledge of
allegiance to the flag was given.

Mr. Mielke provided a resolution for consideration under New Business.
Presentations/Introductions
Chief Scott Nelson and Assistant Chief Mike Meyer presented the Fire
Department 2008 Annual Report.
David Olson presented the 2008 Annual Report of the Economic
Development Department.
Chris Petree presented the February monthly report of the Operations &
Maintenance Department.

Consent Agenda
09.16 Motion was made by Bellows, seconded by Wulff to approve the consent
agenda items as follows:

c. Final acceptance of public utilities in First Park Lakeville and First

d. Mechanical amusement device license for A.N.D. Vending at
Teresa's Mexican Restaurant.
e. Resolution No. 09-14 calling a public hearing on the certification of
delinquent utility accounts.
f. Agreement with South Forty Archery Club for the use of Ritter Farm
Park archery range.
g. Amendment to rental rates in the Lakeville Area Arts Center. Use

n. Resolution No. 09-15 approving plans and specifications and setting
bid date for miscellaneous roadway repairs, District 1 pavement
management, Improvement Project 09-01.
o. Sanitary sewer maintenance policy.
p. Labor agreement between City of Lakeville and Law Enforcement
Labor Services, Inc., Local No. 129, for 2009-2010.

Roll call was taken on the motion. Ayes, unanimous.
New Business -
Mr. Mielke presented a resolution requesting the Federal government to
take action to stop the ability of rail companies. to store rail cars in
urbanized residential neighborhoods without the consent of the City. He
explained that there are a significant number of cars being stored along
the rail line in Lakeville. Progressive Rail is storing these cars, which are
currently not being used. A large number of these rail cars are being
stored in residential areas. The residents are upset and have asked the
City to do something about it. Mr. Mielke explained .that storage of cars
on an active- rail line. is allowed by the Federal Rail Administration, and the
City has limited ability to regulate such use. Therefore, a resolution has
been drafted asking the Federal government to take action to stop the
ability of rail companies to store rail cars in urbanized residential
neighborhoods without the express written consent of the City.
09.17 .Motion was made by Swecker, seconded by Rieb to approve Resolution
No. 09-16 requesting Federal action to limit the storage of rail cars in, or
adjacent to, urbanized residential areas.
Roll call was taken on the motion. Ayes, unanimous.
