MEETING August 17, 1981 The meeting was called to order at 7`s 3a p.m, by Mayor Lekson. .The pledge of allegiance to the flag was .given. { Roll call was taken. Present: Councilmembers Spande, Zaun, Sndt, Nelson and Mayor Lekson. Also presents Roger Knutson, City Attorney; Frank Kriz, Consulting City Engineer; Patrick'McGarvey, City Administrator/Clerk. 81.392 Motion was made by Spande, seconded by Nelson to approve the minutes of ;the August 3;:.1981 council meeting. Roll call was taken on the, motion. Ayes,,Spande, Lekson, Zaun, Sndt & Nelson. 81.393 Motion was made by Nelson, seconded. by Zaun to approve .the claims for payment as presented. Roll call was taken on the motion. Ayes,:-Lekson, Zaun, Sindt, Nelson & Spandex Staff xeports: The City Administrator .presented aletter from Roger Brown asking. approval to hold an MGA Funkana in the liquor store parking, lot on .August 23rd.> 81.394 Motion was made by Zaun, seconded by;;Sindt to approve the request to hold the MGA Funkana in-the municipal liquor store parking lot on August 23 1981. Roll call was taken on the motion. Ayes, Zaun, Sindt, Nelson, Spande & Lekson. At this time Mayor Lekson and Councilmember Zaun presented a plaque to Jerry_Spande in appreciation for his almost i1 years of service to the- City of Lakeville on the Water and. Sewer Committee, Planning Commission and City Council. Mr`.,Spande thanked the council, staff and citizens for the opportunity t9 serve the citizens of Lakeville. 81.395 Motion was made by Zaun, seconded by Nelson. to receive the minutes`of the Natural Resource Committee, Park & Recreation Committee and: Planning Commission meetings. Roll call was taken on the motion. Ayes, Sindt, Nelson, Spande, Lekson & Zaun. ,81.396 Motion was made by Zaun,`seconded by Sindt to approve the site plan far a 28 unit addition. to the Acorn Motel as recommended by the Planning Commission and approvea minor variance for the setback of the existing unit from the right-of-way public street. Roll call was taken on the motion. Ayes, Nelson, Spande, Lekson, Zaun & Sindt. At this time Mr. William Sando, Representative from the"Metropolitan Council, District No. 16, and .James Barton, staff memberwith..the Metro.Council, addressed: the City `Council. concerning the disputed issues between the City and the Metro Council on the Cty.'s Comprehensive Plam. Mayor. Lekson first explained. that the council .was .upset over the denial of a recommendation to the Minnesota P.C.A. for the issuance of a permit. to allow William Johnson to put. in the remaining. part of the sanitary sewer system for Niakwa Village 2nd Addition. .The mayor explained that the method•in which. the Metropolitan Council was dealing with the .City did'not enhance the trust-and cooperation between-the two bodies. Mr. Barton'explaned that they wish to propose:." o the City Council for ..consideration a compromise where the City would designate a 900 to 1000 .acre 1990 Urbam Service Area on a map'at thin time and then-hold in reserve an `additional 900 to 1000 acres for development between now and 1990, Mr: Barton explained that the other issue involving the allocation of sewer flow to the City of Lakeville is being addressed in the. amended -1- • • CITY OF LAKEVILLE COUNCIL MEETING August 17, 1981 208. water Quality Plan now: going through council consideration and approval process, and. that by 1984-a decision would have to be made if the-Metro- politan agencies were to have the Empire plant expanded by 1989 as the cities which it serves are. requesting. Mr. Barton explained that the pity would be requested to accept 1,85 MGD. as the 1990 flow at this time with, the, petition already submitted requesting .the Metro Council to consider raising the .1990 flow to 2.22 MGD. The City Administrator explained the process which the City by law must :.follow. to address the issue of sewer:.flow and stated that. the process was now underway. in attempt to get the. City°s figure of 2.22 accepted by` the Metropolitan agencies within the near future. Mr. Barton, Mr. Sando and ;members of the Lakeville council discussed the reasons and aced for improved trust and cooperation between the two bodies. At the conclusion of the discussion, the City Council indicated that the City staff would. review ;the position presented by Mx. Barton and Mr. Sando at the council meeting concerning the 1990 Urban Service Area and how development policies would'be administered ,during the next-decade for the 1990 Urban Service Area within the larger. year 2000 Urban Service Area of Lakeville.. At this time the City Council took up consideration for adoption of the. proposed Lake Area Redevelopment Plan for properties adjacent to and nearby Orchard Lake and Lake.. Marion. Mayor Lekson explained that the plan was a guide for the City :and 'property owners 'to have in the event the property owners wish to replat and develop; some of the substandard platted areas near .these two lake's. Mr. Hank Lau was present-and questioned whether the,.Gity was proposing condominiums on the Sea.Girt Inn prope~'ty along 168th Street. The mayor. explained that: the .City was not proposing condominiums but was merely attempting to work out how'the property might be redeveloped in the future. if the property owners wish to?do so: Mr. Larry Bekken was present and. raised; several questions concerning the contents of the. plan on pages 67, 6~, 72 and 85'". .The mayor explained that ` the plat.. was intended to bn flexible, and that if there were corrections that needed to be made sn it in the future he 'was sure the council. would: do so. 81.397 Motion was made by Zaun, seconded by;Spande to adopt Resolution No.'81-53 approving and adopting the. Lake Area Redevelopment Plan. Ro11 call was taken on the emotion. Ayes, Spande, Lekson, Zaun, Sindt & Nelson. At this time Carol Schultz, Executive Director`of the Dakota County Housing and Redevelopment Authority, was present to present the-cooperative,,agree- meat between the City and the Dakota, County HRA in an effort 'to achieve 50 units. of elderly subsidized housing and. 24 units of moderate subsidized housing in Lakeville for the period of `1982 through 1984. The council discussed the agreement, and the City, Attorney recommended some changes to give the City .additional control over potential future housing projects which Ms. Schultz indicated she thought ..would be satisfactory to the Dakota County H.R.A. Board and HUD. The City Administrator. read the proposedchanges in the.. agreement for the -council, :.81.398 Motion was made by Zaun,.seconded by Sndt to'az~prove a cooperative agreement with the Dakota. County .Housing and Redevelopment Authority with .the changes as outlined-by ..the City Attorney.. Roll,call was taken on the motion. .Ayes, Lekson, Zaun,;Si:ndt, Nelson & Spande. At this time. the City Council interviewed Mr: Thomas-Anderson::.for-consideration. of appointment to the Youth. Ayes, Zaun, Sindt, Nelson, Spande & Lekson. 81.400 Motion was''made by Spande, seconded by Sindt to approve the development .agreement with ..Dominion-Development Corporation for the..Valley.Park 8th ,..phase 3 improvements and approve-the engineering plans and specifications and authorizing taking of bids on the project. Ftdll call was taken on the motion. Ayes, Sindt, Nelson, Spande, Lekson &'Zaun. 81.401 Motion.: was made.. by Nelson', seconded by Zaun to .approve change order No. 3 with Northdale Construction .Company in-the amount of $16,785 for the improve- menu of Laredo path in :.the Wildwood Ponds Addition, as. recommended by he City Engineer. Roll. call was taken on the motion. Ayes, Nelson,,Spande, Lekson, Zaun & Sindt. At this.aime~the'City Administrator presented a report showing changes in the labor contract between the City and Teamsters Local 320 for the mainten- ance positions in the street, park and utility departments. for the years 1982 and 83. The administrator stated that the changes being presented had been reviewed with the Personnel Committee of the City Council and had been presented bythe union to the membership. The union. had voted in favor of the proposed contract for 1982 and 83. 51.402 Motion was made by Nelson, seconded by Sindt to approve the proposed contract between the City of_Lakeville and Teamsters Local 320 for .the years-1982 and 83 for the street, park and: utility maintenance departments'as recom- mended, and authorzethe.mayor and clerk to execute the contract. Ro11 call. was taken. on the motion. Ayes, Spande, Lekson, Zaun, Sindt & Nelson. The City Administrator reported to the council-that the. fire station work might be completed enough to allow .the city .fire trucks to move: into the facility by August 31, 1981, but that there was a problem receiving the overhead doors and that the weather was holding up the installation of the roof support joists. In the event that the building would not be secured enough to allow: the department to keep the trucks in it after-August 31, 1981, steps were being taken to secure temporary quarters in the downtown area. of Lakeville. in a private owned building or to place the trucks in the City maintenance building. in Airlake Park. This was .being done so that the City could close on the sale of the City Hall-Fire Station building and property to Despatch Industries on .August 31, 1981. He indicated there should be no problem in maintaining the same fire protection :level of serviceduring the interim period. At this time the City Counci.Z discussed th{e filling of the vacancy on the Cty_Council caused by Mr. Spande's resignation. Councilmembers indicated that. theyfelt a special meeting shpuld be set to interview perspective candidates .who have applied. for appointment to the position for .the remainder of Mr. Spande~'s term, which would. expire the first :day. of 1982, 81.403 Motion was made by Lekson, seconded by Sindt to set a special council meeting for August 24; 1981 at 7x30 p.m. to interview candidates for. appointment to the vacancy on the.City Council and set a deadline of 4 p.m,. on August 21, 1981 for ,applying for the=position,. and indicating that the City Council wou7.d make their .choice on the appointment at the special:`council meeting on ,August 24, .198E -Roll .call was taken on the motion. At this time'the City Administrator explained that a request had been made by property owners of the 10 acre parcel. where the Hec Fu2zy establishment is now located for the extension of sanitary sewer and water to serve that -3- i • • CITY OF LAKEVILLE COTJI~CiL MEETING August 17, 19$1 site so that a-new Ramada Inn motel could be built on the same. site. The administrator explained that the council had authorized preparation of a preliminary report earlier"for the extension of sanitary sewer and water westerly along County Road 64`to 204th Street to serve a parcel of-.property on the west side of.I-35. die farther explained that that report needed to be updated if the. council wished 'to have a report on service to the Ramada Inn' site.-. .The City';Administrator >expla:ned that the extension of sanitary. sewer.. and 'water from 204th, Street would require the assessment. of several large. parcels of property that would receive benefit from the improvements, and that. some of 'the property owners had indicated support for the improvement and a few had indicated they did not wish to have them at this time. The administrator recommended the council :authorize the Gity's consulting engineering firm to :prepare a.,prelimnary engineering .report on the extension of sanitary sewer ,and water 'from .204th Street at County: Road 64 to serve the Ramada Inn property on the east side of'Kenrick Avenue and the nearby:: area. 81.404 Motion was made' by Zaun, seconded by Spande`to authorize the City Engineer to prepare ;a preliminary report on the extension of sanitary sewer and- water from County.R©ad 64 on 204th Street westerly to serve the property between County'Ro:ad 70 and 64 `east of Kenrick .Avenue and.-along :County Road 64 from 204th Street to the west side of I-35. RO11 call was taken:, on the motion. Ayes, Zaun, Sindt; Nelson, Spande & Lekson. At this ime some citizens. were present to request City Council support in an effort to~eliminate the proposed sludge-ash .site. proposed for Lakeville/ Farmington along Cedar .Avenue in the vicinity of 190th Street. Roger.Knutson explained to the council and those present how to rezone the property from.R-A to A-P and that an agreement .would. be executed between, the property owner and the City once a rezoning was accomplished under the agriculture preserves state law. The council indicated that they would support the residents in their effort to have the site eliminated from consideration for a.sludge-ash„location for the Metropolitan Waste Control Commission. The City..: Attorney recommended approval of an easement in-.the payment of ..$1,000 to. William Tzenis. ..81.405 Motion was made by Lekson, seconded by Nelson to approve an easement and authorize the payment of $1,000 to William Tzenis as recommended by the City Attorney on project number 80-6, Lake Villa Golf Es ates. My business takes me out of the state of Minnesota. In the 41 years that I have served the citizens of. Lakeville, it has been a privilege for me. Working with you has made the job enjoyable. I have gained a lot knowledge which has made me abetter person. I wish to .thank all of you for your support and help through the years. I shall always call Lakeville my home.
