CITY OF LAKEVILLE COUNCIL MEETING
September 2, 1980
The meeting was called to order at 7:30 p.m, by Mayor Lekson. The pledge
of allegiance to the flag was given.
Roll call was taken. Present: Councilmembers Spande, Lekson, Zaun, Sindt
and Nelson.
Also. present.: Darrell Schneider and Frank Kriz, Consulting City Engineers;
Roger Knutson, City Attorney; Dennis Feller, Finance Director; James
Robinette, Public Works Director.
80.404 Motion was made by Spande, seconded by Nelson to approve the minutes of
the August 18, 1980 council meeting.
Roll call was taken on the motion. Ayes, Lekson, Zaun, Sindt, Nelson & Spande.
80.405 Motion was made by Nelson, seconded by Zaun to approve the claims for
payment as presented.
Roll call was taken on the motion. Ayes, Zaun, Sindt, Nelson, Spande & Lekson.
` 80.406 Motion was made by Zaun, seconded by Nelson to receive the minutes of the
August 20 Parke& Recreation Committee meeting and the August 21 Planning
Commission meeting.
Roll call was taken on the motion. Ayes, Sindt, Nelson, Spande, Lekson & Zaun.
Mr. Richard Whittier presented his concerns about the conditional use permit
for the garage at 20520 Hughes Avenue West.
80.407 Motion was made by Zaun, seconded by Spande to approve the conditional
use permit for Dr. Joseph Emond at 20520. Hughes Avenue which would. provide
over 1,000 square feet of total garage space.
Roll call was taken on the motion. Ayes, Nelson, Spande, Lekson, Zaun & Sindt.
80.408 Motion was made by Nelson, seconded by Spande to approve alternative
"C", exhibit E as an acceptable plat for Lakeview Heights in order to
allow an area wide enough along 185th Street to allow for greater safety,
traffic flow and control features on 185th Street and to accept such a
plat without .park land dedication in consideration of the size of lots.
Roll call was taken on the motion. Ayes, Spande, Lekson, Sindt & Nelson.
Nays, Zaun.
Mr. Zaun stated that the reason he voted against it was because he wanted
to propose alter~aative "A" as'recommended by the Planning .Consultant.
.The council instructed the City Attorney to prepare findings of facts
and conclusions for the denial of the plat as proposed by the developer
and for the approval of alternative`"C" based upon the Planning. Consult-
ant's reports and. the council"s discussion.
Dorothy Gannon was present. to express her concern on the application for
rezoning on Lots 1, 2, 3_and the south 20 feet of Lot 4, Block 2, of
Fairfield Addition.
80.409 Motion.. was made by Zaun ,'seconded by Nelson to follow the recommendation
of the Planning Commission to adopt Ordinance No. 170, an ordinance rezoning
Lots 1, .2, 3 and the south 20-feet of-,Lot 4, Block 2, Fairfield Addition
from B-4 to CBD-C.
Roll call was taken on the motion. Ayes, Lekson, Zaun, Sindt, Nelson & Spande.
.80.410 Motion was made by Nelson, seconded by 5indt to approve the conditional use
permit for Mike Gannon contingent upon the four conditions as recommended
by the City Planner and the planting of vines next to the fence in order
to eliminate the problems of being able to see through the fence.

Mr. David Shaye made a pYesentation for the proposed site plan for Car
Quest (G_T.C.)
80.411 Motion was made by Zaun, seconded by Nelson to grant approval of the site
plan for Car Quest at the corner of 215th Street and Granada Ave.
Roll call was taken on the motion. Ayes, Sindt, Nelson, Spande, Lekson.& Zaun.
80.412 Motion was made. by Zaun, seconded by Spande to table consideration of
awarding bids on the Juneau Trail bridge project.,

.80.413 Motion was made by Zaun, seconded by Nelson to approve resolutions 80-84
thru 80-91 setting the assessment hearings for September 30, 1980 at the
High School.
Roll call was taken on the motion. Ayes, Spande, Lekson, Zaun, Sindt & Nelson.
Judy Lange was present and presented her concerns for a library in Lakeville.
80.414 Motion was made by Zaun, seconded by Sindt to appoint Pete Martin, Waldo
Larson., Judy Lange and Dr, Stever to the Citizen Advisory Committee for
a library in Lakeville.
Ro11 call was taken on the motion. Ayes, Lekson, Zaun, Sindt, Nelson & Spande.
80.415 Motion was made by Zaun, seconded by Spande to receive the budget and
to set September 9, 1980 as the first budget meeting.

80.416 Motion was: made by Nelson, seconded by Spande to award the purchase of
various fire equipment as recommended by the fire chief to Minnesota
Fire, Inc. for $3,486.70.

80.417 Motion was made by Spande, seconded by Nelson to adopt Ordinance No. 171
amending the City Code, Chapter T, regarding the vacation. of licensed
premises after the closing hours and to waive the second reading..
Roll call was taken on the motion. Ayes, Nelson, Spande, Lekson, Zaun & Sindt.
80.418 Motion was made by Spande, seconded by Zaun to table approval of the res-
olution Qn final approval of the Office Electronics Industrial Revenue
Bond Project until September 15.

80.419 Motion was made by Spande, seconded by Zaun to approve Resolution No. 80-92
receiving the preliminary report on the extension of utilities on the
south side of 175th Street and ordering `inclusion of those utilities with
the plans and specifications on project 80-13, and call a public hearing
for September. 30, 1980 at 9:30 at the Lakeville High Schaol..

80.420 Motion was made by Nelson, seconded by Zaun to ,approve the contract with
Consulting Engineers Diversified for step 3 of the sewer rehabilitation
project with the Metropolitan Waste Control Commission.
Roll call was taken on the motion.' Ayes, Zaun, Sndt, Nelson, Spande & Lekson.
.80.421 Motion was made by Zaun, seconded'bY Nelson to adopt Resolution No. 80-93
calling a public hearing to assess the Steinmetz property on 170th Street
for September 30, 1980 at 9:25 at the Lakeville High School.

80.422 Motion was made by Spande, seconded by Zaun to approve change order No.
1 and 2 on Oak Curve project 80-4 with Orfei & Sons.
Roll call was taken on the motion. .Ayes, Nelson, Spande, Lekson, Zaun & Sindt.
80.423 Motion was made by Zaun, seconded by Nelson to adopt Resolution No. 80-94
accepting the feasibility report and calling a public hearing on two lots
in Oak Hills for street improvements for October 20, 1980.
Roll call was taken on the motion. Ayes, Spande, Lekson, Zaun, Sindt & Nelson.
80.424 Motion was made by Zaun, seconded by Spande to adjourn the council meeting.
