CITY OF LAKEVILLE SPECIAL COUNCIL MEETING
LAKEVILLE HIGH SCHOOL
July 17, .1980
The meeting was called to order at .7:30 p.m. by Mayor Lekson.
Ro11 call was taken. Present: Councilmembers Zaun, Spande, Sindt and Mayor
T,ekson. Absent: Nelson.
Also present: .Patrick :Farrell, City Attorney; Darrell Schneider., Consulting.
City Engineer; Patrick McGarvey, City Administrator/Clerk.
At this time Mayor Lekson opened the public hearing on Project No. 80-13,
improvements to and within the Forest Hills Addition.
The City Attorney attested to the proper, legal notice published in the
paper and mailed.
At this time Mr. Schneider presented the project area and cost estimate.
He stated that the. entire estimated cost for the project was $792,300.00.
Mr. Schneider stated that a 16-inch water line .would. be constructed along
175th Street from the Forest Hills Addition to the Oak Hi11s Addition to
connect Forest Hills to the existing trunk system. in the Oak Hi11s/Dakota
Heights. area.
At this time Councilmember Nelson arrived and took his chair.
~t this time Mr. Schneider presented an outline of the public improvement
process which the City Council must follow to make. any public improvement.
Mr. Schneider stated that the estimated cost for sanitary sewer in the Forest
Hills Addition would be $30.68 per front foot plus a service line at $300
per lot brings a line up to the property line. Mr. Schneider stated that the
cost of the proposed 16-inch water line oversizing would be paid by the
City trunk fund.
He stated that the estimated front foot assessment rate for the water lateral
equivalent is $29.35 plus a service stub to the property line of $300 per
each lot.
Mr. Schneider stated that 175th Street will not have to be cut, as a sleeve
was installed when the street was improved.
Mr. Schneider stated that the street improvements in the Forest Hills Addition
would involve a 32 foot wide street with concrete curb and gutter including
catch basins and some storm sewer. improvements. He stated that the 173rd
Street .would be restored to its equivalent or better gravel condition for
the extension of the water and sewer over to Forest Hills. Mr. Schneider
presented an estimate based on a 100 foot wide lot us follows:
Sanitary sewer, $3,068.00; service stub, $300.00; water lateral, $2,935.00;
water stub, $300.00; street improvements and storm sewer, $3,094.00.
In addition there would be a City unit connection charge of $460.00 for
sewer and $625.00 per lot for water based on the 1980 rates.. In addition
there is the metro .SAC charge currently at the rate of $425.00.
Mr. Schneider went on to further explain how-the council can and must decide
the policy on the assessment of a project such as a front foot assessment,
or a unit assessment, or some arbitrary front foot figure. He explained that
these decisions had to be presented at the public hearing on the assessment
role once the project is near completion or is complete.
Mr. Schneider presented"a slide showing a schedule. of the project if it were
to be approved by the City Council on July 17th.
He stated that the plans and specifications could be .completed by his firm
by September 2, 1980, if they were authorized on July 17th. He stated that
bids could be opened on September 25, 1980, and possibly awarded by the
council at the October 6, 1980 council meeting. The contractor would possibly
start as soon as October 20, 1.980, and would be granted until September 1,
1981 to complete the entire project.

Mr. Joe Kuka asked how the utilities would get through lot 1 in the Argonne
Farms area from 173rd Street to Jonquil Avenue.
Mr. Schneider stated that the City would need to acquire an easement for the
right-of-way in this area of the project.
Mr. Schneider also stated that an easement along 173rd Street in addition
to the present 33 foot width would need to be acquired up to a permanent
easement of 60 feet plus some construction easement in areas along 173rd
Street.
Mr. John Greaves asked if there were any alternative plans to secure utility
service to the Forest Hills Addition.
M~. Schneider explained, and presented a map, indicating the Forest Hills
sewer .service would always go to the west. He explained that when the 175th
Street project was considered and eventually constructed that alternatives
were looked into and that this one being presented tonight was the most
feasible.
Ms. Lori Glass asked about the legal notice she received in that her lot
was not indicated to be receiving the water improvement under the. water part
of the notice. The mayor asked the clerk and attorney to check the notice
while the meeting progressed.
After more discussion, the. City Administrator reported that the legal notice
was in error in that it did not include certain lots in Block 1 and Block 2
of the Forest Hills Addition which are proposed to receive the water improve-
. meat but were not listed under the legal description for the water improvement
in the notice.
Mr. .Farrell explained that the council could still: move ahead and order the
project for the areas and improvements as`indicated in the notice and call
a new hearing to notify the owners of the few lots in Block land Block 2
which were not indicated in the notice as receiving the water improvement
but for which the report and project is intended to serve..
Mr. Larry Hazel asked the council about this being a good time to receive
favorable construction bids for a project plus bond bids.
The mayor explained that the City to date had received construction bids
below what the engineer had been estimating them,. and that the bond interest
rate bids had been very favorable so far. He indicated that he did not fore-
- see this continuing into 1981..
Mr. Schneider explained and answered a question that the city sanitary sewer
system .conveyance has adequate capacity for this project all the way to
the metro interceptor in Airlake Park which then conveys the sewage to the
new Empire Treatment Plant.
At this time the mayor opened the meeting to questions and comments. from the
councilmembers.
Councilmember Nelson asked about the policy the council might choose to
follow. in assessing this project either on a unit basis or a front foot basis.
Mr. Schneider stated that the proposed assessment of approximately $9,600
per lot is based on an average to a certain extent as presented.
Mayor Lekson stated that he felt that large parcels of property with .footage
along 173rd Street could not be assessed for the entire front footage at
this time,
Councilmember Spande stated that he felt the time is right for this improvement
and that bids may be good within the near future. He stated his concern is
for assessment against people who cannot afford the cost of these improvements.
Councilmember Zaun asked if a person can waive the right to a public hearing.
Mr. Farrell stated the property owner could do so.

Councilmember Zaun stated that he liked the idea of the project tieing the
water system together in that area of the city, and ha also felt that the
council needed to arrive at a fair assessment policy for the large lots and
to account the property owners' plans for the property in the future.
A citizen asked about the hook-up time limit once utilities are available
to the property.
Mr. Farrell stated that the current city requirement so that the property can
be connected to the city system within two years could be changed from a
time limit to a policy based `on health needs .only.
Mr. .Ron Gerk asked about the location of-the water proposed to be extended
along 175th Street. Mr. Schneider said that his report was based on both
sides of 175th Street being assessed for the water where it is extended along
175th Street.
Mr. Louie Szabo asked about the water being extended to the Java Court South
area.
Mr. Schneider stated that the extension could be made in the future.
80.334 Motion was made by Zaun, seconded by Nelson to close the public hearing.
Roll call was taken on the motion. Ayes, Nelson, Zaun, Lekson, Spande and Sindt.

80.335 Motion was made by Spande,. seconded by Zaun to adopt Resolution No. 80-73
ordering the improvement project. No. 80-13 and authorizing .the City Engineer
to prepare plans and specifications on the project.
Roll call was taken on the motion. Ayes; Nelson, Zaun, Lekson, Spande and Sindt.
80.336 Motion was made by Zaun, seconded by Spande to call a public hearing for
August 18, 1980, for the improvement for lots omitted from the legal
notice for the Forest Hills Addition for the watermain improvement.
Roll call was taken on the motion. Ayes, Nelson, Zaun, Lekson, Spande and Sindt.
80.337 Motion was made by Zaun, seconded by Spande to adopt. Resolution No. 80-74
calling a public hearing for Autust 18, 1980, on the issuance of industrial
development revenue bonds .for the G.T.C., Tnc. project in the amount of
$3 million.
Roll call was taken on the motion. Ayes, Nelson, Zaun, Lekson, Spande and Sindt.
80.338 Motion was made by Zaun,. seconded by Nelson to adjourn the .special council meeting.
