CITY OF LAKEVILLE SPECIAL COUNCIL MEETING
June 5, 1980
The meeting was called to order by Mayor Lekson at 7:30 p.m. at-the
Lakeville Senior High School. Roll call was taken. Present: Councilmembers
Lekson, Nelson, Zaun, Sindt. Absent.: Spande.
Also present: Patrick Farrell, City Attorney; Darrell Schneider, City Engineer
and Patrick McGarvey, City Administrator/Clerk.
At this time Mayor Lekson opened the, public hearing on the-Oak Hills Additions
proposed improvements consisting of sanitary .sewer, water, storm sewer and
street improvements.
Patrick Farrell attested to the proper legal notice both mailed and published
far the hearing.
At this time Darrell Schneider presented the proposed project. Mr. Schneider
stated that the total estimated cost of the project was $663,500.00. Mr.
Schneider showed a map of the City Comprehensive Sewer Plan and how the
Oak Hills Addition property falls into two different drainage sheds.
Mr. Schneider also showed maps of the proposed sanitary sewer system, .water
system, storm sewer system and street layout.
A-chart was shown on the serene indicating the various square foot costs
of the improvements, Sanitary sewer, $37.85 per front foot; water, $21.98
per front foot; storm sewer, $4.61 per front foot;. streets, $27.63 per front
foot with the cost varying,by lot depending on how much front footage each
lot has.
Mr. Schneider then showed a chart which proposed to assess the improvements
on a unit .basis with an equal amount for each lot. Assessments would be
sanitary sewer, $3,875; water, $2;250; storm sewer, $472; and streets,
$$3,190 for a total of $9,787.00, This figure, Mr. Schneider stated, does
not include the city unit connection charges for water and sanitary sewer
or the metro SAC charge.
At this time Mr. Tom O'Shaughnessy asked Mr. Schneider about the breakdown
of the cost for the street improvement. Mr. Schneider stated that 320
of the cost was for blacktop, 22% for classified base, 36o for concrete.
curb and gutter, and l0o for restoration.
Mr. Schneider stated that the lift station and force main part of the
sanitary sewer improvement cost is estimated at $52,000.
At this time Mr. Farrell explained how an improvement project proceeds through
the legal steps required by state law, with the next stage being the prepar-
ation of plans and specifications and taking of bids.
At this .time Mr. Gary West stated that the cost had increased considerably
since 1975 and 1976, and in his opinion a project should be done now or it
will keep on going up in cost.
Mayor Lekson stated that he felt there was a good chance of receiving very
favorable bidding on the project at this time, and that the bond interest
rates are likely to increase in 1981 and thereafter.
Mr. Farrell explained that the City assessment policy would. be to assess
this project for a period of up to 20 years with an interest rate of 8%
on the unpaid principal each year. The exact rate of interest would depend
on how much the City has to pay to .borrow the money when the bonds are sold,
which may require an interest rate higher than 80.
Mr. Farrell further stated that a property owner can pay up their assessment
on or before November-16th of each year to avoid paying the next year's
interest cost.
Councilmember Betty Sindt asked if anyone present at the hearing was negative
about the project. Nobody present stated. .,that they were.

At this time Duane Zaun stated that he favored this project now, and would
probably favor assessing it on a unit: type of assessment when .the assessment
hearing is held.for sewer and water,
80.284 Motion was made by Zaun, seconded by Nelson to close the public hearing.

80.285 Motion was made by Nelson, secnnded by Sndt to adopt Resolution No. 80-61
ordering the Oak Hills Additions improvement .project and. authorizing the
City Engineer to prepare plans and specifications for the project.
Roll call was. taken on the motion. Ayes, Nelson, Zaun, Sindt and Lekson.
Nays, none.
At this time. Mayor Lekson opened the public?hearing on the proposed utility
improvement project along 202nd Street,: Dodd Road, Holyoke Avenue and the
Aronson Park area at 8:40 p.m.
Patrick Farrell attested to the proper legal notice, both published and mailed..
for the hearing.
At this time Mr. Schneider presented maps on the overhead slide projector
showing the proposed sanitary sewer and water main extensions. The estimated
cost for the sanitary sewer .extensions is $238,000 and for the water main
extensions $601,000. Mr. Schneider also showed a.n::overhead map that
provided for some additional sanitary sewer lines which were not included
in the official preliminary report along 202nd Street.
Mr. Schneider explained that the proposed..-water extension along 202nd Street
was a 12-inch size trunk line and he showed how the line would benefit
the abutting properties as well as improve the water circulation system in
that .area of the city.
Mr. Schneider then showed an overhead map of the existing sanitary sewer
system and the proposed extensions.
Mr. Schneider stated that the estimated cost for the sanitary sewer was
$30 per front foot and water was $27.90 per front foot. In addition a
person connecting to .these lines would have to pay the city unit connection
charges, which in 1980 total $1,085 per single family house for water and
sewer plus an additional $425 for the-metro SAC charge.
Mr. Schneider then showed a chart of the estimated costs based on the
front footage for parcels of property involved in the benefited area indicating
the estimated assessments.
At this time Mayor Lekson opened up the meeting for questions and comments
from the audience. Mr. Robert Klamm, representing the Bethlehem Lutheran
Church spoke about the proposed assessments to the church for their .property
located on Iberia and 202nd Street and questioned if benefit equaled the
proposed assessment for .the footage on 202nd Street even if it is assessed
at a rate of half the total distance..
At this time the City Administrator explained the reason for estimating the
cost of extending water to the east end of Aronson Park along 202nd Street
and for extending sanitary sewer to the east end of the dark. It was
explained that the City was considering building a new City Hall-Police-
Station at the east end, and the building would at a minimum need a cty_
sanitary sewer line. The building would not necessarily need extension
of the water main along.. 202nd Street at this time as it could. be served
with an onsight well.
Mr. Chuck Zweber questioned the reason for proposing to extend water and
sanitary sewer north from 202nd Street on Holyoke Avenue.

The City Administrator explained that the reason for extending the water
and sewer in all four directions at the intersection of Holyoke and 202nd
Street and Dodd Road & Trunk Highway 50 was because of the proposed intersection
improvements to be made by the State, County and City at these two intersections
in 1981 or 1982. The City did not want to have to tear up the
new roads when they are finished to install utility Ines after the road-
projects.
Mr. Peterson, who lives along County Road 64 west of Dodd Road, objected
to the: extension of water along that segment of County Road 64. He stated
that if he was going to have to pay for water that he would also request
the sewer be installed at the same time.
Mr. Peter Friedges questioned how the City had extended the water along 210th
Street in years past without assessing he abutting property for it, The
City Administrator explained that the council made a decision at that time,
but that the City could not afford to continue extending sanitary sewer and
water trunk lines without assessing any of the costs until years later when
.they might actually be used by rural property when it is developed.
Mr. Chuck Zweber stated that his property at the northeast corner of Holyoke
Avenue and 202nd Street could not support the proposed assessments because
of its small size, in his opinion.
After other questions and comments from the .audience, Councilman Zaun spoke
about the need to have citizen input for the ,project and especially on
extending utilities in the Aronson Park area. He also stated that the
City Engineer should come up with the. cost of including sanitary sewer along
the portion of County Road 64 from Dodd Road west to Aronson Park.
Councilman Nelson stated that-he could see the-need for the water extension
only approximately 1,000 feet east of Holyoke Avenue on 202nd Street so
that the utility lines would. be under the proposed intersection improvement
project. He also stated that he would like`to see more detail for the
County Road. 64 improvements west of Dodd Road.
Mayor Lekson stated that the council would most likely continue the hearing.
to allow the engineer to come up with some of the cost data on sewer extensions
which were not .included in the original'prel,iminary report, and that the
council would be considering the viewpoints'of the citizens as to whether
or not all or any part of this .project should be ordered"in by-the council.
80.286 Motion was made by Lekson, seconded by Sindt to continue the public hearing
to July 7, 1980 council meeting.
Roll call was taken on the motion. Ayes, Lekson, Nelson, Zaun and Sndt.

80.287 Motion was made by Nelson, seconded by Lekson to authorize and direct the
City Engineer to prepare a preliminary report addendum on the sanitary sewer
extensions along County Road 64 west of Dodd Road and along 202nd Street
east of Dodd Road and east of Holyoke Avenue.
Roll call was taken on the motion. Ayes, Nelson, Zaun, Sindt and Lekson.
Nays, none.
80.288 Motion was made by Zaun,. seconded by Sindt to adjourn the special council meeting.
